Dear Mr. Saxton:
This letter in response to your request for a Minor Modification to a Conditional Use (MMD2007 00019) at
7950 SW Durham Road adjacent to 8048 SW Schaffer Lane), WCIM 2S113BA, Tax Lot 401. You have
requested approval to • the Durham Elementary School site by constructing a replacement playground on
an exisnug oppeen � multi -use ield. The egg playground is the sof a site ending development project. Seven
• structures willbe tie* and four suvcturts' vvillbe relocated froth the existing playground location. n addition; AI
have proposed to construct a wood mulch pathway from an existing covered play area to the new open
playground. The proposed activity is typical of school use, which is permitted conditionally in a R12 (HD) zone.
Past conditional use permits are CUP88 - 05 and CUP95 00006. The submitted sire plan reflects the current and
proposed conditions.
Analysis of Modification Request
Section 18330.020 of the Tigard Development Code Conditional Use Chapter indicates that any modification
which is not within the description of a major modification as provided in Atlmough H below shall be considered
a minor modification. The Director shall determine that a major modification(s) has resulted if one or more of
the changes listed below have been proposed
A. A change in land use; The existing playground is currently for school use and the playground improvements
will continue to be for school use. Therefore, the proposed modification will not cause a in land use.
B. An 10% increase in dwelling unit density; The site is not used for residential purposes. Therefore, dwelling
unit density does not apply.
C A changge in the type and /or location of access ways and parking areas where off -site traffic would be
affected; The applicant does not propose a change to the accessways or parking areas.

- D: Ati increase is the floor area proposed for non- residential use by more than 10% where previously
specified; The. applica r does not propose any changes to the existing building. Therefore, floor area will not
increase.
E. A reduction of more than 10% of the area reserved for common open space and/or usable open space;
The proposed playground will be constructed over the existing multi -use field (usable open space) and will serve
the purpose of usable open space. Therefore, the proposed modification will not reduce the area reserved for
usable open space.
F. A reduction of specified setback requirements by more than 20 %; The applicant does not propose any
changes to the existing building. Therefore, the proposed modification will not affect building setbac The
setbacks for the playground be 27 feet from the east property line, 183 feet from the north property line
abutting the (iglu-of-Way along Durham Road, 46 feet from the west property line, and 270 feet from the south
property line. These setbacks are within the required setbacks for schools, which are 30 feet for the front, 20 feet
for the side and 30 feet for the rear.

G. An elimination of project amenities by more than 10% where previously specified provided such as:
(1) Recreational facilities; (2) Screening; or (3) Landscaping provisions; and The proposal involves adding

be from the existing playground location. In addmon, the applicant proposed to construct a wood mulch
pathwayfrom the existing covered play area to the new open playground. Therefore, amenities will be increased.
H. A 10% increase in the approved density; The site is not used for residential purposes. Therefore, this
criterion does not apply.

review based on the findings that
A. The proposed development is in compliance with all applicable requirements of this title; and The

designee has determined that the proposed minor ttrnr1ification of this existing will continue to promote the

provided that, development which occurs after this decision complies with all applicable local, state, and federal
laws.
