CLAIM OF LIEN
Whereas, the City Council for the City of Tigard (the "City "), by Ordinance No. 98 -12, adopted May 26,
1998, did levy the final assessments for the project known as the Dartmouth Local Improvement District; now,
therefore:
• NOTICE IS HEREBY GIVEN that Ordinance No. 98 -12 assesses the cost of street improvements on
certain real property (the "Property ") in the County of Washington, State of Oregon, described as follows:

The name of the owner or reputed owner of said land is:
Paul Simmons, Waremart
The amount of the final assessment is $45,034.23. The property owner must either pay the final assessment
in full, or enter into an installment payment agreement with the City by June 15, 1998. Final assessments which are
not paid in full by July 2, 1998 shall bear interest at the rate of 9% per annum as set by the City Council in
Ordinance No. 98 -12. Final assessments which are not paid in full by July 2, 1998 and which are not subject to an
installment agreement shall be subject to foreclosure. Information on payment of the final assessment in installments
and an application for doing so accompanies this notice. Information on deferral of the assessment pursuant to ORS
311.702 et seq. is available from the City Finance Director.
The City claims a lien in the amount of $45,034.23, (the amount of the final assessment), plus interest and
any additional interest or penalties imposed by the City with respect to any installments which are not paid when due.
The lien was entered in the City's lien docket on May 27, 1998 and may be recorded in the Washington County lien
records in accordance with ORS 93.643.

Application to Pay Assessment in Installments
Recitals
I, Eric A. Sporre , am duly appointed representative of Pacific Realty Associates, LP
and hereby certify that Pacific Realty Associates, LP is the owner of property identified by
Washington County as Tax Map and Lot # 1S136CD04200.
The City of Tigard levied a final assessment for the Dartmouth Local Improvement District on
the above - described benefited property in the amount of $45,034.23.
The previous owner of the property applied to pay the assessment for the Dartmouth Local
Improvement District in installments and has been making the payments on the assessment.
The outstanding balance is $25,698.08. A lien has been placed on the property to ensure
payment of the assessment.
Pacific Realty Associates, LP, wishes to continue to pay the assessment in installments and
consents to the lien remaining in place until the installments are paid.
Agreement
I hereby make application to the City of Tigard and agree to pay the remaining assessment
amount of $25,698.08 with interest at a rate of 5.89%. Assessment payments with interest will
be payable semi - annually at the offices of the Finance Director of the City of Tigard.
I agree that the lien securing payment of the assessment shall remain in place until the
amount of the assessment, including interest, is paid. •
Accounts that become delinquent for more than ten days shall be subject to late charges.
In consideration for the privilege of paying the assessment in installments, Pacific Realty
Associates, LP on behalf of itself and all subsequent owners of lot number 1S136CD04200
hereby waives all irregularities or defects, jurisdictional or otherwise, in the proceedings to
cause the local improvement for which the final assessment is levied and in the apportionment
of the actual cost of that local improvement.
By signing below, 1 state that I understand the terms and conditions of the City's payment
policies, including penalties or possible foreclosure for nonpayment.
