Correspondence //75 C G c/u c/6 Sef 5/09/08 FILE COPY RE: BUP2007 -00060 Mark, On January 31 of 2007, Albert Shields asked me to assist him in explaining to a contractor at the Planning counter what would be needed for a fence plan. Albert was involved as a Compliance officer because the fence was being built without having been permitted. During the conversation Albert noted that we, the Building Department would not be granting access off Bull Mountain Road, and was only expediting the plan review to help the contractor. I believe it was at Albert's suggestion I added a note to the plan to clarify a driveway couldn't be installed. The wording was chosen to keep the permitted fence on the owner's property, and clarify that a driveway couldn't be poured, or gate used for access until the City of Tigard's Engineering Department had a chance to approve or deny access from Bull Mountain Road. I remember the contractor mentioning the amount of money already invested in the project. At that point I told him I would be approving the structure only. Whether or not the fence was on the property, and would ever be able to be used for access, was not being guaranteed. I don't remember his exact words, I do remember that his response indicated he clearly understood he would be proceeding at his own risk. The plan was incomplete until the next morning when the rest was faxed in from the contractor's welder. Loraine Sellers
