I. Basic Facts:
1 . The site is zoned, "C-3M" Main Street Commercial and designa-
• ted retail on Neighborhood Plan I.
2. On July 19 9 1977, the Tigard Planning Commission approved a

conditions:
a. Easements be provided along the south and west property ;
lines for utility purposes.
b. A usable outdoor area be provided along the north % `t '
property line (subject to design revl.ew approval).
3. 18. 30.040 30.040 states "The minimum front yard shall be ten
feet, landscaped and maintained. "
4. 18.60. 150 states: "Groups of more than two parking spaces
shall be served by a service drive so that no backing move-
ments or other maneuvering within a street other
* alley will be required. "
II. Site Plan Review: du
The applicant is proposing to constrict a two story building

While normally an application would be rejected because of
these code deficiencies, it has come to stair 's , attention
that this portion of S.W. Electric Street',could be vacated. .
In order to allow these code deficiencies, a on-remonstrance
agreement for the vacation of S.W . Electric should be re-
ceived prior to issuance of a building permit or the neces-
• nary variances granted by he Planning Commission. If S W,
e Electric Street is vacated, consideration should be given ,�
to landscaping the additional area gained by that piece of .
property.
Other problems that should be corrected are as follows :
o A gravel area is specified for the outdoor recreation
space. A lawn in this area would furnish a more i plea� ing and
1 usable environment for the apartment dwellers i
• o The Tigard Planning Commission required that the 1apart-
men, a be provided with 'a "usable outdoor area" . This
area has been provided but without direct access A ` I, '"
stairway with possibly a deck should be installed to 1 ° '
provide direct access to the outdoor area. I ,
o No signing program has been submitted. This should be
subject to design review.

Building material is brick for the walls and antique gold
for the roof. The material is compatible with surrounding ,
buildings, and the building's use and 'site restrictions
limit other architectural style .
IV. Staff Recommendation:
Staff recommends approval with the following conditions
1. A non-remonstrance agreement for the vacation of S.W.
Electric be received or the neces.515ary variances granted
prior to issuance of a building permit .
2 . If S.W. Electric Street is vacated, the additional land
gained be subject to design review in order to provide ad-
ditional landscaping.
3. Gravel be deleted from the outdoor area and replaced by
lawn .
4. Direct access be provided for the apartments to the out-
door area
1 5. Si gning program be submitted fo r
des ign review.
6 . All landscaped 'areas abutting pavement be curbed.

• Preliminary Review
The following items were noted by staff and should be addressed by the

A. Site Plan
1. Parking
The Tigard Municipal Code requires a total of sip parking
spaces--four for the business, 1.5 for the apartment . Because
of site configuration and the value of existing trees on the
site, staff would recommend that the applicant investigate
joint parking with the Tlgard Health Center. It is assumed
that the apartments need for car space will come mainly in
the evening when the center is closed. In addition, the cenw
ter contains four spaces above the' code r-:' '., -d for its use.
18 .60.030 of the Tigard Municipal Code reads as follows
"Owners of two or more uses, structures, or parcels of land
may agree to utilize jointly the same parking and loading
spaces when the hours of operation do not overlap, provided
that satisfactory legal evidence is presented to the building
offic',.al in the form ;5f deeds, leases or contracts to establish ';
the joint use. "
Staff would recommend that a joint agreement be signed to al-
low parking for two car;; at the Tigard Health Center and, that
