REQUIREMENT: OREGON REVISED STATUTE (ORS) 447.241.
(1) Every project for renovation, alteration or modification to affected buildings and related
facilities shall be made to insure that the path of travel to the altered area and the restroom,
telephones and drinking fountains are readily accessible to individuals with disabilities unless
such alterations are disproportionate to the overall alterations in terms of cost and scope.
(2) Alterations made to the path of travel to an altered area may be deemed disproportionate to
the overall alteration when the cost exceeds twenty -five per -cent (25 %).

Description of proposed Minor Modification
Baja Fresh Oregon, LLC proposes to install a new glass storefront type storm enclosure at the
entrance to the existing restaurant. This glass storefront will consist of a rolling glass partition
and pair of glass doors providing needed protection from the elements to the existing patio area
at the front of the restaurant.
Rationale for Minor Modifications
Baja Fresh Oregon, LLC proposes these minor modifications for the following reasons;
• Security reasons — shortly after opening, reports of vandalism at neighboring business were
brought to the attention of the business owner. Because of the threat of vandalism to the
furniture in the existing patio area, as well as the concealed nature of the patio area and it's
"grotto" like atmosphere - Baja Fresh Oregon, LLC decided that the ability to lock up this
area after hours was an important safety precaution for personnel as well as an important
safeguard for furnishings.
• Winter storm protection — customers have complained of excessive cold when the doors to
the restaurant are opened during peak hours. This condition was particularly noticeable
during cold, blustery storms. The addition of the rolling glass "storm enclosure" will also
result in the creation of a vestibule to help mitigate cold air intrusion during stormy
conditions. It should be noted that the owner's intent is for this partition to be normally open
whenever possible, thus, no heating or ventilation is intended for this outdoor patio space.

Square footage of enclosed restaurant vs. patio area
The patio area to be temporarily enclosed by the proposed storm front enclosure consists of an
area totaling 517 square feet. The existing restaurant space exclusive of the patio area consists of
an area totaling 4,321 square feet (including existing kitchen, cooler and restroom core).
Occupant load calculations for determination of minimum no. of
plumbing fixtures
Per the information presented above, the gross total floor area is 4,838 square feet (4321 + 517).
Therefore the area subject to the calculations per table A -29 -A will be the gross total area less
the square footage of the existing restroom core, kitchen and food cooler room.

Per Table A -29 -A, the gross total area divided by 30 square feet results in a total occupant load
of 136. Based on the assumptions of a 50% mix of both males and females i.e., 68 each sex,
Table A -29 -A provides for a water closet fixture count of 2 per sex, based on an occupancy load
of 75 for a Group A occupancy. The existing restroom cores presently provide two water closets
fixtures per sex as well as two lavatories per sex; thus, no additional fixtures are required.
