Dear Mr. Powell a0
This letter confirms our recent, telephone conversation concerning
the public street access to the Gevurtz Property. This issue dates
back to the acquisition of additional right-of-way by the Division
of Highways for the Bonita Road over-crossing and the severance of
direct access to the subject parcel. At that time, the owner of •
the property of record was the Southern Pacific Land Company and
the Bonita Road widening was coupled with the settlement of the t fi
access problem under condemnation proceedings.
During this process , the Southern Pacific Land, Company requested

and the Division of Highways agreed to provide a public access to
the property acceptable to the City of Tigard. As part of the
proceedings , the division prepared a sketch of, the proposed access
. and submitted to the city for concurrence. I have attached a
' copy of that sketch, which was Obtained from Southern Pacific Land
Company files; indicating Nick Hiebert !s acceptance of the pro- .
rop'
posed access to be constructed by the Divi.ii,. on of Highways. Based
on this agreement, the division ha,s a contract for construction •
which is to be completed in the near future.
As I indicated previously, Mr. Gevurtz had no interest in the pro-
r ` ceedings at that time and should bear no obligation if the city
desires a change in their agreement with the Division of Highways.
Further, it is my understanding in discussing this matter with
Mr. David Baldwin of the Southern Pacific Land Company that the
condemnation proceeding clearly indicated that the Division of
Highways was obligated to provide a public access which p ;� �t would be
acceptable to the City of Tigard, which, of course, they felt they
accomplished by virtue of the sketch signed by mr. Hiebort.

Review Board's requirements for landscape and irrigation plans as per your
letter dated August 8, 1975.

. 'From these telephone conversations it is our understanding that while the
'', building permit may now be issued, no occupancy permit will be issued until
, the required landscape and irrigation plans have been submitted and approved.
I have also been informed by you that Tigard City standards for sidewalks
requite that the sidewalk from our building to the street be 5' 1- 0” wide
rather than the 2' - 6u width shown on our submitted site plan. I await
your clarification of the extent of this sidewalk - whether to our property
line or whether it must extend along the access road to Bonita Road,
„' . We will instruct the contractor to provide a 5' - 0" :ride sidewalk in con-
formance with your requirements.

provided.

1. Scale of the shade trees was unspecified. Staff

B. Mr. Olson, designer of the parking lot, speaking for
the church, said that ground cover in the form of ivy ,

1. A conditional use for this project was approved by the
Tigard Planning Commission on March 18, 1975 (CU 6 -75)
subject to the following conditions:

to City standards.

Dear Mr. Gevurtz,
Recent site inspection of cevurtz Furniture on Bonita tld.
has shown that several elements of the landscape plan have yet •
to be implemented. These elements will be itemized below and
must be satisfied before the landscape bond can Le released.
Landscape plan deficiencies:
1, A large percentage of the ivy plantings are in poor
,.,' condition and should be upgraded now and next spring.
• 2. Twenty-one "Santa Cruz" Firethorn Pyracantha 18-24"
B & B need to be platted in the northbbed as per
landscape plan.
3. One undersized Verna , Witch Hazel in the north bed
be replaced (3-4 ' B & B Required)
4. Five shore pine (8 - 10' b & b) be planted in north
bed as per plan.
5. Undersized or dead Oregon grape in north bed be
replaced (Oregon grape should be 15 - 18" B & 8) .
Fourteen azaleas be planted on northeast eorne as
per plan (41 azaleas specified 27 existing) .
7, Four shore pine (8 - ,1O' b & b) be planted in east
bed as per plat .

that since the initial Boar.d approval', his rcompany
_ - had been approached by Wash. Co Historical Society
in an attempt to
p - preserve the existing cad water
tower on the site. Their findings were that
structurally the water tower was sound and that it
could be used for pool equipment storage, a laundro-
mat or a small meeting room. If both the water
tower and the swimming pool were maintained, there
would not be enough room for the tennis courts and
their request is that the requirement of the tennis
courts be eliminated; Also the swimming pool would
need to be relocated.
Mr. Bishop submitted a site plan showing the proposed

area and, although the idea is to be applauded, if
