DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED Minor Land Partition 94-0017 SUBJECT TO CERTAIN CONDITIONS as listed below. SECTION I - CONDITIONS OF APPROVAL: THE FOLLOWING CONDITIONS SHALL BE REQUIRED PRIOR TO RECORDING THE PLAT. SECTION II - FINDINGS OF FACT: 1. VicinitylabErighm The subject site is located east of SW 121st Avenue and north of SW Manzanita Court. The properties to the north, south and east are zoned R-4.5 (Residential, 4.5 units per acre). Properties to the west are zoned R-7 (Residential, 7 units per acre), 2. 1e inforriitin and Proposal Desatatign An existing single family house presently occupies the site. The site has acces, to S.W. 121st Avenue. The applicant requests a Minor Land Partition approval to divide one parcel of approximately 20,147 square feet into two parcels of approximately 10,791 and 9,356 square feet. 3. Mensyf_goments The City of Tigard Building Division has rl-viewed this proposal and has offered the following comments: Easements shall be provided for all utilities. Buildings on the proposed parcel 2 shall convey all concentrated storm water to the public storm system. The Tualatin Valley Fire District has reviewed this proposal and has offered the following comments: NOTICE OF DECISION MLP 94-0017 BURTON PWINDSOR Page 2 The City of Tigard Maintenance Services Department, City of Tigard Water Department, Portland General Electric have reviewed this proposal and have offered no comments or objections. No other comments have been received. SECTION ID - FINDINGS AND CONCLUSIONS. - Minor Land Partition Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal coArms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City ae 3i applicable agency standards (Ord. 89-06; Ord. 83-52). The proposal conforms with the City's comprehensive plan in that the newly created lots will continue to allow for residential development. This proposal therefore is not in conflict with the Low Density Comprehensive Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process. Adequate public facilities are available to serve the proposal. Section 18.162.05C contains the following special provisions for lots created through the Partition Process: A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area The lot area shall be as required by the applicable zoning district, In the case of a flag lot, the accessway may not be included in the lot area calculation, C, Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 1 feet or have a legally recorded minimum 15 foot wide access easement, NOTICE OF DECISION MLP 94-0017 BURTON / WINDSOR Page 3 , ,■1■45"t ' ' '11": ;, D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Secti0ns 18.100.080 and 18.100.090. Screening may also be requked to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement vvhich will ensure access and maintenance rights shall be recorded with the approved partition map. 1. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and/or development is allowed within or adjacent to the one-hundred-year tioodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bieycle pathway Criteria A is satisfied as the proposed lot widths for parcels 1 and 2 are approximately 86 and 75 feet respectively, exceeding the minimum 50 foot lot width requirement in the R-4,5 zone. Criteria B is satisfied as this partition would create lots of approximately 10,791 and 9,356 square feet, exceeding the 7,500 square foot minimum lot size requirement. The proposed lot frontages are approximately 86 and 75 feet respectively, thereby exceeding the minimum 15 foot frontage requirement of Criteria C. As indicated on the site plan, parcel 1 is in compliance with the front and side yard setback requirements of the R-4.5 zone, thereby satisfying Criteria D. The rear yard NOTI,CE OF DECISION MLP 94-0017 - BURTON / WINDSOR Page 4 setback of 15 feet is not satisfied as the site plan indicates a setback of approximately 6 feet. The property lines for tax lot 600 were created through a partition approval in 1978. The existing 6 foot rear yard setback is considered a non - conforming situation. The proposed partition will not increase the nonconformity of this setback and will not adversely effect the adjoining property. Compliance for setbacks on parcel 2 shall be reviewed when it is built upon. Criteria E and F are not applicable as these lots are not flag lots. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H shall be satisfied as a joint use and maintenance agreement shall be recorded with the plat for a common driveway. It is recommended that the applicant request permission from the owners of the flag lots to use the existing driveway in the flag for access to the new lot. If the applicant is not successful in obtaining access to the existin g common driveway, shared access shall be required with lot 1. Criteria I shall be satisfied when the lot is built upon. Criteria J is not applicable to these lots as they are not within the floodplain. Section 1 8.88.010(Selar Access) states that all newly create lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north -south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east -west axis. Section from 18.88,040(E) , however, allows the approval authority to exempt �, new w lots the solar access standard in certain cases, including situations where existing right-of-way prevents lots from being oriented for solar access. The existing orientation of SW 121st Avenue and the configuration of the subject site prevents the proposed parcel from being orientated for solar access. Therefore, the new parcels are except from the solar access standard. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164 100 (Storm Drains) have been addressed and are s: shied as specified below: 1, Streets: Access to the site is provided by SW 121st Avenue, a Major Collector as shown on the City Comprehensive Plan. This property was a part of a previous minor land partition which created a flag lot to the rear of this parcel. It is recommended that the applicant request permission from the lot owners of the flag to use the existing driveway in the flag for access to the new lot. if the applicant is successful in obtaining this permission, the new lot should be added to the existing joint use and maintenance agreement for the common driveway, by deed, and r-'2renced on the new partition plat. 2. Sanitary Sewer: Sanitary sewer service is provided by the existing 8" sewer located in SW 121st Avenue, and has sufficient capacity for the proposed development 3. Storm Sewer: The property slopes in a westerly direction towards SW 121st Avenue. The on-site drainage from the proposed residential construction should be directed to the street through the curb. SECTION IV - DECISION The Planning Division hereby APPROVES Minor Land Partition MLP 94-0017 subject to the conditions listed in Section I at the beginning of this decision. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE EFFECTIVE DATE OF THIS DECISION. 1. Location: 11000S.W. 121st Avenue (Wash. Co. Tax Ma? 1S1 34CA, Tax Lots 600 & 614) Applicant: Mr. & Mrs. Henry B. Williams I. Findings of Fact: 1. The site is designated "Urban Low Density Residential" on the Tigard Community Plan 1971 and zoned "R-7" Single Family Residential. 2. The subject site has been approved for duplexes as a conditional use by the Planning Commission (8/16/78 Planning Commission meeting) with the condition that the applicant obtain a minor land partition. 3. The applicant is applying for a minor land partition in Accordance with the Tigard Municipal Code, Sec. 17.24.010-17.24.050. 4. The site is currently occupied by a single family home located in the northwest corner of tax lot 600 and a single family home located to the rear of the site on tax lot 614. Large evergreen trees are located behind the house and along the north property line. 5. Surrounding land uses are single family homes to the east and south; a church parsonage is located to the north; and to the west across S.W. 121st is an old farm house and orchard. 6, The applicant is requesting to partition tax lot 600 and alter the boundary of tax lot 614 to create two duplex lots and two single family lots. Tax Lot 614 will be reduced in size to allow for access to the duplex lots. The single family lot to be partitioned from tax of 600 will be 21,870 square feet, the duplex lots A i B will be 14,250 square feet and 12,640 square feel: respectively and he remaining single family lot on tax lot 614 will b?. 8,960 square feet in size. All the, lots with the exception of the single family lot fronting on S.W. 121st will be shaped as flag lots. 7. Access for the two duplex lots and the single family lot on the southeastern' portion of the site would be on ten footeasement5. Water service is available to the site from the Tigard Water District eight inch line in S.W. 121st. Sanitary sewer would have to be extended from either an eight inch linu in 119th Avenue or from an eight inch line in S.W. Manzanita Court.
