APPLICATION SUMMARY FILE NAME: Shroyer Office Building CASE NO.: Minor Modification (MMD) MMD2012 -00017 PROPOSAL: The proposal is to construct an additional entry wa to an existing office building. The C -P zoning district is designed to accommodate civic and business /professional services and compatible support services, e.g., convenience retail and personal services, restaurants, in close proximity to residential areas and major transportation facilities. Within the Tigard Triangle and Bull Mountain Road District, residential uses at a minimum density of 32 units /net acre, i.e., equivalent to the R -40 zoning district, are permitted in conjunction with a commercial development. Heliports, medical centers, religious institutions and utilities are permitted conditionally. Developments in the C -P zoning district are intended to serve as a buffer between residential areas and more - intensive commercial and industrial areas. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.360, 18.520, 18.745 and 18.765. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. MMD2012 -00017 Shroyer Office Building Page 1 of 3 SECTION III. BACKGROUND INFORMATION Site Information & History: The subject parcel is located at 7080 SW Fir Loop. The existing two -story structure was built in the late 70s as part of a larger office development. Based on the original approval (SDR33 -78), the site is 32,680 square feet; however tax assessor records show the area to be approximately 28,749 square feet. A quick calculation shows the lower square footage to be correct. Proposal Description: The proposal is to construct a second entry way on the east side of the building. In addition, the applicant is proposing an accessible space for the new ADA compliant entry. Construction of the parking space and sidewalk will result in the loss of one parking space, some landscaping and one tree. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS The proposed change to add a second entry to the building requires land use approval, in this case a Minor Modification to Approved Plans (18.360.060). MINOR MODIFICATION OF AN APPROVED PLAN: Section 18.360.060.0 states that a minor modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title; and The following criteria are the most relevant to the proposed change: 18.520 — Commercial Zoning Districts Table 18.520.2 shows a minimum 15% landscaping requirement within the C -P zone. Based on the original approval approximately 15,032 square feet of the site is landscaped (roughly 50 %). The proposed loss is approximately 120 square feet, which is less than 1%. The remaining landscaping will still meet the minimum requirement. 18.745 — Landscaping and Screening Section 18.745.050.E.a (4) requires that trees be planted in all landscape areas in parking lots on the basis of one tree for every seven parking spaces. Based on a site visit there are three trees planted closely within the landscape area. The loss of the one tree will not impact this requirement and canopy will still be provided by the remaining trees. 18.765 — Off- Street Parking and Loading Requirements Per Table 18.765.2 the minimum required spaces is thirty (10,820/1,000 x 2.7 = 29.2 spaces). There are currently 32 parking spaces for the 10,820 square foot office building. The loss of one space will still satisfy the minimum requirements. FINDING: Based upon review of the applicant's plans and narrative and a site visit, staff fords that all applicable requirements of this title are satisfied. This criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the proposed modification will not result in one of the changes listed in TDC18.360.050.B.1 -11 which require a major modification. Approximately 20 percent of the building or 2,200 square feet is vacant. I have been advised by local realtors and a local architect that the rent ability of this space would be improved by the addition of a new entry. For this purpose I am requesting that the City of Tigard approve a Minor Modification for my building. The attached drawings show the existing site plan and the proposed new entry as designed by the above mentioned architect. The entry is through an opening which is now a window; thus structural load considerations can largely be ignored. The design is ADA compliant, the current entry is not, and will have a glass store front appearance which reflects the existing character of the building. My reading of Development Code Sections 18.360.050(B) and 18.330.020(B)(2) indicates that the proposed change does not invoke any of the criteria discussed within these sections. Current setbacks and building height will remain unchanged. One parking space will be lost, leaving 33 spaces for a building of 10,800 square feet. One small tree will be lost. I anticipate a few minor changes to the proposed new entry as shown. For example a drain will need to be added and it may be possible to eliminate the step. With this in mind, I ask that approval be granted for an ADA compliant entry at the location shown, with the final form to be submitted as part of the building permit application. Additionally, since the new entry will be part of a larger remodel, I ask that its cost be applied to the ADA requirement for the entire remodeled space.
