Re: Fowler Middle School Minor Modification
Dear Ron:
This letter is in response to the Minor Modification request of the Fowler Middle School
Conditional Use Permit for the home located at 11130 SW Tigard Street. The school
district intends to replace the home with classroom trailers and a parking area in order
to develop a continuation school. The Director has approved this request subject to the
following Conditions of Approval:
1. Additional right -of -way shall be dedicated to the Public along the frontage of SW
Tigard Street to increase the right -of -way to 30 -feet from the centerline. The
description shall be tied to the existing right -of -way centerline. The dedication
document shall be on City forms. Instructions are available from the Engineering
Department. STAFF CONTACT: Brian Rager.
2. A Street Opening Permit will be required for this project to cover the extension of
sanitary and water services to this site. The applicant will need to submit five (5)
sets of the proposed public improvement plans for review and approval. NOTE:
These plans are in addition to any drawings required by the Building Division and
should only include information relevant to the public improvements. This permit
shall be obtained' by the applicant prior to issuance of the building permit. STAFF

3. As a part of the public improvement plan submittal, the Engineering Department
shall be provided with the name, address and telephone number of the individual
or corporate entity who will be responsible for executing the compliance agreement
and providing the financial assurance for the public improvements. STAFF

4. An agreement shall be executed by the applicant, on forms provided by the City,
which waives the property owner's right to oppose or remonstrate against a . future
Local Improvement District formed to improve SW Tigard Street. STAFF

5. The applicant's site plan shall be revised to show the proposed driveway to align
across from SW Twin Park Place. STAFF CONTACT: Brian Rager, Engineering

6. Prior to issuance of the building permit, the applicant shall pay the fee in -lieu of
constructing an on -site water quality facility. The fee is based on the total area of

7. Prior to issuance of building permits, the applicant shall submit a storm drainage
plan for the building. STAFF CONTACT: Commercial Plans Examiner.
8. It appears that existing healthy trees in excess of 12 inches in diameter will need
to be removed in order to construct this facility. Please provide an arborist report
and a mitigation plan where necessary to replace these trees. The mitigation
ratio is based on the number of trees being removed versus the total number of
existing healthy trees in excess of 12 inches in diameter. STAFF CONTACT:

9. Provide a security lighting plan for review and approval. STAFF CONTACT:

10. Provide a written sign -off by the franchised waste hauler for the design and

11. Provide a minimum of two (2) bicycle parking spaces per classroom. STAFF
CONTACT: Mark Roberts, Planning Division.
12. Provide a landscape plan for the parking lot area that provides one (1) parking
lot tree for each seven (7) parking spaces, and design features that serve to
screen the parking lot to the greatest extent possible from view of SW Tigard
Street. Because street improvements are to be deferred until development of
the larger site, street trees will not be required at this time. STAFF CONTACT:

TRAFFIC IMPACT FEE FOR Fowler Middle School Modular Classrooms
Enclosed with this letter you will find a calculation sheet showing the computation that has
been performed to determine the amount of the Traffic Impact Fee (TIE) to be paid for the
project noted above. The amount of the TIF is $1,082.
You have two payment options available to you. The first is to pay the TIF at the time you
are issued a building permit. The second is to arrange for payment over time by signing a
promissory note (if you wish to exercise this second option please contact me for additional
details). Traffic impact fees are subject to an annual increase of up to 6% if not paid or
financed prior to July 1st of each year.
Please note that you may appeal the discretionary decisions made in determining the
appropriate category and the amount of the fee based on that category. A notice of appeal
must be received by the City Recorder no later than 5:00 p.m. on March 13, 1997 and must
be accompanied by the $625.00 appeal fee required by Washington County. Although filed
with the City Recorder, an appeal would be heard by the Washington County Hearings
Officer.
