relocated to the southerly side of the building, where a concrete pad and 4' high
chain link fence will be constructed

DESIGNATION: MUE: Mixed Use Employment. The MUE zoning district is designed to apply
to a majority of the land within the Tigard Tnangle, a regional mixed use
employment district bounded by Pacific Highway (Hwy. 99), Highway 217 and
I -5. This zoning district permits a wide range of uses including major retail
goods and services, business /professional offices, civic uses and housing.

Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request. The findings and conclusions on which the decision is based are noted in
Section IV.
THIS APPROVAL SHALL BE VALID FOR 18 MONTHS
FROM THE EFFECTIVE DATE OF THIS DECISION.
SECTION III. BACKGROUND INFORMATION
Site Information:
The project address is 13333 SW 68 Parkway in the Tigard Triangle. The 8.6 acre site is located at the
southern terminus of 68 Parkway, and adjoins the intersection of Highway 217 and Interstate -5 to the
west, east, and south. Office uses adjoin the property to the north. The site is developed with an
existing 105,000 square foot office building and associated parking lot improvements. The building is
occupied by multiple tenants who utilize the structure for office space.

Proposal Description:
The proposal satisfies Condition of Approval No. 2 of Minor Modification MMD2011- 00018, and
permanently abates a fire code violation. This violation stems from the placement of a designated
smoking area too proximate to a backup generator and fuel storage area.
The proposal is to permanently abandon two existing designated smoking areas along the northern and
western sides of the existing building, and create a new designated smoking area along the southerly
side of the existing building, as demonstrated on the site plan submitted with the application. The new
smoking area will be located next to an existing door and parking area. A concrete pad measuring 15' x
20' will be constructed to house seating, urns, and other amenities. An existing 5' x 10' smoking shelter
will be moved from one of the existing smoking areas onto the pad. The pad will also be enclosed by a
4' high chain link fence with black slats.
The conversion of approximately 300 square feet of landscaping to impervious surface reduces the
amount of landscaping on site to approximately 26.5% of the total site area. The minimum landscape
area in the MUE zone is 15 %. As such, the property will remain in conformance with this standard.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW:
Section 18.360.060.0 states that a minor modification shall be approved, approved with
conditions, or denied following the Director's review and as follows:
1. The proposed development is in compliance with all applicable requirements of this
title; and
FINDING: Upon review of the proposal's plans and narrative, and as conditioned below,
staff finds that all applicable requirements of this title are satisfied.
2. The modification is not a major modification.
FINDING: Staff finds that the changes listed in TDC18.360.050.B.1 -11 are either satisfied
or do not apply. Therefore, the proposed development is not a major
modification. This criterion is met.
CONCLUSION: The proposal is in compliance with the applicable requirements of this title and
is a minor modification of existing site development.

A Minor Modification is a Type I procedure. As such, the Director's decision is final on the date it is
mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not

Portland Per your request, please find the narrative of findings for the minor plan modification
Seattle for the smoker's area relocation at Triangle Pointe.

Irvine The site is located at 13333 SW 68 Parkway within the Tigard Triangle, and is zoned
Mixed Use Employment (MUE). The plan specifically involves placing a 10'x5'
smoking shelter on a concrete pad of 250 SF, enclosed with a 4' fence.
Requirement: Per TDC 18.360.090.12.b, a minimum of 20% of the gross area
including parking, loading and service areas shall be landscaped.
Response: The response and calculations provided is an update to the recent
p p P p
calculations provided in reference to MMD2012 -0019. For the purposes of this
determination, as done in the prior minor plan modifications for the initial
redevelopment of the site, the main parking area will be used in the calculation
(excluding the "north lot "). The total area of this section of the property is 191,162 SF.
After the proposed construction of the smoker's enclosure, the landscaped square
footage will be 50,626 SF, or 26.5% of the site. See attached graphic exhibit for
detailed calculation. Therefore this standard will be met.
As demonstrated in the narrative above and on the attached graphic supporting
material, this minor modification meets all applicable criteria. Please feel free to
