Dear Mr. Taylor:
The plans you have submitted regarding the above application are approved, subject to the
conditions and requirements noted on them and/or set forth below.
BACKGROUND:
In April, 2002, when the subject property was under previous ownership, this department found
extensive Electrical, Building, and Housing Code violations, ordered the premises vacated as a
dangerous structure, and barred re- occupancy until the violations were all corrected and the
property brought into compliance. Attempts had been made by a former tenant to convert the
house from single - family to duplex without benefit of permits, approvals, or inspections.
From this point on, City records will clearly identify that this property is recognized as a single -
family residence and that the past violations have been corrected. We have arranged to
incorporate the Building and Housing Code corrections into one permit, BUP2002- 00449,
identified as a "Remodel of Single - Family Residence." The electrical corrections have already .
been completed under a separate ELC permit and have received final inspection approval.
When the work covered by this permit is complete, inspected and approved, we will accept this
structure as being in compliance with the Building and Housing Codes and may be re- occupied.
Part of this inspection will include any and all other violations of the Building or Housing Codes,
such as egress windows in bedrooms, smoke detectors where required and size of sewer line.
PLANNED CHANGES /CORRECTIONS:
The passage to be created between the living room and the wetbar area to provide free access
throughout the first floor and the expansion of the greatroom balcony are addressed sufficiently
in the submitted plans for us to issue a permit and verify compliance through the permit
inspection process.

OTHER CODE REQUIREMENTS:
The plans do show smoke alarms in the required locations. Other requirements of the Building
or Housing Codes which have previously been found lacking or inadequate at this property
include the provision of egress windows in each sleeping room and an adequate landing outside
of exterior doors. Requirements that have not previously been inspected but that will be required
before final inspection approval will be granted include the provision of protective features
required for a swimming pool. These items will be reviewed in the course of field inspection
under this BUP. A copy of Appendix B of the Oregon One and Two Family Dwelling Specialty
Code, "Swimming Pools, Spas, and Hot Tubs," is attached.
POOL HOUSE AND SETBACKS:
However, this Plan Approval for BUP2002 -00449 does not include or extend to the presence or
condition of the structure labeled as "Pool House." We have no record of a permit ever having
been issued for the construction of that building and it appears to be located in violation of
Planning and Zoning requirements regarding setbacks. Further, its current physical condition is
such that we find it to be in violation of various requirements of the Building Codes regarding
plumbing installations and fire resistant construction. Specifically, the plumbing fixtures in the
pool house lack impervious surfaces and protection from freezing and it is not known whether
they are properly vented. Further, any part of any structure that is within three feet of a property
line is required to be of one -hour fire resistive construction.
The subject of the pool house is addressed in a separate letter by this department. The issues
regarding the presence of the pool house and any setback intrusions must be addressed with the
Planning Division before Building can consider any plans for correction of the Building issues
for that structure. Accordingly, issuance of this permit, BUP2002- 00449, and any subsequent
final inspection approval will constitute approval of the use of the house itself as a single - family
residence but will not in any way constitute or imply approval or acceptance of the pool house.
That structure must be closed off and secured until such time as it is either completely removed
or all associated violations are corrected. We are approving the subject permit application
regarding the primary residence structure only to facilitate your returning it to habitable status.

cured, locked or removed to prevent access; or
10.2. The ladder or steps shall be surrounded by a barrier
which meets the requirements of Section B 105.2,

B1053 Indoor swimming pool. All walls surrounding an in-
door swimming pool shall comply with Section B 105.2, Item 9.

B105.4 Prohibited locations. Barriers shall be located so as to
prohibit permanent structures, equipment or similar objects -
frotn being used to climb the barriers.
B1053 Barrier exceptions. A swimming pool with a power
safety cover or a spa and hot tub with a safety coyer that com-
plies with ASTM F 1346 as listed in Section BIM shall be ex-
empt from the provisions of this appendix.
