NOTICE OF TYPE II DECISION DIRECTOR'S INTERPRETATION ■ DIR 2012 -00002 - MOTOR VEHICLE SALES EXEMPTION TIGARD AMENDED DECISION — MAY 1, 2012 CORRECTION OF A TYPOGRAPHICAL ERROR ON PAGE 3 CHANGES MARKED IN RED FONT 120 DAYS = July 27, 2012 SECTION I. APPLICATION SUMMARY FILE NAME: MOTOR VEHICLE SALES EXEMPTION CASE NO.: Director's Interpretation (DIR) DIR2012 -00006 APPLICANT: Testa Motors, Inc. OWNER: PPR Washington Square LLC 3500 Deer Creek Road PO Box 847 Palo Alto, CA 94304 Carlsbad, CA 92018 PROPOSAL: Pursuant to Subsection 18.130.030 (Omitted and Unanticipated Uses) of the Tigard Development Code, the applicant has requested a Director's Interpretation to address an unanticipated land use. The requested interpretation is that exception 4.c of Section 18.130.060.Q.4.c (Sales- Oriented Retail) was not intended to apply to motor vehicle sales or rental businesses not incorporating the use characteristics that apply to standard automobile dealerships, used car lots and rental car facilities. These standard characteristics include extensive exterior auto parking and storage, and associated auto repair and maintenance. Accordingly, this interpretation would allow a land use engaging in the sale of non - fossil fuel based vehicles, operated within an enclosed retail space no larger than 5,000 square feet, with no vehicle repair or maintenance allowed, and associated accessory parking and outdoor display areas no larger than 1,200 square feet. LOCATION: Citywide ZONE: All Zoning Districts APPLICABLE REVIEW CRITERIA: Tigard Development Code 18.130.030 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. SECTION III. BACKGROUND & REQUESTED INTERPRETATION The applicant is Testa Motors, a relatively new automotive manufacturer that makes and sells all- electric cars NOTICE OF TYPE II DECISION DIR2012 -00002 / Motor Vehicle Sales Exemption PAGE 1 OF 4 directly to customers. The company is proposing a showroom and sales facility within Washington Square Mall. All sales would be for custom built vehicles delivered directly to the customer, with no onsite inventory other than test -drive vehicles, and no on -site servicing or the sale of parts. Washington Square Mall is dominated by sales- oriented retail land uses, consistent with the MUC (Mixed - Use Commercial) zoning district it is located in. The MUC zoning district does not allow motor - vehicle sales, as the nature of this land use conflicts with the purpose of this zoning district and the Washington Square Regional Center Community Plan. The applicant proposes that their direct sales model is a new and unanticipated land use, more closely resembling the retail stores located inside the mall than a typical auto dealership. A comparative list of land use characteristics is below: PROPOSED LAND USE TYPICAL MOTOR VEHICLE SALES No onsite inventory other than showroom models — Onsite storage of vehicle inventory for sale cars are custom built to order Showroom and sales area limited to no more than Showroom, sales and service building surrounded by 5,000 square feet of enclosed space, with limited expansive Exterior Storage Areas, typified by low outside parking for the storage and recharging of test floor -area ratios. vehicles (1,200 square feet maximum) No vehicle servicing, no sale of parts Onsite Service and Parts Facility No vehicle rental. Vehide Rental Services All- electric, emission free, low noise. Internal combustion engines requiring gasoline and other petroleum products To allow this unanticipated land use, the applicant proposes a Director's Interpretation that establishes the business described above as a land use that would have been permitted in zoning districts that allow sales - oriented retail, as defined in 18.120.060.Q. More specifically, the requested interpretation is that exception 18.130.060.Q.4.c (Exceptions to Sales - Oriented Retail) was not intended to apply to motor vehicle sales or rental businesses not incorporating the use characteristics that apply to standard automobile dealerships, used car lots and rental car facilities. SECTION IV. APPLICABLE DEVELOPMENT CODE STANDARDS 18.130.030 Omitted and Unanticipated Uses The purpose of this Section is to establish a procedure for determining whether certain specific uses would have been permitted in a zoning district had they been contemplated at the time of code adoption, and whether such omitted and /or unanticipated uses are compatible with the listed uses. Approval or denial of an unlisted use application by the Director shall be based on the following findings: 1. "The use is consistent with the intent and purpose of the applicable zoning district;" The proposed use is consistent with the intent and purpose of the applicable zoning districts in that its characteristics, type of services, and customer base are anticipated by the commercial zoning districts allowing sales - oriented retail uses. Moreover, the interpretation is consistent with the intent and purpose of the applicable zoning district set forth in 18.520.010 because, by clarifying that the use is allowed as part of sales oriented retail uses, the interpretation will ensure that a full range of uses and the full range of economic opportunities associated with the use can be made available to city residents and in a location that minimizes adverse impacts to residential areas. This criterion is satisfied. 2. "The use is similar to and of the same general type as the use categories listed in the zoning district;" The use is similar to and of the same general type as the use categories listed in the commercial zoning districts. Specifically, this direct -sales facility is similar to the sales- oriented retail use category listed in the zoning district through its use of a small, fully enclosed showroom to display up to four models of cars and associated marketing materials. Motor vehicles will not be serviced here, nor will parts be sold, nor will petrochemicals be present. Aesthetically and functionally it will perform in a similar manner to a retail store, office or personal services oriented business. The applicant has also rovided evidence of stores C operating in similar shopping centers in other cities. These locations include Santana Row in San Jose, alifornia; Fashion Island in Newport Beach, California; and Park Meadows in Lone Tree, Colorado. This criterion is satisfied. "The use has similar intensity, density, and off -site impacts as the use categories listed in the zoning district, to be evaluated using the criteria set forth in Section 18.130.015.A.2; and" The use has similar intensity, density and off -site impacts as the use categories listed in the zoning district. As discussed above, the store will appear and function like a retail or office land use. There will be no offsite noise or glare, no presence of petroleum products and associated emissions, and will be of a similar size and scale. Trip generation would not be dissimilar from other commercial land uses allowed in this zoning district. The requested interpretation would allow another retail store in Washington Square that would look and operate like the other in -line stores in the mall. This criterion is satisfied. 4. "The use has similar impacts on the community facilities as the listed use categories. Community facilities include streets, schools, libraries, hospitals, parks, police and fire stations, and water, sanitary sewer and drainage systems." The proposed use is expected to have similar impacts on community facilities as other listed use categories in the commercial zoning districts. As discussed in the background and findings above, the store is expected to function like other land uses within Tigard's commercial districts, and will have similar impacts and service needs as a sales- oriented retail land uses. This criterion is satisfied. SECTION V. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET No letters or comments were received from nearby property owners. SECTION VI. INTRODUCTION This narrative is written in support of the request by Tesla Motors, Inc. ( "Tesla ") for an interpretation by the Community Development Director ( "Director ") under Code 18.130.030 regarding Omitted and Unanticipated Uses. Specifically, this application requests an interpretation that the exception for Motor Vehicle Sales /Rental uses under the Sales- Oriented Retail use category in Code 18.130.060.Q.4.c. has an implied exception for Motor Vehicle Sales /Rental uses that only offer energy - efficient, hybrid, non - fossil fuel based vehicles for sale (which could be commonly referred to as "Smart Vehicles" or some similar use category description), and which do not have the standard use characteristics associated with traditional automobile dealership uses. II. BACKGROUND Only a decade ago it would have been difficult to predict today's heightened interest in sustainable products that do not contaminate the environment. Suddenly, there are new industries devoted to the invention and manufacture of energy - efficient, innovative products that are not based upon fossil fuels or petroleum products. It would also have been difficult to predict that these new industries and products would need nontraditional facilities for their marketing and sales. This is particularly true for the new iteration of motor vehicles such as electric cars, scooters or bicycles operating partially or totally with electric power. As a result, most modern zoning codes do not anticipate such uses and thus there is a need to find interpretive ways to allow them for the benefit of the consumer public, and to foster economic growth and development in conjunction with the manufacture and sale of these sustainable products. Tesla provides an excellent example of such new product technology, coupled with a new retail concept. (See attached description from Tesla.) As you can see, Tesla's concept presents a much different business profile than the standard characteristics of a traditional Motor Vehicle Sales /Rental use as envisioned in the City's current Code. Specifically, Tesla Motors' retail format is the antithesis of a standard automobile dealership. Tesla does not utilize extensive exterior auto parking or storage and does not engage in auto repair or maintenance in conjunction with its retail store operations. As stated in Tesla's materials, its stores operate more like an Apple store than an Audi dealership. 82138 -0001 /LEGAL23190796.3 III. APPLICABLE APPROVAL CRITERIA The proposed interpretation is consistent with the applicable Approval Standards of Section 18.130.030 of the Code, as follows: C.1. The use is consistent with the intent and purpose of the applicable zoning district in that its characteristics, type of goods and services, and customer base are anticipated by the Commercial Zoning Districts allowing Sales- Oriented Retail uses. Moreover, the interpretation is consistent with the intent and purpose of the applicable zoning district set forth in Code 18.520.010 because, by clarifying that the use is allowed as part of Sales - Oriented Retail uses, the interpretation will ensure that a full range of uses and the full range of economic opportunities associated with the use can be made available to City residents and in a location that minimizes adverse impacts to residential areas. C.2. The use is similar to and of the same general type as the use categories listed in the Commercial Zoning Districts. Specifically, it is similar to the Sales-Oriented Retail use category listed in the zoning district because it is involved in the sale of new products to the general public. C.3. The use has similar intensity, density and off -site impacts as the use categories listed in the zoning district. The requested interpretation would merely allow another in -line retail store in Washington Square that would look and operate like the other in -line stores in the mall. C.4. The use has similar impacts on community facilities as other listed use categories. The interpretation is based on a limited exception to an exception. The new exception limits the use to the type of impacts associated with a standard Sales - Oriented Retail use. D.1. The use is not specifically listed in another zone as either a permitted use, restricted use, or a conditional use. IV. REQUESTED INTERPRETATION Based upon the above, this application requests an interpretation that exception 4.c. of Section 18.130.060 Q. Sales - Oriented Retail was not intended to apply to motor vehicle sales or rental businesses not incorporating the use characteristics that apply to standard automobile dealerships, used car lots or rental car facilities, such as extensive exterior auto parking and storage, or auto repair and maintenance. Instead, the actual activity on the site would then be more closely aligned with the activities and characteristics of a typical Sales - Oriented Retail use. In conjunction with this request, it is anticipated that an interpretation allowing businesses similar to Tesla that would engage in the sale of sustainable, energy - efficient, hybrid, non - fossil fuel based vehicles, would operate under reasonable restrictions, such that all sales operations would be conducted within an enclosed building, that the related retail space would not exceed 5,000 square feet, there would be no vehicle repair and maintenance allowed, there would be no vehicle part sales allowed and, finally, that any accessory exterior parking, and display areas would not exceed 1,200 square feet. -2- 82138 -0001 /LEGAL23190796.3 • • V. CONCLUSION The above interpretation is consistent with the intended purpose of the omitted and unanticipated uses section of the Code. Specifically, it was not possible for the Code to contemplate the evolution of retail needs of newer, energy efficient and non - fossil fuel based vehicles which can be inspected, ordered and purchased via the Internet and now include standard retail stores independent of the need for outdoor storage and display, or of accessory service and repair facilities. Accordingly, an exception to the Motor Vehicle Sales /Rental exception to the Sales- Oriented Retail use category needs to be recognized through the requested interpretation. -3- 82138 -0001 /LEGAL23190796.3 T9Lr, Description of the Tesla retail concept At Tesla, we're striving to introduce a new type of retail, service, and driving experience. In doing so, we're challenging the status quo of a century old industry with the hope of revolutionizing it. Our retail concept is central to our business strategy: as a fairly small automaker we must make incredibly efficient use of limited capital to promote our brand. Instead of conventional advertising, we have chosen to invest heavily in our retail experience, getting in front of customers in our stores, versus in a magazine or TV ad. Why Tesla is different We are unlike the traditional automotive dealership concept in several ways: 1. We are located in high pedestrian traffic locations, where customers tend to shop on a frequent basis (e.g., shopping malls, high streets, etc.) 2. We do not have an inventory of vehicles; all orders are custom built and delivered — 3 -6 months after the order is placed 3. We offer an informative and educational experience, rather than a high - pressure selling environment. Our employees are not paid commissions. We do not offer discounts or run promotions. We encourage all customers (including children) to sit in our vehicles, constantly promoting a fun and inviting atmosphere. 4. We own and operate all of our stores. This allows us to treat customers the way we believe they should be treated, in all of our stores worldwide. 5. We separate sales and service. We do not perform any type of repairs or maintenance in our retail stores. We also don't sell parts at these locations. Instead, we build service -only centers at separate locations that are more amenable for this type of activity. What enables these differences We are in a unique position to change a retail experience that hasn't changed in the last century. There are a few things that allow us to do so: 1. We control our retail experience — there is no franchisee /middleman. This allows us to react quickly and maintain a consistent, top -rate customer experience. 2. We design, build, and sell electric vehicles...only. These vehicles are quiet, emission - free, and do not contain any gasoline or motor oil. This makes them much safer to move and display within retail spaces. 3. We deploy technology to maximize customer interaction and education. With at least 4 touchscreens per store and display vehicles and components, we encourage customers to explore our company, technology, vehicles, and owners at their own pace. 4. We hire the best. Our store staff are all Tesla evangelists, and come from varied backgrounds (e.g., physics grad students, retired school teachers, former entrepreneurs). TESLA MOTORS, INC How we operate Although we're bringing a new type of product to a traditional shopping environment, we actually operate very much like a traditional retailer. We're much more like an Apple store than an Audi dealership. Here's a quick snapshot of how we do it: • Store hours: we follow regular shopping center hours • Number of employees: we typically employ 3 full -time Managers and 5 -7 part -time Product Specialists. During store hours, we tend to have an average of 3 -4 employees on the floor. • Store layout: Tesla stores are typically in the 2,500 -3,000 square foot range. Stores consist of the following areas: o Display area — graphics, merchandise, and vehicle displays; 4 touch screens and a 85" plasma video screen. Several Product Specialists /Managers available to answer questions o Lounges — 2 separate, semi - private lounges with seating and a computer terminal used for vehicle education, reservations, and configurations o Staff office — small office hidden from view with employee work terminals and break area o Washroom(s) — as required by local building code • In -store activities: we perform the following functions in our stores: o Testa vehicle / EV education via touch screens, Product Specialists o Testa vehicle and component display — we display as many as 4 vehicles within each store, subject to store size and vehicle availability o Testa vehicle reservations — involves minimal paperwork and a transaction ($5,000 per reservation) o Testa vehicle configurations — after a customer has reserved their vehicle, they can design /configure their vehicle in- store, approximately 3 months before it's produced o Testa merchandise sales — Testa apparel and toys are displayed and sold o Testa customer events — from time to time we may host in -store events for Testa reservation holders or owners, or for anyone interested in our products • Parking area activities: each Testa store has a Tesla- branded parking area within short walking distance. These parking areas consist of 6 parking spaces and 2 Tesla- installed vehicle chargers, and are outfitted with special lighting and signage. These areas are used to park and charge Testa test -drive vehicles. Customers wanting to test -drive a Testa vehicle may sign -up for a test -drive in -store and then walk over to the parking area, from which the test -drive will be launched.
