In reference to your phone conversation of August 27 concerting the property at
, 11490 Greenburg Road, on that date we had delivered to you checks totaling .,
$2,925 to purchase additional sewer permits as directed by Brad Roast. Your
office did not accept the checks and mentioned a problem concerning the
easement
I called to find out what this was about and you told me that you wanted us to
hold any further payment until the question of the property's designation and

Dear Ms. Ramsey:
Since our meeting on Monday, we have discussed your project with
{
representatives of the City of Tigard. We asked why they were requiring
a half-street improvement of Janis. ' The response was that your use of
the property would be a change i h use under Tigard City Ordinance.
They have a Policy that when the use 'i is .changed, an improvement is re-
r
quip red of the street abutting the property.
There are two ways that you can obtain relief from these requirements from
the 'City. The first is to appeal to the City Council , the fee for which
ch
i s $225. The second, is to obtain a ruling from the City Engineer that
the required improvements are not feasible at this time, Both of these ' -
options presume that the City is correct in their opinion - that your
use constitutes a change in use on the property. Wiile we are not
attorneys, we believe that there is some question as to whether your use
constitutes a change in use and that the City has any ability to require
a half-street improvement,
We recommend that you review this Matter with your attorney prior to
proceeding with any improvements, In the event that you wish to proceed
with the design and construction of the half-street improvement, which

would include construction of curbs, sidewalks and paving to match the
existing street, we are pr epared
to complete the design for a fee of
$3,000. We could prepare this within two weeks of receiving notice to

Site Analysis Drawings Narrative
The property at 11490 SW Greenburg Road is bordered can the south by Greenburg
Road. The next street to the east is 95th, which is also the Tri-Met bus stop
for the area The next street to the west is 97th Court.
The property is accessed by a driveway which is 31 feet wide in its entirety.
Approximately 13 feet is an the property and the remainder is located in a
25.50 foot easement adjoining the property to the east. A
There is an existing bicycle bath approximate ly .5 feet wide between the street
and the south boundary. Beyond that is an approximate 3 foot ditch.
The power and telephone lines are carried on utility poles on the south side of
Greenburg Road, crossing a lot number 2304 and angling across the easement to
the two structures at 11490 SW Greenburg Road.
The site is designated as lot number 2302 and is .36 acre in size. The west 1
boundary is 192.77 feet, then east 97.58 feet, then south 64.34, 47.76, and
92.80 feet, then west 75.93 feet.
The existing house is to be used as a residential facility for youth. The tn -
plea, after renovation, wil 1 be used as an activity area. The shed wil 1 be
removed.

savings of time which will be gained thereby).. Thereafter, a
final plan review will be conducted by City staff. Should -

The,property at 11490 SW Greenberg Road is bordered on the south by Greenburg ' r
Road. The next street to the east is 95th, which is also the Tn .-Met bus stop
for the area. The next street to the west .is 97th Court.
The property is accessed by a driveway which is 31 feet wide in its entirety.
Approximately 13 feet is on the property and the remainder is located in a
. 25.50 foot easement adjoining the property to the east.
There is an existing bicycle bath approximately 5 feet wide between the street
and the south boundary. Beyond that is an approximate 3 foot ditch.
The power and telephone l ine s are carried on ut i l ity poles on the south side of
Greenburg Road, crossing a lot number 2304 and angling across the easement to
the two structures at 11490 SW Greenburg Road.
The site is designated as lot number 2302 and is .36 acre in size. The nest
boundary is 192.77 feet, then east 97.58 feet, then south 64.34, 47.76, and
92.80 feet, then west 75.93 feet.

Road. The next street to the east is 95th, which is also the Tni-Met bus stop

The property is accessed by a driveway which is 31 feet wide in its entirety.

The Regional Evaluation Center has been providing adolescent shelter care for
Washington County since 1978. Boys referred to the Center are wards of the
Juvenile Court assigned to the temporary care and custody of the state �.
Children's Services Division. The youngsters range in age from 13-17 and spend
a maximum of 60 days in residence awaiting either a return home or placement in
a formal treatment program. •
The existing structures on the property at 11490 SW Greenburg Road will be used
to provide housing for these youth. The structure is currently being used as a
bed & breakfast/boardinghouse. We will house 6 youth. Twenty-four hour
supervi s ion. wil l be provided by adu l t staff who work 8-hour shifts. There
will be two staff in the facility during afternoon and evening hours when youth
are most active and single staff coverage during school hours and overnight.
All staff providing supervision have at least a bachelor's degree;

1. Requirement for Half Street Improvement: In consultation with Cooper •
Consurtants, Inc., engineering services, we submit the following:
''It is our opinion that a hal.f-street improvement on Greenburg Road
would be inappropriate at this time„ Construction of these
improvements constrain the design of future improvements that ate
anticipated on Greenburg Road' (see attached correspondence). We would
instead agree to participate in the cost of future improvements to
Greenburg Road.
2. Re tired Parking Area: No parking spaces for residents are needed, •

Re: Residential Care Facility on Greenburg Road, Tigard
• Dear Ms. Ramsey:
Since our meeting on Monday, we have discussed your project with
representatives of the City of Tigard. We asked why they were requiring
a half-street improvement of Janis. ' The response was that your use of
the property would be a change in use under Tigard City Ordinance.
They have a policy that when the use is changed, an improvement is re-
quired of the street abutting the property.
There are two ways that you can obtain relief from these requirements from
the City. The first is to appeal to the City Council , the fee for which
is $225. i
The second is to obtain a ruling from the City Engineer that
the required improvements are not feasible at this time. Both of these
options presume that the City is correct in their opinion - that your
use constitutes a change in use on the property. While we are not
. s attorneys, we believe that there is some question as to whether your use
constitutes a change in use and that the City has any ability to require
a half-street improvement.

We recommend that you review this matter with your attorney prior to
proceeding with any improvements. In the event that you wish to proceed
with the design and construction of the half-street improvement, which
a, 4 would include construction of curbs, sidewalks and paving to match the
existing street, we are prepared to complete the design for a fee of
$3,000. We could prepare this within two weeks of receiving notice to
