DESIGN/BUILD AGREEMENT
WATER SYSTEM TELEMETRY UPGRADE
THIS DESIGNBUILD AGREEMENT ("Contract") is made and entered into this 8th day of
December 2005, by and between the City of Tigard, a municipal corporation of the State of
Oregon, hereinafter called "City", and Portland Engineering; Inc..hereinafter called "Consultant",
collectively known as the "Parties".
RECITALS
WHEREAS, City needs the services of a professional, technical, expert consultant, and
implementation team with the particular training, ability, knowledge, and experience possessed-
by
ossessedby Consultant and wishes to continue receiving such services from Consultant; and
WHEREAS, The Parties agree that Consultant shall provide City with such services, on a
nonexclusive basis, subject to certain conditions;
THEREFORE, The Parties v :sh to set forth the terms and conditions of their agreement in this
Design/Build Agreement.
AGREEMENT
1. SCOPE OF SERVICES/WORK
Consultant shall perform the following services under this agreement:
1.1. Design Phase Services
Design a functional Telemetry and Control System that provides high reliability and
that is easy to maintain and troubleshoot. In general, the Consultant shall prepare
specifications and drawings for (1) new Remote Terminal Unit (RTU) panels that will
accommodate all existing input/outputs (1/0), additional I/O, and spare UO, (2) new
Master Telemetry Unit, and (3) Programmable Logic Control configuration and
programming for all remote sites. See Exhibit A for a detailed description for all
design phase services.
1.2. Construction/Implementation Phase Services
Construct a functional Telemetry and Control System based on the services provided
in the design phase. In general, the Consultant shall provide installation services to
install RTU panels, and provide a complete system checkout and commissioning.
The consultant shall configure and test all radio equipment and ensure reliable
communications between each remote site and the MTU. See Exhibit A for a detailed
description for a construction phase services.
2. EFFECTIVE DATE AND DURATION OF CONTRACT
This Contract shall become effective upon signature by both Parties. Unless earlier
terminated, this Contract shall remain in full force and effect until City accepts Consultant's
completed performance or on June 2, 2006, whichever first occurs. Expiration of this
Contract shall not extinguish or prejudice City's right to enforce this Contract with respect to

any breach of a warranty of Consultant or any default or defect in Consultant performance
that has not been cured.
3. PAYMENT AND BOND
City agrees to pay Consultant an amount not exceeding THREE HUNDRED FIVE
THOUSAND FIVE HUNDRED SEVEN and 00/100 dollars ($305,507.00) (the "Guaranteed
Maximum Price" or "GMP") for the services and work required under this Contract based on
a not-to-exceed basis described in scope of work, which includes all fees and allowable
expenses relating to Consultant's performance under this Contract. The final not to exceed
amount shall be determined no later than the 75% design phase.
3.1. Payment Details
3.1.1. The maximum payment will not exceed THREE HUNDRED FIVE
THOUSAND FIVE HUNDRED SEVEN AND 00/100 DOLLARS
($305,507.00) in the 2005-06 fiscal year. Payments shall be made according
to pricing shown in Exhibit B.
3.1.2. Consultant shall prepare and submit each month to the City's Project Manager
at 13125 SW Hall Blvd., Tigard, Oregon 97223, a statement of services
rendered for the billing period, (indicating the description of each service used
in the proposal and the dollar amount of each service completed through the
stated date), together with a request for payment duly verified by the
Consultant's Representative.
3.1.3. Payment by the City shall release the City from any further obligation for
payment to Consultant for services performed or expenses incurred as of the
date of the statement of services. Payment of installments shall not be
considered acceptance or approval of any work or waiver of any defects therein.
City certifies that sufficient funds are available and authorized for expenditure
to finance costs of this contract.
3.1.4. Consultant shall include proof of payment to any and all subcontractors and
suppliers with each statement submitted to the City. The City shall retain the
right to withhold payments if required proof of payment to subcontractor and
suppliers is not included with a statement.
3.1.5. City shall pay Consultant for the amount billed each month within thirty (30)
days after receiving Consultant's billing. City shall not pay any amount in
excess of the compensation amounts set forth above nor shall City pay
Consultant any fees or costs which City reasonably disputes.
3.1.6. Retainage
The City will retain an amount not exceeding five percent (5%) from any
payments made to the Consultant until the project's final completion. In lieu of
cash retainage being held by the City, the Consultant may, in accordance with
Tigard Public Contracting Rule 40.040 (B):
3.1.6.1. Deposit bonds or securities with the City or in any bank or trust
company to be held for the benefit of the City,
3.1.6.2. Request the City deposit any amounts withheld as retainage in an
interest-bearing account for the benefit of the City, with any interest

earned accruing to the Consultant, or
3.1.6.3. At the City's discretion, deposit a surety bond in a form acceptable
to the City in lieu of all or a portion of funds to be retained.
If the city incurs any additional costs as a result of any of the options listed
above, the City may recover such costs from the Consultant by reduction of the
final payment to Consultant.
3.1.7. Final Payment
The Consultant shall notify the City in writing when the Consultant considers
the project complete, and the City shall, within 30 days after receiving the
written notice, either accept the work or notify the Consultant of work yet to be
performed on the contract. Upon acceptance by the City, the entire balance due
to the Consultant, including the retained percentage, shall be paid to the
Consultant, by the City within 30 days after the date of said final acceptance.
The City may require the Consultant to submit evidence, satisfactory to the
City's Representative, that all payrolls, material bills, and other indebtedness
connected with the project have been paid, except that in case of any disputed
indebtedness or liens, the Consultant may submit in lieu of evidence of
payment, a surety bond satisfactory to the City guaranteeing payment of all
such disputed amounts when adjudicated in cases where such payment has not
already been guaranteed by surety bond.
3.2. Bonding Details
Consultant shall supply both a performance bond and a payment bond within ten days
of contract award. All bonds shall be posted as required under Tigard Public
Contracting Rule 30.190. All bonds must be furnished by a surety company
authorized to do business in Oregon. Required bond amounts are as follows:
3.2.1. Performance Bond
Consultant shall provide the City with a performance bond in the amount of
the contract price for the entire project.
3.22. Payment Bond
Consultant shall provide the City with a payment bond in the amount of TWO
HUNDRED TWENTY TWO THOUSAND SIX HUNDRED TWENTY
THREE AND 00/100 DOLLARS ($222,623.00) which incorporates the cost
of the equipment and materials and implementation portions of the project.
Any claims made against a payment bond must comply with ORS 279C.600 to ORS
279C.265 and Tigard Public Contract Rule 40.060.
4. PREVAILING WAGE
The provisions of ORS Chapters 279A and 279C and all other Oregon and Federal provisions
pertaining to minimum salaries and wages are incorporated herein by reference as if fully set
forth. The Consultant agrees that the workmen in each trade or occupation required for the

work to be done pursuant to the contract, employed in the performance of the Contract, either
by the Consultant or Subcontractor or other person doing or contracting to do any part of the
work contemplated by the Consultant shall be paid not less than the prevailing, minimum
hourly rate of wage specified by the Commissioner of the Bureau of Labor, and attached
hereto.
For contracts $25,000 or greater, the Consultant shall pay a fee equal to one-tenth of one
percent (.001) of the price of the contract. The fee shall be paid on or before the first progress
payment or 60 days from the date work first began on the contract, whichever comes first. The
fee is payable to the Bureau of Labor and Industries and shall be mailed or otherwise delivered
to the Bureau at the following address:

5. FAILURE TO PERFORM
In the event that the Consultant fails to perform any material obligations, the City reserves
the right to give the Consultant written notice of such failure. The Consultant will then have
thirty (30) calendar days to resolve the failure. If the failure is not resolved within that thirty
(30) days after notice the City reserves the right to withhold all money that is due and
payable to the Consultant. Such a remedy is in addition to other remedies that might be
available to the City. Moreover, the City reserves the right to terminate the contract if the
Consultant exceeds thirty (30) days of non-performance.
6. CHANGES
This Contract, including all exhibits attached hereto, shall not be waived, altered, modified,
supplemented, extended or amended, in any manner whatsoever, except by written
instrument, executed by both parties. Such waiver, alteration, modification, supplement,
extension or amendment, if made, shall be effective only in the specific instance and for the
specific purpose given. The parties acknowledge and agree that this Contract may be
amended to specifically provide for additional Consultant services that are within or directly
related to the Scope of Services/Work.
7. KEY PERSONNEL
Consultant acknowledges and agrees that the City selected Consultant and is entering into
this Contract because of the special qualifications of Consultant's key personnel. In
particular, through this Contract, City is engaging the expertise, experience, judgment, and
personal attention of Mike Hogan, P.E. ("key personnel"). Consultant shall not reassign,
transfer, or reduce the hours of key personnel to other duties or positions, to the extent that
the key personnel are/is no longer available to provide City with his/her/their expertise,
experience,judgment, and personal attention, without first obtaining the City's prior written
consent to such reassignment or transfer. In the event Consultant requests that City approve
a reassignment or transfer of the key personnel, City shall have the right to interview, review

the qualifications of, and approve or disapprove the proposed replacement(s).
8. INDEPENDENT CONSULTANT STATUS/CONSULTANT WARRANTIES
Consultant certifies that:
8.1. Consultant acknowledges that for all purposes related to this Agreement, Consultant is and
shall be deemed to be an independent Consultant as defined by ORS 670.600 and not an
employee of City, shall not be entitled to benefits of any kind to which an employee of
City is entitled and shall be solely responsible for all payments and taxes required by law.
Furthermore, in the event that Consultant is found by a court of law or any administrative
agency to be an employee of City for any purpose, City shall be entitled to offset
compensation due, or to demand repayment of any amounts paid to Consultant under the
terms of this Agreement, to the full extent of any benefits or other remuneration
Consultant receives (from City or third party) as a result of said finding and to the full
extent of any payments that City is required to make (to Consultant or to a third party) as a
result of said finding.
8.2. The undersigned Consultant hereby represents that no employee of the City, or any
partnership or corporation in which a City employee has an interest, has or will receive
any remuneration of any description from Consultant, either directly or indirectly, in
connection with the letting or performance of this Agreement, except as specifically
declared in writing.
8.3. If this payment is to be charged against Federal funds, Consultant certifies that he or she is
not currently employed by the Federal Government and the amount charged does not
exceed his or her normal charge for the type of service provided.
8.4. Consultant and its employees, if any, are not active members of the Oregon Public
Employees Retirement System and are not employed for a total of 600 hours or more in
the calendar year by any public employer participating in the Retirement System.
8.5. Consultant certifies that it currently has a City business license or will obtain one prior to
delivering services under this Agreement.
8.6. Consultant is not an officer, employee, or agent of the City as those terms are used in ORS
30.265.
8.7. Consultant shall be free from City's direction and control over the means and manner of
providing the labor or service, subject only to the specifications of the desired results.
Consultant is responsible for obtaining all assumed business registrations or professional
occupation licenses required by state or local law. Consultant shall furnish the tools or
equipment necessary for the contracted labor or services.
8.8. Consultant agrees, warrants, represents and certifies that:
8.8.1. Consultant is engaged as an independent Consultant and will be responsible for

any federal or state taxes applicable to any payments made under this Contract.
8.8.2. Consultant has filed federal and state income tax returns in the name of the
business, for the previous year, for labor or services performed as an independent
Consultant in the previous year.
8.8.3. Consultant agrees and certifies that it is a corporation in good standing and
licensed to do business in the State of Oregon. Consultant agrees that it has
complied and will continue to comply with all Oregon laws relating to the
performance of Consultant's obligations under this Contract.
8.8.4. The work or services performed under this Contract shall be performed in a good
and workmanlike manner and in accordance with the degree of skill and diligence
normally employed by professional consultants performing the same or similar
services at the time and location such services are performed.
8.8.5. Consultant has the power and authority to enter into and perform this Contract
and, when executed and delivered, this Contract shall be a valid and binding
obligation of Consultant enforceable in accordance with its terms.
8.8.6. Consultant has read, understands and agrees to be bound by each of the terms and
conditions of this Contract.
8.8.7. Consultant represents that Consultant is not an employee of the City, is not
currently employed by the Federal Government, meets the specific independent
contractor standards of ORS 670.600.
8.8.8. Consultant is not eligible for any Federal Social Security, unemployment
insurance, or workers' compensation benefits from compensation or payments
paid to Consultant under the contract.
8.8.9. Upon City's request, Consultant shall provide City with evidence reasonably
satisfactory to City confirming the foregoing covenants and warranties.
9. OTHER CONSULTANTS
City may undertake or award other contracts for additional or related work, and Consultant
shall filly cooperate with such additional Consultants and with any City employees
concerned with such additional or related work, and shall coordinate the performance of
work under this Contract and contract documents, with such additional or related work. If
such award results in additional work for consultant beyond the scope of this agreement, City
will negotiate with consultant for the payment of additional compensation. Consultant shall
not commit or permit any act which will interfere with the performance of work by any other
Consultant or by any City employee. Consultant shall notify City as soon as possible if work
being performed by any other consultant is interfering with or will interfere with the work to
be performed by Consultant under this Agreement.
10. SUBCONSULTANTS, ASSIGNMENT; SUCCESSORS-IN-INTEREST
10.1. Except as specifically authorized in the contract documents, Consultant shall not
make any subcontract with any other party for furnishing any of the work and
services contemplated under the contract documents or assign or transfer any interest
in this Contract, without obtaining the express prior written consent of City. No list
of subcontractors approved by City may be changed or departed from except as
consented to by City in writing. Whenever City consents to the substitution of one
subcontractor for another, if any reduction in cost to the Consultant result there from

the amount thereof shall be passed on to City as a reduction in the amount to be paid
to the Consultant for the performance of the work.
10.2. The Consultant shall be wholly responsible for the performance of all subcontractors
and for their acts, errors and omissions, and those of persons either directly or
indirectly employed by the consultant to the same extent that Consultant is liable to
City under this Agreement, and the fact that subcontractors are subject to the approval
of City shall not affect the Consultant's responsibility in this regard. In any case, this
Contract shall be binding upon and shall inure to the benefit of the parties hereto, and
their respective successors and assigns, if any.
10.3. The Consultant shall bind every subcontractor to all terms and conditions anywhere
contained in the contract documents as far as applicable to the work of such
subcontractor so that the subcontractor assumes toward the Consultant and toward the
work all the obligations and responsibilities that the contract assumes toward City as
to the performance of the subcontractor's portion of the work.
10.4. Nothing contained in the contract documents shall be construed to create any contract
between City and any subcontractor. Subcontracts must be let pursuant to applicable
Oregon Statues and Administrative Rules.
11. NO THIRD-PARTY BENEFICIARIES
City and Consultant are the only parties to this Contract and are the only parties entitled to
enforce its terms. Nothing in this Contract gives, is intended to give, or shall be construed to
give or provide, any benefit or right, whether directly or indirectly or otherwise, to third
persons unless such third persons are individually identified by name herein and expressly
described as intended beneficiaries of the terms of this Contract.
12. PAYMENT OF LABORERS; PAYMENT OF TAXES
Consultant shall:
12.1. Make payment promptly, as due, to all persons supplying to the Consultant labor and
material for the prosecution of the work provided for in the contract documents;
12.2. Pay all contributions or amounts due the under the Industrial Accident Fund form the
Consultant or subcontractor incurred in the performance of this Agreement;
12.3. Not permit any lien or claim to be filed or prosecuted against the City on account of
any labor or material furnished; and
12.4. Pay to the Department of Revenue all sums withheld from employees pursuant to ORS
316.167.
If Consultant fails, neglects or refuses to make prompt payment of any claim for labor,
services, or goods furnished by any person in connection with this Contract as such claim
becomes due, City may pay such claim to the person furnishing the labor or services and

charge the amount of the payment against funds due or to become due Consultant by reason
of the Contract.
The payment of a claim in this manner shall not relieve Consultant or Consultant's surety
from obligation with respect to any unpaid claims.
Consultant and its subcontractors, if any, are subject to Oregon Workers' Compensation Law,
which requires all employers that employ subject workers who work under this Contract in
the State of Oregon to comply with ORS 656.017 and provide the required workers'
compensation coverage, unless such employers are exempt under ORS 656.126. Consultant
shall ensure that each of its subcontractors, if any, complies with these requirements.
13. COMPLIANCE WITH APPLICABLE LAW
13.1. Consultant shall adhere to all applicable laws governing its relationship with its
employees, including but not limited to laws, rules, regulations, and policies concerning
workers'compensation, and minimum and prevailing wage requirements.
13.2. To the extent applicable, the Consultant represents that it will comply with Executive
Order 11246 as amended, Executive Order 11141, Section 503 of the Vocational
Rehabilitation Act of 1973 as amended and the Age Discrimination Act of 1975, and all
rules and regulations issued pursuant to the Acts.
13.3. As provided by ORS 279C.525, all applicable provisions of federal, state or local
statutes, ordinances and regulations dealing with the prevention of environmental
pollution and the preservation of natural resources that affect the work under this
contract are by reference incorporated herein to the same force and affect as if set forth
herein in full. If the Consultant must undertake additional work due to the enactment of
new or the amendment of existing statutes, ordinances or regulations occurring after the
submission of the successful bid, the City shall issue a Change Order setting forth the
additional work that must be undertaken. The Change Order shall not invalidate the
Contract and there shall be, in addition to a reasonable extension, if necessary, of the
contract time, a reasonable adjustment in the contract price, if necessary, to compensate
the Consultant for all costs and expenses incurred, including overhead and profits, as a
result of the delay or additional work.
14. INSURANCE
Consultant and its subcontractors shall maintain insurance acceptable to City in full force and
effect throughout the term of this contract. Such insurance shall cover all risks arising
directly or indirectly out of Consultant's activities or work hereunder, including the
operations of its subcontractors of any tier. Such insurance shall include provisions that such
insurance is primary insurance with respect to the interests of City and that any other
insurance maintained by City is excess and not contributory insurance with the insurance
required hereunder. The policy or policies of insurance maintained by the Consultant and its
subcontractor shall provide at least the following limits and coverages:
14.1. Commercial General Liability Insurance: Consultant shall obtain, at Consultant's
expense, and keep in effect during the term of this contract, Comprehensive General
Liability Insurance covering Bodily Injury and Property Damage on an "occurrence"

form (1996 ISO or equivalent). This coverage shall include Contractual Liability
insurance for the indemnity provided under this contract. The following insurance will
be carried:

14.2. Professional Liability Insurance: Consultant shall obtain, at Consultant's expense, and
keep in effect during the term of this contract, Professional Liability Insurance covering
any damages caused by an error, omission or any negligent acts. Combined single limit
per occurrence shall not be less than $1,000,000, or the equivalent. Annual aggregate
limit shall not be less than$?99A,-999-and filed "claims-made" form.
14.3. Commercial Automobile Insurance: Consu t shall also obtain, at Consultant's
expense, and keep in effect during the term of the contract, Commercial Automobile
Liability coverage for hired and non-owned vehicles. The Combined Single Limit per
occurrence shall not be less than$1,000,000.
14.4. Workers' Compensation Insurance: The Consultant, its subcontractors, if any, and all
employers providing work, labor or materials under this Contract are subject employers
under the Oregon Workers' Compensation Law and shall comply with ORS 656.017,
which requires them to provide workers' compensation coverage that satisfies Oregon
law for all their subject workers. Out-of-state employers must provide Oregon
workers' compensation coverage for their workers who work at a single location within
Oregon for more than 30 days in a calendar year. Contractors who perform work
without the assistance or labor of any employee need not to obtain such coverage."
This shall include Employer's Liability Insurance with coverage limits of not less than
$100,000 each accident.
14.5. Additional Insured Provision: The City of Tigard, Oregon, its officers, directors, and
employees shall be added as additional insureds with respect to this contract. All
Liability Insurance policies, except Professional Liability, will be endorsed to show this
additional coverage.
14.6. Notice of Cancellation: There shall be no cancellation, material change, exhaustion of
aggregate limits or intent not to renew insurance coverage without 30 days written
notice to the City. Any failure to comply with this provision will not affect the
insurance coverage provided to the City. The 30 days notice of cancellation provision
shall be physically endorsed on to the policy.
14.7. Insurance Carrier Rating: Coverage provided by the Consultant must be underwritten

by an insurance company deemed acceptable by the City. The City reserves the right to
reject all or any insurance camer(s) with an unacceptable financial rating.
14.8. Certificates of Insurance: As evidence of the insurance coverage required by the
contract, the Consultant shall furnish a Certificate of Insurance to the City. No contract
shall be effected until the required certificates have been received and approved by the
City. The certificate will specify and document all provisions within this contract. A
renewal certificate will be sent to the above address 10 days prior to coverage
expiration.
14.9. Independent Contractor Status: The service or services to be rendered under this
contract are those of an independent contractor. Consultant is not an officer, employee
or agent of the City as those terms are used in ORS 30.265.
14.10. Primary Coverage Clarification: All parties to this contract hereby agree that the
Consultant's coverage will be primary in the event of a loss.
14.11. Cross-Liability Clause: A cross-liability clause or separation of insureds clause will be
included in any general liability policies required by this contract.
Consultant's insurance policy shall contain provisions that such policies shall not be canceled
or their limits of liability reduced without thirty (30) days prior notice to City. A copy of each
insurance policy, certified as a true copy by an authorized representative of the issuing
insurance company, or at the discretion of City, in lieu thereof, a certificate in form satisfactory
to City certifying to the issuance of such insurance shall be forwarded to:

Such policies or certificates must be delivered prior to commencement of the work. Ten days
cancellation notice shall be provided City by certified mail to the name at the address listed
above in event of cancellation or non-renewal of the insurance.
The procuring of such required insurance shall not be construed to limit Consultant's liability
hereunder. Notwithstanding said insurance, Consultant shall be obligated for the total
amount of any damage, injury, or loss caused by negligence or neglect connected with this
contract.
15. INDEMNIFICATION
Consultant warrants that all its work will be performed in accordance with generally accepted
professional practices and standards as well as the requirements of applicable federal, state
and local laws, it being understood that acceptance of a consultant's work by City shall not
operate as a waiver or release.

Consultant agrees to indemnify and defend the City, its officers, agents and employees and
hold them harmless from any and all liability, causes of action, claims, losses, damages,
judgments or other costs or expenses including attorney's fees and witness costs and (at both
trial and appeal level, whether or not a trial or appeal ever takes place) that may be asserted by
any person or entity which in any way arise from, during or in connection with the
performance of the work described in this contract, except liability arising out of the negligence
of the City and its employees. If any aspect of this indemnity shall be found to be illegal or
invalid for any reason whatsoever, such illegality or invalidity shall not affect the validity of
the remainder of this indemnification.
16. CONFIDENTIALITY
No reports, information and data given to or prepared or assembled by Consultant under the
contract documents shall be made available by Consultant to any individual or organization
(except City) without the prior written approval of City.
17. RECORDKEEPING
Consultant shall maintain all fiscal records relating to this Contract in accordance with
generally accepted accounting principles. In addition, Consultant shall maintain any other
records pertinent to this Contract in such a manner as to clearly document the Consultant's
performance hereunder. All such fiscal records, books, documents, papers, plans, and
writings shall be retained by Consultant and kept accessible for a minimum of three (3) years,
except as required longer by law, following final payment and termination of this Contract,
or until the conclusion of any audit, controversy or litigation arising out of or related to this
Contract, whichever date is later.
18. ACCESS TO RECORDS
Consultant agrees that City and its authorized representatives shall have access to all books,
documents, papers and records of the Consultant which are directly related to the Contract
for the purpose of making any audit, examination, copies, excerpts and transcripts.
19. FOREIGN CONSULTANT
If Consultant is not domiciled in or registered to do business in the State of Oregon,
Consultant shall promptly provide to the Oregon Department of Revenue and the Oregon
Corporation Division all information required by those agencies relative to this Contract.
20. GOVERNING LAW; JURISDICTION; VENUE
This Contract shall be governed and construed in accordance with the laws of the State of
Oregon without regard to principles of conflicts of law. Any claim, action, suit or proceeding
(collectively, the "Claim") between City and Consultant that arises from or relates to this
Contract shall be brought and conducted solely and exclusively within the circuit court of
Washington County for the State of Oregon. If the claim must be brought in a federal forum,
then it shall be brought and conducted solely and exclusively within the United States
District Court for the District of Oregon. Consultant, by its execution of this Contract,
hereby consents to the in personam jurisdiction of said courts.

21. OWNERSHIP OF WORK PRODUCT
Upon completion of the work pursuant to this project, Consultant grants to City a
nonexclusive, nontransferable, royalty-free license to use any work products, including
Custom Software, furnished to City first made by Consultant during the Telemetry System's
useful lifetime.
Except as otherwise expressly provided, no license or other right is hereby transferred to
City, including any license by implication, estoppel or otherwise, under any patent, patent
application, trade secret, trademark or copyright. All domestic and foreign rights and title to
inventions, whether patentable or not, and copyrights, solely or jointly conceived by
Consultant, its employees, associates, or subcontractors, arising from work performed
hereunder, or previously conceived in anticipation of consulting work to be performed in
regard to City's engagement of Consultant, shall be the exclusive property of Consultant.
22. PRODUCT DELIVERABLES DATA FORMAT
To the extent Consultant's work or services under this Agreement consists of or includes
tabular or GIS data, textural information, maps, graphic documents or CAD drawings, the
Consultant shall provide all such work product data to the City in the following formats:
22.1. Tabular data in Microsoft Access XP/2002, for Microsoft Windows 2000 Operating
System or Microsoft Excel XP/2002, for Microsoft Windows 2000 Operating System
format, if appropriate.
22.2. GIS data ip. ESRI.e00, geodatabase, or shapefile format.
22.3. All text information in Microsoft Word XP/2002, for Microsoft Windows 2000
Operating System.
22.4. All finished maps or graphics documents in an Adobe PDF file format or as a
Postscript file so that the City can print copies of these maps or graphic documents.
22.5. All CAD drawings in AutoCAD 2002 format.
23. ERRORS
Consultant shall perform such additional work as may be necessary to correct errors in the
work required under this Contract without undue delays and without additional cost to City.
24. TERMINATION
24.1. This Contract may be terminated at any time by mutual consent of both parties.
24.2. Consultant may terminate this Contract upon thirty (30) days' written notice to City if
City fails to pay Consultant pursuant to the terms of this Contract and City fails to
cure within thirty (30) days after receipt of Consultant's notice or such longer period
of cure as Consultant may specify in such notice.
24.3. City, in its sole discretion, may terminate this Contract, in whole or in part, upon

thirty (30) days notice to Consultant.
24.4. City may terminate this Contract, in whole or in part, immediately upon notice to
Consultant, or at such later date as may be established by City in such notice, upon
the occurrence of the following events:
24.4.1. Federal or state laws, regulations or guidelines are modified or interpreted in
such a way that the work or services provided under this Contract is
prohibited or City is prohibited from paying for such work or services from
the planned funding source;
24.4.2. Consultant no longer holds any license or certificate that is required to
perform the work or services; or
24.4.3. Consultant commits any material breach or default of any covenant, warranty,
obligation, certification or agreement under this Contract, fails to perform the
work or services under this Contract within the time specified herein or any
extension thereof, or so fails to pursue the work or services as to endanger
Consultant's performance under this Contract in accordance with its terms,
and such breach, default or failure is not cured within ten (10) days after
delivery of City's notice or such longer period as City may specify in such
notice.
24.5. In the event of termination under paragraphs 25.1, 25.2, 25.3 or 25.4.1, Consultant's
sole remedy shall be a claim for the sum designated for accomplishing the work or
services multiplied by the percentage of work or services completed and accepted by
City, plus reasonable termination expenses as agreed to by the parties less previous
amounts paid and any claim or claims which the City has against Consultant. If
previous amounts paid to Consultant exceed the amount due to Consultant under this
paragraph 25.5, Consultant shall pay any excess to City upon demand.
24.6. In the event of termination under paragraphs 25.4.2 or 25.4.3, City shall have any
remedy available to it in law or equity.
24.7. Upon receiving a notice of termination, Consultant shall immediately cease all
activities under this Contract, unless expressly directed otherwise by City in the
notice of termination. Further, upon termination, Consultant shall deliver to City all
contract documents, information, works-in-progress and other property that are or
would be deliverable had the Contract been completed. Upon City's request,
Consultant shall surrender to anyone City designates, all documents, research or
objects or other tangible things needed to complete the work or services.
25. ATTORNEY FEES
If a suit or action is filed to enforce any of the terms of this Contract, the prevailing party
shall be entitled to recover from the other party, in addition to costs and disbursements
provided by statute, any sum which a court, including any appellate court, may adjudge
reasonable as attorney fees.

26. FUNDS AVAILABLE AND AUTHORIZED
City has sufficient funds currently available and authorized for expenditure to finance the
costs of this Contract.
27. SEVERABILITY
The parties agree that if any term or provision of this Contract is declared by a court of
competent jurisdiction to be illegal or in conflict with any law, the validity of the remaining
terms and provisions shall not be affected, and the rights and obligations of the parties shall
be construed and enforced as if the Contract did not contain the particular term or provision
held to be invalid.
28. FORCE MAJEURE
Neither City nor Consultant shall be held responsible for delay or default caused by fire, riot,
acts of God, or war where such cause was beyond, respectively, City's or Consultant's
reasonable control. Consultant shall, however, make all reasonable efforts to remove or
eliminate such a cause of delay or default and shall, upon the cessation of the cause,
diligently pursue performance of its obligations under this Contract.
29. WAIVER
The failure of City to enforce any provision of this Contract shall not constitute a waiver by
City of that or any other provision.
30. RECYCLABLE MATERIALS
Consultant shall use recyclable products to the maximum extent economically feasible in the
performance of this Contract.
31. DRUG TESTING PROGRAM
ORS 279C.505 requires that all public improvement contracts contain a provision requiring
contractors to demonstrate that an employee drug-testing program is in place. The
Consultant demonstrates that a drug-testing program is in place by signing of the contact.
The drug testing program will apply to all employees and will be maintained for the duration
of the Contract awarded. Failure to maintain a program shall constitute a material breach of
contract.
32. CONSULTANT'S EMPLOYEE MEDICAL PAYMENTS
Consultant agrees to pay promptly as due, to any person, co-partnership, association or
corporation furnishing medical, surgical, and hospital care or other needed care and attention
incident to sickness or injury to the Consultant's employees, all sums which the Consultant
agreed to pay for such services and all money and sums which the Consultant collected or
deducted from employee wages pursuant to any law, contract or agreement for providing or
paying for such service.
33. NOTICE
Except as otherwise expressly provided in this Contract, any communications between the
parties hereto or notices to be given hereunder shall be given in writing by personal delivery,
facsimile or mailing, postage prepaid, to Consultant or City at the address or number set forth

on the signature page of this Contract, or to such other addresses or numbers as either party
may hereafter indicate pursuant to this paragraph 32. Any communication or notice so
addressed and mailed shall be deemed to be given five (5) days after mailing. Any
communication or notice delivered by facsimile shall be deemed to be given when receipt of
the transmission is generated by the transmitting machine. To be effective against City, such
facsimile transmission must be confirmed by telephone notice to the City Manager. Any
communication or notice by personal delivery shall be deemed to be given when actually
delivered.
34. COMPLETE AGREEMENT
This Contract and attached exhibits constitutes the entire agreement between the parties. No
waiver, consent, modification, or change of terms of this Contract shall bind either party unless
in writing and signed by both parties. Such waiver, consent, modification, or change if made,
shall be effective only in specific instances and for the specific purpose given. There are no
understandings, agreements, or representations, oral or written, not specified herein regarding
this Contract. Consultant, by the signature of its authorized representative, hereby
acknowledges that he has read this Contract, understands it and agrees to be bound by its terms
and conditions.
The Consultant and the City hereby agree to all provisions of this Contract.

Section 1: System Overview
The current SCADA telemetry system for the City of Tigard municipal water system is nearing
the end of its service life and will need to be replaced. The City of Tigard water distribution
system consists of many reservoirs, pump stations and valves that control the storage and
distribution of water to the City. The current telemetry system consists of a Master Telemetry
Unit (MTU) located in the city office communicating to 14 Remote Telemetry Units (RTU) over
leased telephone lines. A personal computer (PC) in the city office running Prosoft software is
used for interfacing, configuring and maintaining the telemetry system. This PC also has some
basic control logic capability. Another PC in the city office running Wonderware Intouch
Software provides operator input to the system.
There are several factors affecting the reliability and usability of the current system. These
issues are listed below.
1. The Aquatrol SCADA telemetry system is built on old technology making maintenance
difficult. The Prosoft Interface to the Master Telemetry Unit (MTU) is implemented
through a personal computer (PC) with a proprietary DOS application. The Remote
Telemetry Units (RTU) also requires a DOS application for configuration and
maintenance. Using new technology, SCADA Telemetry systems can be designed using
"off the shelf' components.
2. Polling rates are very slow, up to 3 minutes.
3. The Wonderware Operator Interface (OI) application runs on a separate PC. The
operating system on this PC and the Wonderware software are both at least 3 versions
behind the latest releases.
4. Spare parts for the system are not available locally and shall be ordered from the factory.
5. Additional control hardware is required at several remote sites due to the limited
capabilities of the current system. Specifically, stand alone loop controllers are required
to control valves.
6. The current hardware replacement costs are very high.
7. The RTU panel interface wiring has very little fuse protection. Periodic instrument and
control component failures result from no over current (lack of fusing) protection for the
devices.
Section 2: RTU Site Information
The following pages provided details on each RTU site including the location, input and output
(I/O) requirements and panel size and condition. For each site the table shows the current
available I/O as well as the required I/O which includes the existing utilized I/O points and
additional I/O that will be needed to satisfy the city's control objectives. The new system shall
also include installed spare 1/0 points at each location for each type of I/O totaling 25% of the
required I/O (e.g. if 8 analog inputs are required at a given site, a minimum of 2 spares for a total
of 10 analog inputs shall be installed for this project). The minimum total UO count at each site
shall be 6 digital inputs, 6 digital outputs, and 2 analog inputs. Four digital inputs have been
included in the required I/O count for security features such as door and hatch switches for

intrusion detection. One new discrete input has been added to each site for power loss
monitoring.

Section 3: Requirements for new Telemetry and Control System
The new Telemetry and Control System will use wireless radio transmission for communicating
between the remote sites and the water building.
General Requirements:
Portland Engineering, Inc. hereinafter called the "System Integrator (SI)" is shall design, and
install a complete, functional Telemetry and Control System that provides high reliability and
that is easy to maintain and troubleshoot. In order to meet this requirement, the following tasks
shall be completed.
1. All RTU's shall be replaced with new control and communication hardware. Each RTU
shall be a fully functional programmable logic controller(PLC) capable of controlling
local equipment.
2. The results of the radio site survey determined that a Master Telemetry Unit (MTU) is
required in the new system. A licensed frequency is required due to location issues;
therefore, a serial communications network utilizing a MTU to control the
communications is required. In this case the SI shall provide a new MTU that will
coordinate all network communications. The MTU shall be a fully functional
programmable logic controller with an Ethernet interface for Operator Interface and data
acquisition.
3. The current leased line communication system shall be replaced by radio
communications. Each remote site and the City office shall have a new radio transmitter
and receiver installed. The City of Tigard had a detailed radio survey conducted of all
remote sites to determine feasible radio frequencies, necessary equipment, and
transmission paths. The results of this survey have been provided to the SI. The City
will obtain services for a FCC radio license.
4. The SI shall design the new RTU panels to accommodate all existing I/O, additional 1/0,
and spare I/O noted in this scope of work. The SI shall provide detailed panel drawings
and electrical schematics for each site. It is expected that the existing panel enclosures
will be reused so the design of the new components shall fit within these enclosures. All
equipment shall be pre-wired to a back panel by a UL certified panel shop and include a
UL open panel label. The new RTU design shall include UPS backup power supply.
Additional panel design requirements are covered in Section 9.
5. The Sl shall provide engineering for PLC configuration and programming for all remote
sites. The PLC programming shall satisfy the control strategies included in this
document.
6. The SI shall provide installation service to install panels with licensed electricians, and
provide a complete systern checkout and commissioning. The SI shall provide
installation service for additional conduit, wire and field device termination for any new
I/O that is noted in this scope of work.
7. The SI shall configure and test all radio equipment and ensure reliable communications
between each remote site and the City Office.
8. The existing Operator Interface (OI) computer in the City Office shall be replaced with a
new PC provided by the SI. The computer shall meet the specifications in Section 4:
Hardware Recommendations.

9. The new OI shall include upgraded OI software including Wonderware Intouch software
upgraded to version 8.0 or newer. The SI shall provide a Wonderware "Muni Suite"
software package for installation on the new PC. The additional components (InSQL,
Active Factory, SCADAlarm) in the Muni Suite package will be used for data collection,
reporting and remote alarming. The SI shall develop new applications for the operator
interface, data collection and reporting, and remote alarming. The Muni Suite software
includes Wonderware Active Factory tools for reporting. The SI shall include two
additional Active Factory licenses to be installed on existing City of Tigard PC's that will
be used for generating reports and viewing archived data. The new OI computer shall
include IO server software for communication with the control system.
10. The SI shall provide a stand alone alarm autodialer to be used as a backup to
SCADAlarm autodialer. The purpose of this autodialer is to provide an alarm in the
event of a computer failure that would prevent SCADAlarm from providing alarms. The
autodialer shall be wired to a digital output on the MTU PLC for alarming if the OI PC
fails. The autodialer requirements are given in Section 4: Hardware Specifications.
11. The SI shall provide a laptop computer to be used by the city for remote access and as a
backup Operator Interface. The computers shall meet the specifications in Section 4:
Hardware Recommendations. This laptop computer shall be configured to be an
emergency Operator Interface that would only be used temporarily if the main Operator
Interface PC were to fail. This computer shall include a Wonderware Intouch Runtime
license and 1/0 server for communicating with the control system.
12. The SI shall provide a second laptop computer to be used by the city for system
maintenance. This computer shall meet the specifications in Section 4: Hardware
Recommendations. This computer shall include PLC programming software and
programming cable.
13. The SI shall provide a 4 port 10/100 mbs network hub for connection between the MTU
PLC and the OI PC.
14. The City will provide two (2) new printers for reports and other printing needs. The
printers shall meet the specifications recommended by the SI; see, Section 4: Hardware
Recommendations.
15. The SI shall provide a new multimeter tester. The tester shall meet the specifications in
Section 4: Hardware Recommendations.
16. The SI shall include 52,500 for workstation furniture. The type and quantity of furniture
will be specified by the City with the recommendation of the OI at a later date but before
the completion of the project.
17. The SI shall provide a pressure test kit for calibrating pressure transmitters. See Section
4: Hardware Recommendations for specifications.
Exceptions to the Scope of Work:
1. Any field work for modifying existing equipment for enhanced control; this includes
remote generator starting, generator fuel level, chlorine injection pump status, relief valve
status, modifying valves to provide remote operation, installation of new sensors or
hardware for enhanced control (flow meters, pressure sensors, level sensors, new valves
or valve modifications). The need for the items described above will be evaluated by the
City and the SI and completed under a different project.

2. Telemetry sites (416 and #17) are excluded from this project.
3. The City of Tigard has provided as part of the ASR 42 Project five 1-inch and two 2-inch
conduits.
4. Equipment and installation for future Site #18 is excluded from this project.
5. Any work for Site #10 (ASR 42) is excluded from this project. All worked performed by
the SI for this site is under a separate contract.
6. The City of Tigard shall obtain the required FCC radio license under a separate contract.
7. The project budget assumes that the existing Wonderware Development license shall be
retired and replaced with a Muni-Suite Development license. If the City decides at a time
during the project construction to keep the existing license, a cost of$7,425 will be added
to the total project cost.

Schedule:
SI shall provide a project schedule two weeks after a notice to proceed is issued. The SI shall
prepare and submit to the City, within 14 calendar days after notice to proceed, a practicable
schedule showing the order in which the SI proposes to carry out the work, the dates on which
the important features of the work will start, and the contemplated dates for completing same. In
addition to a time-scaled bar chart schedule depicting the project critical path, the SI shall submit
a detailed CPM logic diagram. At a minimum, the SI shall meet with City and include the
following in the schedule:
1. Project Kickoff Meeting
2. Schematic Design Review
3. Preliminary Design Review (75%)
4. Final Design Review
5. Implementation Management
6. Substantial Completion Inspection/Punch List
7. Final Completion Inspection/Punch List
8. 30 Day Warranty Inspection
At a minimum, each meeting shall include at least the City of Tigard Project Manager, and/or
Operations Manager, and/or SCADA Operations Manager.
The SI shall submit to the City, within 5 calendar days after each meeting, meeting notes,
schedule update, project action item list, and product and control logic review summary. In the
review summary, each comment shall be listed and addressed as one of the following:

• Incorporated—The comment was incorporated as noted.
• Modified and incorporated —The comment was incorporated in a modified
form. The modification is to be presented and justified.
• Not incorporated —The comment was not incorporated. This action is to be
discussed and justified.
• Response— This is appropriate when a question is raised. The response is to
include a recommendation to resolve any unresolved issues.
Payment Terms:
Terms of payment for engineering tasks shall be progress payments through the course of the
project based on a project schedule of values. Labor costs shall be submitted by the 25th of the
month due net 30 days. A payment of$44,958 for initial hardware and software procurement
shall be required upon project initiation.
Equipment Warrantv:
Product warranty for Hardware and Software procured by the SI and received in "new condition"
is the responsibility of the manufacturer. The SI shall submit any documents required by the
manufacturer in order to validate the product warranty.
Security:
The security of the new Telemetry and Control System is an important consideration in the
design of the Control network. The telemetry and control network shall be designed as a stand
alone network that is not connected with the City of Tigard Local Area Network (LAN) or the
internet. Only selected individuals will be connected to the telemetry and control system in order
to view operating data and generate reports. These connections to the telemetry and control
system shall be implemented through a secure firewall or a separate network interface card
installed in the individual's PC to segregate these networks and ensure that no unauthorized
network traffic will make it onto the telemetry and control network.
Operator Interface Application:
The status of all equipment, alarms, operator controls shall be clearly displayed on the OI
computer. During the design process specific requirements for the OI system will be developed
by the SI and City but at a minimum the OI application shall include the following:
1. Process overview showing status of all major equipment
2. One screen for each remote site with site detail and controls
3. One alarm screen for displaying all system alarms
4. One trend screen with runtime configurable trends capable of trending all logged tags
5. One communications screen showing communication status of all PLC's
6. The OI application shall use log in security to prevent unauthorized access and control.
At a minimum the application shall have 4 levels of security. The first (default) level
allows monitoring of the system but will not allow any control. The second level is the
"Operator" level that allows basic control. The third level is the "Supervisor" level that
allows control and additional access to change alarm set points and other configuration
items. The fourth level is the"Administrator" level that allows full control of the system

including shutting down the runtime application and starting the development
application.
Reports:
The SI will provide a basic daily showing flows, pressures and levels where available for each
site. The SI will provide a weekly pump run hours report for all the pumps that are monitored by
the control system.
Section 4: Hardware Recommendations
Hardware recommendations shall be finalized during the design process between the SI and City.

communication vs. Ethernet communication) to be deployed. The programmable logic
controllers will be specified by the City at a later date.

Section 5: Control Strategies
The following control strategies include the current functionality as well as additional
functionality requested by the City. These control strategies are general in nature intended to
provide a basic outline of the desired control functions. The SI is responsible for reviewing the
control strategies and visiting remote sites to ensure a full understanding of the desired control
functions and analyzing failure modes to ensure reliable and safe operations. The SI should keep
the following items in mind when reviewing these control strategies.
• All pumps will have Auto/Manual selection at the OI that determine how the pump will
operate. For example, in Auto mode, a pump would start and stop automatically based on
reservoir or zone levels and shut down based on certain alarm conditions (high level, low
level, pressure etc.). In manual mode the pump will run whenever an operator selects it
to run but will still shut down on alarm conditions.
• All control valves shall have an Auto/Manual selection at the OI. In auto mode the valve
will control to flow or pressure depending on it function. In manual mode the operator
will enter the valve position on the OI.
• In most cases all necessary field instruments and control hardware are already installed
unless otherwise specified in these control strategies.
• The city shall have remote control of all inlet and outlet valves on all reservoirs. Two
new discrete outputs are included at each reservoir site with a reservoir for this purpose
with the exception of Menlor site #13 which already has this capability.
• Five (5) new discrete inputs have been added to each site for door/hatch intrusion
monitoring and power loss monitoring.
• New control equipment shall be modular so that additional 1/0 may be added at a later
date.
Site #1: Canterbury
Site #1 has two reservoirs, Aquifer Storage and Recovery (ASR), pressure sustaining pumps and
a generator.
The ASR system has a recharge pump for filling the aquifer and a recovery pump for filling the
reservoirs. The recovery system should only run if there is room in the 410 zone for more water
and the chlorine pump is running. The recharge system should only run if there is enough water
in the Site41 Reservoir and turbidity is low. The control system shall have the ability to
accommodate flow control for both recharge and recovery operations when the city installs
additional flow control hardware. The SI shall provide hardware to determine the running status
of the chlorine injection pump.
The SI shall include two (2) additional level sensors for monitoring ASR well and Monitor well
levels.
The pressure sustaining pumps provide water pressure to the local area. In automatic mode these
pumps should sequence on and off to maintain a pressure set point. At least one pump shall be
running at all times. In manual mode the operator can select and run any or all pumps.

The SI shall include additional control hardware (discrete outputs, relay, and wiring) for remote
operation of inlet and outlet valves for reservoirs at this site. The city will provide modifications
(pilot control valves) to existing valves to allow remote operation.
The operator shall be able to remotely run the generator. The SI shall include control hardware
and installation of hardware to allow remote start and stop of the generator. The SI shall include
instrumentation for measuring fuel level.
Site #2: Gaarde Pump Station
Site #2 has a well pump, a pump to send water to High-Tor, a pump to send water to 10 MG, a
let down valve, a pressure relief valve and a generator.
The let down valve will only be opened and closed remotely through the Telemetry and Control
system in manual mode by the operator.
The well pump should only run in Auto or Manual mode if there is room in the 410 zone and the
Chlorine addition pump is running. The level in the 410 zone is determined by the reservoir
level at the#4 site. The SI shall provide hardware to determine the running status of the chlorine
injection pump.
The 10 MG pump flow set point can be manual entered by the operator or developed from the 10
MG level. This pump shall shut down on Site 42 low reservoir level. The control system shall
provide automated operation that will allow the city to pump water during off peak electricity
times. The operator shall enable operation of this pump by selecting a switch on the O.I screen.
The High-Tor pump flow set point can be manually entered by the operator or developed from
the High-Tor level. This pump shall shut down on Site#2 low reservoir level. The control
system shalt provide automated operation that will allow the city to pump water during off peak
electricity times. The operator shall enable operation of this pump by selecting a switch on the
OI screen.
An alarm shall be generated when the pressure relief valve opens. Additional wiring and field
equipment shall be installed by the SI for detecting when the relief valve opens.
The operator shall be able to remotely run the generator. The SI shall include control hardware
and installation of hardware to allow remote start and stop of the generator. The SI shall include
instrumentation for measuring fuel level.
Site #3 135th
Site #3 has two reservoirs and a well pump. The reservoirs gravity feed to the 410 zone.
The well pump should only run in Auto or Manual mode if there is room in the 410 zone and the
Chlorine addition pump is running. The operator shall enable operation of this pump by
selecting a switch on the OI screen.

The SI shall include additional control hardware (discrete outputs, relay, and wiring) for remote
operation of inlet and outlet valves for reservoirs at this site. The city will provide modifications
(pilot control valves) to existing valves to allow remote operation.
An existing sensor for well level shall be connected to the new Telemetry and control system.
Site#4 (reservoir)
Site 4 has a reservoir and a monitoring well. The well has been decommissioned. The reservoir
is part of the 410 zone so the level rises and falls with the level in the zone. There are existing
level sensors for reservoir and well that will be connected to the control/telemetry system for
display on the operator interface. The SI shall provide analog inputs for these devices.
The SI shall include additional control hardware (discrete outputs, relay, and wiring) for remote
operation of inlet and outlet valves for reservoirs at this site. The city will provide modifications
(pilot control valves) to existing valves to allow remote operation.
Site #5: Bonita Pump Station
This site has three pumps that pump water from a remote reservoir into the 410 zone. Currently
this site is not used but may be used in the future. These pumps should only run in manual mode
when requested by an operator and only if there is room for water in the 4 10 zone.
Site#6: Tiedeman
The Tiedeman Site is the connection between the City of Tigard and City of Portland water
systems. There are three valves (24 inch, 12 inch and 4 inch) that control the amount of water
coming into Tigard. Individual loop controllers currently provide control for the 12 and 24 inch
valves.
The 24 inch valve in auto mode shall control the flow of water based on a flow set point. In
order for this to happen a new flow meter shall be installed by the city. The current butterfly
valve may need to.be replaced to provide more precise control. The valve should close in any
mode upon high level in the 10 MG reservoir. The control system shall also not allow the city to
exceed the summer peak flow restrictions. Summer mode allows 101"% increase or 20% decrease
in total flow from previous day. The operator shall enter the desired increase and decrease
percentage and the control system shall calculate flow rate to meet the desired total for day. The
control system shall generate an alarm if the actual flow rate is not within the dead band of the
flow set point.
The 12 inch valve opens in auto mode only if there is room in reservoirs and not in summer
restriction mode. This valve controls to a flow set point. The 12 inch valve also has a PRV
mode that is used to maintain fullness of 410 zone. This mode is only available when not in
summer mode. In PRV mode the valve is controlled to a flow set point only if the outlet pressure
is high enough. If the outlet pressure drops below the pressure set point (about 113 psi) the valve
will open to maintain the pressure. The operator shall enter the pressure set point and select PRV
mode on the 01.

The 4 inch valve is on/off control mode only but it is desired to modulate this valve for low flow
conditions (below 700 gpm use the 4 inch and above 700 gpm use the 12 inch). Additional valve
is hardware required on 4 inch to get modulating control. The city will be responsible for
modifying the valve to allow modulating control.
Site #7: Bradley Corner
This site is the connection between Tigard water system and Tualatin Valley and Portland.
Tigard does not have any controls at this site. The RTU at this site is only for monitoring flow,
pressure and intrusion into their system.
Site#8: High-Tor
The High-Tor site has 3 reservoirs, 5 pressure sustaining pumps and a generator.
The reservoirs are fed from several pump stations and then gravity feed to lower elevations.
The pressure sustaining pumps provide water pressure to the local area. In automatic mode these
pumps should sequence on and off to maintain a pressure set point. At least one pump shall be
running at all times. In manual mode the operator can select and run any or all pumps.
The SI shall include additional control hardware (discrete outputs, relay, and wiring) for remote
operation of inlet and outlet valves for reservoirs at this site. The city will provide modifications
(pilot control valves) to existing valves to allow remote operation.
Additional flow meters may be added by the city in the future so the telemetry/control system
shall accommodate up to 6 additional analog inputs in the future.
The operator shall be able to remotely run the generator. The SI shall include control hardware
and installation of hardware to allow remote start and stop of the generator. The St shall include
instrumentation for measuring fuel level.
Site #9: Baylor
The Baylor site has two reservoirs and a control valve connection to Tualatin Valley water
system. In automatic mode the control valve will control the flow into the City of Tigard based
on a flow set point. A stand alone loop controller currently provides valve control. In addition
the flow set point shall be adjusted based on inlet pressure. The inlet pressure from Tualatin
Valley may not fall below 40 psi.
The SI shall include additional control hardware (discrete outputs, relay, and wiring) for remote
operation of inlet and outlet valves for reservoirs at this site. The city will provide modifications
(pilot control valves) to existing valves to allow remote operation.
Site #10: 10 MG
This site has 1 reservoir, a transfer pump and ASR.
The transfer pump moves water from the 10 MG reservoir to High-Tor. In automatic mode the
pump should run to a flow set point. The flow set point shall be adjusted by the control system

based on the level in High-Tor reservoir. The transfer pump can only run if there is at least 8
feet of water in the 10 MG reservoir. The transfer station shall provide automated operation to
take advantage of off peak electricity rates. Additional flow meters may be installed by the city
in the Future so the RTU at this site shall be expandable to add additional analog inputs.
The ASR recovery system should only run if there is room in the 10 MG reservoir for more
water and the chlorine pump is running. The recharge system should only run if there is enough
water in the High-Tor Reservoir and the water turbidity is low. The control system shall have
the ability to accommodate flow control for both recharge and recovery operations when the city
installs additional flow control hardware. The SI shall provide hardware to determine the
running status of the chlorine injection pump.
The SI shall include additional control hardware (discrete outputs, relay, and wiring) for remote
operation of inlet and outlet valves for reservoirs at this site. The city will provide modifications
(pilot control valves) to existing valves to allow remote operation.
Site 11: Hunziker
Currently this RTU is not functioning so all control functions are locally operated. This site has
one pump used to move water from the Baylor reservoir to the 410 zone.
The operator shall remotely start and stop the pump at this site. There is no automatic mode for
this pump. The pump shall shut down on low Baylor reservoir level or high 410 zone level.
Site 412: 132nd Pump Station
This site has two pumps that move water from the 410 zone to High-Tor reservoir.
In automatic mode the pumps will pump water to High-Tor if the 410 zone has enough water and
there is room in the High-Tor reservoir.
Additional equipment will be installed by the city to monitor flow from this site and temperature
inside the pump vault. The telemetry/control system shall have 2 additional analog inputs for
these devices.
Site #13: Menlor
This site has 1 reservoir and two altitude valves, a pressure relief valve, supply inlet from 710
zone.
An alarm shall be generated when the pressure relief valve opens. Additional wiring and field
equipment shall be installed by the SI for detecting when the relief valve opens.
This site is the future location for a new pump station. This pump station will pump water to the
710 and have a circulation pump for occasionally turning over the water in the reservoir. The Sl
does not need to do any programming or other work to accommodate this pump station other
then leaving enough room inside the control enclosure and back panel to add 1/0 blocks.

Site 14: Gaarde PRV
This site has two control valves (12 inch and 4 inch) that control the flow of water from the 10
MG tank to the 410 zone. There are two loop controller providing pulse position control for
these valves.
In auto mode each valve controls flow based on an operator entered flow set point. Individual
flow meters provide feedback for the control loop. There is no manual mode. To close the
valves the operator enters a zero flow set point. There shall be at least 9 feet of water in l OMG
reservoir in order to open these valves.
Future Sites:
The city anticipates several new sites will be added to the system at a later date. The Telemetry
and Control System shall allow for the addition of these sites. The city will clarify if the SI is
required to purchase control hardware as part of this scope as an addendum to this document.
The new sites are as follows:
Site#16: Beaverton (Roshak and Barrows RD)
Site #17: City of Tualatin (SW 72nd Ave SW Bridgeport Road) connection sites to for pressure
and flow om existing instruments.
Site 418: #2 550 reservoir- level, 2 valves, intrusion detection, Chlorine, pH and Turbidity
Section 6: Implementation Strategy
Great care shall be taken by the SI to minimize equipment downtime during the installation of
the new telemetry and control system. The implementation plan should follow the sequence
listed below. The SI will need to coordinate with City of Tigard personnel to schedule each
site's conversion to the new system. The order in which each site is converted will also be
determined by the results of the Radio Site Survey that will determine the transmission paths and
what sites will be repeaters.
1. Install radio equipment and new OI computer in the City Office.
2. Install radio equipment and new controller at Site #3 and establish radio communication
from the remote site to the City Office. Site #3 is not frequently used so it will allow the
SI plenty of time to solve any communication problems that arise during the initial setup.
3. Test the I/O at Site #3 and ensure good data transfer between site #3 and the City Office.
4. Verify the accuracy of Operator Interface Graphics at City Office.
5. De-commission the original Site #3 RTU and remove from MTU polling sequence.
6. Repeat steps 1 through 5 for the remaining sites. The order in which the remaining sites
will we changed out will be determined by City personnel.

Section 7: Project Responsibilities
The SI will be responsible for all aspects of design, installation, startup and commissioning of
the new Telemetry and Control System. This includes procurement of all hardware and
software. The SI shall provide submittals as specified in Section 8. It will be the responsibility
of the SI to provide all necessary FCC licensing for the radio system. The SI shall be a licensed
General Contractor if they intend to hire any subcontractors for installation services.
The City of Tigard or their representative will provide project oversight, prompt review of all
submittals and coordination with the SI for system implementation.
Section 8: Submittals
The SI will provide the following submittals:
1. Design Submittal 1: to include hardware list with cut sheets for all remote sites and City
Office.
2. Design Submittal 2: to include panel drawings, UO termination detail drawings,
electrical schematics for all remote sites.
3. Control Submittal to include printed or electronic copy of the control logic.
4. Operator Interface Graphics standard submittal. This will include sample graphics for
text displays, numeric displays, screen color, font type and size, screen resolution,
start/stop controls, loop controller, and alarm display, trend display, and. state indicator
colors.
5. O&M Manual to include all items discussed in Section 11.
Section 9: Panel Construction Requirements
The panels shall be constructed by a UL certified panel shop and have a UL label. At all sites,
the existing enclosures will be reused so no specific enclosure ratings are given. The SI shall
provide UPS backup power for devices in each panel. The panel shall remain energized for a
minimum of 30 minutes on UPS power. All panels shall include a digital input into the PLC for
detecting power loss. This input shall be included as an alarm in the OI and SCADAlarm.
For internal panel wiring the following wire colors shall be used:
• Blue for 24 VDC
• Black wires for 120 VAC L1
• White wires for 120 VAC L2
• Green wires for ground.
• Red wires for 120 VAC controls
The SI shall provide fusing to protect panel mounted control equipment from short circuits in
field. The SI shall provide individual fuses for all inputs and outputs.

Section 10: Testing, Startup and Commissioning
The SI shall perform the following tests to ensure system functionality. The City of Tigard
personnel or their representative shall be given the opportunity to witness these tests.
1. Factory acceptance test (FAT) on all panels to ensure accuracy of wiring before the
panels are installed in the field.
2. FAT on 01 computer to ensure communication between controllers and OI and to ensure
accuracy of 01 graphics and tags.
3. 1/0 checkout at each remote site after installation of new controllers.
Section 11: O&M Manuals
The SI shall compile O&M Manuals that contain the following Items:
1. As built panel drawings, 1/0 drawings and electrical schematics.
2. Printed and electronic copies of all control programs.
3. Electronic copy of Operator Interface Application.
4. Hardware parts list that included part number, manufacturer, manufacturer phone
number, local vendor, and local vendor phone number.
5. User manuals for all hardware.
6. List of recommended spare parts.
Section 12: Training
The SI will provide up to 40 hours of training to city personnel on the operation and maintenance
of the new Telemetry and Controls system.
