APPLICATION SUMMARY FILE NAME: Triangle Pointe HVAC CASE NO.: Minor Modification (MMD) MMD2012 -00019 PROPOSAL: Minor modification to an approved plan for the exterior placement of a ground floor HVAC Unit. The MUE zoning district is designed to apply to a majority of the land within the Tigard Triangle, a regional mixed use employment district bounded by Pacific Highway (Hwy. 99), Highway 217 and I -5. Ts zoning district permits a wide range of uses including major retail goods and services, business /professional offices, civic uses and housing; the latter includes multi - family housing at a maximum density of 25 units /acre equivalent to the R -25 zoning district. A wide range of uses, including but not limited to community recreation facilities, medical centers, schools, utilities and transit - related park- and -ride lots, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360, 18.520, 18.745. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. BACKGROUND INFORMATION Site Information: The Triangle Pointe office building, built in the late 1960s for Farmers Insurance, is under new ownership and is in the process of being leased as a multi- tenant building. The original site included landscaping and a parking lot surrounding the building. Several recent modifications have accommodated a generator to the west of the building, and a revised entryway and landscaping on the north side to update the building. Proposal Description: Triangle Pointe is a multi- tenant building requiring additional HVAC capacity to serve new tenants. The proposed HVAC would replace landscaping in the northeast landscaped area adjacent to the building. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.060.0 states that a minor modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title; and FINDING: As shown in the applicant's narrative and site plan, the site would continue to meet the minimum g landsca p in standard for the MUE zone and would be screened from view as required in the landscaping and screening standards. Staff finds that all applicable requirements of this title are satisfied. This criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the changes listed in TDC18.360.050.B.1 -11 either do not apply or are not propopsed. Therefore, the proposed development is not a major modification. This criterion is met. .CONCLUSION: The proposal is in compliance with the applicable requirements of this title and it is a minor modification of a site development. SECTION V. Sacramento Irvine The site is located at 13333 SW 68 Parkway within the Tigard Triangle, and is zoned Mixed Use Employment (MUE). The plan specifically involves placing a 10'x40' concrete pad for the HVAC unit, a screening fence, and removal of 2 site trees. Requirement: Per TDC 18745.050.E.2, screening is required for air conditioning and heating systems. Response: Per Section 18745.050.B.8.d, a 6' chain link fence with slats will be provided. The adjoining property is the 1 -5 ROW and is downhill of the screened area. The unit is 5' tall. A 6' fence will adequately screen the unit. Therefore this standard will be met. Requirement: Per TDC 18.360.090.12.b, a minimum of 20% of the gross area including parking, loading and service areas shal I be landscaped. Response: For the purposes of this determination, as done in the prior minor plan modification for the initial redevelopment of the site, the main parking area will be used in the calculation (excluding the "north lot "). The total area of this section of the property is 191,162 SF. After the proposed construction of the HVAC pad area, the landscaped square footage will be 50,876 SF, or 27% of the site. See attached graphic exhibit for detailed calculation. Therefore this standard will be met. Requirement: Per TDC 18.790.030.B.2.D, no tree mitigation is required for developments which retain 75% or more of existing trees. Response: The proposed design requires the removal of 2 sweet gum trees on the east side of the building. For purposes of this calculation, the trees at the perimeter of the site were not used as existing quantity of parking lot and building trees are enough to satisfy the requirement. This area has 13 existing trees over 12 ", 11 trees will remain, which constitutes a 15% removal of trees. Therefore this standard will be 901 NS Gisan Street, Suite 100 met. Portland..
