The property owner may file an application to pay the assessments in installments, if the application is filed by May 7, 2002. If an application to pay in installments is not filed with the City by May 7, 2002, the property owner must pay the final assessment in full. Final assessments, which are not paid in full by May 28, 2002, shall bear interest at the rate of 9% per annum as set by the ORS 82.010. Final assessments which are not paid in full by May 28, 2002 and which are not subject to an installment agreement shall be subject to foreclosure. Information on payment of the final assessment in installments and an application for doing so accompanies this notice. Information on deferral of the assessment pursuant to ORS 311.702 et seq. is available from the City's Director of Finance. The City claims a lien in the amount of $22,891, (the amount of the final assessment), plus interest and any additional interest or penalties imposed by the City with respect to any installments which are not paid when due. The lien was entered in the City's lien docket on April 26, 2002 and may be recorded in the Washington County lien records in accordance with ORS 93.643. T. and Theresa A. Roth, are the owners of property identified by Washington County as Tax Map and Lot # 2S101AA09800. The City of Tigard has levied a final assessment for the 69 Avenue Local Improvement District on the above described benefited property in the amount of $22,891. Agreement We hereby make application to the City of Tigard and agree to pay the above assessment with interest at a rate of one and one half percentage point over the effective rate of the bonds as determined on the date of the bond sale in forty (40) equal semi - annual installments over a period of twenty (20) years. Prior to the bond sale an interim interest rate equal to the U.S. Government Bond Ask Rate for the expected maturity date as of the 1S of the month in which the application is signed, plus 2 %, shall be utilized. Interest will begin to accrue on the outstanding balance on April 26, 2002. Assessment payments with interest will be payable semi - annually at the offices of the Finance Director of the City of Tigard. Accounts that become delinquent for more than ten days shall be subject to late charges. In consideration for the privilege of paying the assessment in installments, J. T. and Theresa A. Roth on behalf of themselves and all subsequent owners of lot number 2S101AA09800 hereby waives all irregularities or defects, jurisdictional or otherwise, in the proceedings to cause the local improvement for which the final assessment is levied and in the apportionment of the actual cost of that local improvement.
