SECTION I CONDITIONS. OF APPROVAL:
THE FOLLOWING CONDITIONS SHALL BE REQUIRED PRIOR TO RECORDING THE
PLAT. UNLESS OTHERWISE NOTED, THE STAFF CONTACT FOR ALL CONDITIONS

1. The applicant shall provide a master sewer and storm drainage plan for review and
approval of the Engineering Department. Based on the approved plan, the applicant shall
obtain a standard street opening permit for any public utility construction,

SECTION II - FINDINGS OF FACT:
1. Vicinit_Information
The subject site is located west of SW Hall Boulevard and south of SW Spruce Street.
Properties to the north, south and east are zoned R -12 (Residential, 12 units per acre).
Properties to the west are zoned R -4.5 (Residential, 4.5 units per acre). The surrounding
area is predominantly zoned residential.
2. Site information and Proposal Description
This site is approximately 26,934 square feet in size. An existing single family home
presently occupies the site. The site has access to S.W. Hall Boulevard. The applicant
requests a Minor Land Partition approval, to divide one parcel of approximately 26,934
square feet into three parcels of approximately 7,286 8,794 and 10,854 square feet.
3. Agency Comments
The City of Tigard Building Division has reviewed this proposal and has offered the following
comments:
Easements shall be provided for all utilities. Buildings on the proposed parcels 1 and 2
shall convey all concentrated storm water to the public storm system.
The Oregon Department of Transportation has reviewed this proposal and has offered the
following comments:
Only one shared driveway will be allowed onto SW Hall Boulevard. The applicant is
required to obtain a driveway permit from ODOT. Staff Contact: Sam Hinaidi (229- 5u02).
The Tualatin Valley Fire District has reviewed this proposal and has offered the following

SECTION III - FINDINGS AND CONCLUSIONS - Minor Land Partition
See.ltion 18.162.040 contains the following general approval criteria for a Minor Land
Partition:
1. The proposal conforms with the City's Comprehensive Plan;
2. The proposed partition complies with all statutory and ordinance
requirements and regulations;
3. Adequate public facilities are available to serve the proposal;
4. All proposed lots conform to the size and dimensional requirements of this
title; and
5. All proposed improvements meet City and applicable agency standards (Ord.
89-06; Ord. 83-52).
The proposal conforms with the City's comwehensive plan in that the newly
created lot will continue to allow for residential development. This proposal
therefore is not in conflict with the Medium Density Comprehensive Plan
designation. This proposed partition shall comply with all statutory and ordinance
requirements and regulations as demonstrated both by the analysis presented within
this administrative decision and by this application and review process. Adequate
public facilities are available to servo the proposal.
Section 18.162.050 contains the following special provisions for lots created tJ.ough the
Partition Process:
A. Lot Width. The minimum width of the building envelope area shall meet the
lot requirement of the applicable zoning district.
B. Lot Area: The lot area shall be as required by the applicable zoning district.
In the case of a flag lot, the accesswa.y may not be included in the lot area
calculation.
C. Lot Frontage: Each lot created through the partition process shall front a
public right-of-way by at least 15 feet or have a legally recorded minimum
15 foot wide access easement.
D. Setbacks: Setbacks shall be as required by the applicable zoning district.

E. Front Yard Determinalon for Flag Lot: When the partitioned lot is a flag
lot, the developer ma!) determine the location of the front yard, provided
that no side yard is kess than 10 feet. Structures shall generally be located
so as to maximize aeparation from existing structures.
F. Screening on Flag Lots: A screen shall be provided along the property line
of a lot of record where the paved drive in an accessway is located within
ten feet of an abutting lot in accordance with Sections 18.100.080 and
18.100.090. Screening may also be required to maintain privacy for
abutting lots and to provide usable outdoor recreation areas for proposed
development.
G. Fire Protection: The fire district may require the installation of a fire
hydrant where the length of an accessway would have a detrimental effect
on fire fighting capabilities.
H. Reciprocal Easements: Where a common drive s to be provided to serve
more than one lot, a reciprocal easement which ,vill ensure access and
maintenance rights shall be recorded with the Lpproved partition map.
Access-way: Any accessway shall comply with the standards set forth in
Chapter 18.108, Access, Egress, and Circulation.
J. Where landfill and/or development is allowed within. or adjacent to the one-
hundred-year floodplain, the City shall require the dedication of sufficient
open land area for greenway adjoining and within the floodplain. This area
shall include portions at a suitable elevation for the construction of a
pedestrian/bicycle pathway with the floodplain in accordance with the
adopted pedestrian/bicycle pathway plan.
Criteria A, B, C. and D are satisfied. There is no minimum lot width
requirement in the R-12 zoning district. The minimum lot size requirement
in the R-12 zone is 3,050 square feet. The lot area is defined as the total
horizontal area within the lot lines of a lot exclusive of public and private
roads, and access easements to other property or the private driveway area
of a flag lot A revised site plan shall be submitted which indicates the lot
area exclusive of access casements and emergency vehicle turn-wounds.
Criteria B shall be satisfied if the revised site plan demonstrates that these
lots tnJet the minimum requirements duplexes, otherwise only single
faintly residences will be allowed on these parcels. Lot #3 has
approximately 100 feet of frontage on SW Hall Boulevard, thereby
satisfying the minimum 15 frontage requirement Parcels 2 and 3 shall
satisfy the minimum frontage requirement of criteria C through the

provision of a 20 foot access e� sement. The required setback for single-
family development in the R-12 zone are: front yard - 15 feet; side yard -
5 feet; flag lot side yard - 10 feet; rear yard - 15 feet; and 20 feet from the
front of the garage to the property line from which access is obtained. As
indicated on the site plan, the existing house on lot #3 meets the applicable
setbacks. Future development on lot #1 and #2 will be reviewed for
compliance with the applicable setbacks at the time of building permits,
however the proposed site plan shows that compliance is feasible.
Criteria E and F are not applicable to parcel #3 because it is not a flag lot.
Criteria E will be satisfied on parcels 2 and 3 as front yard determination
will be determined when it is built upon. Screening shall be provided along
the length of the north property line, adjacent to the access drive, in
accordance with Sections 18.100.080 and 18.100.090 thereby satisfying
Criteria F.
Fire hydrants shall be consistent with Uniform Fire Code standards thereby
satisfying Criteria G. A reciprocal access easement and joint use and
maintenance agreement shall be recorded with the approved partition map
thereby satisfying Criteria H. Section 18.106.070 states that 3 -6 dwelling
units requires one driveway with a minimum width of 25 feet with a
minimum pavement width of 20 feet. In addition, access drives in excess
of 150 feet in length shall provide for emergency vehicle turnaround. This

within the floodplain.
Section 18.88.010 (Solar Access) states that all newly created lots within the
City of Tigard shall promote the use of renewable energy sources by
providing for improved access to sunlight for residential dwellings. A lot
meets the basic requirement if it has a north -south dimension of 90 feet or
more and has a front lot line that is oriented within 30 degrees of a true
east -west axis. As indicated on the site plan, both lots meet the orientation
and yard dimension standards, thereby satisfying this requirement.
Section 18 "98.030(8)(4) (Building Heights and Flag Lots) provides that
windows 15 feet or more above g rade shall not face dwelling unit windows
or patios on any abutting lot unless the proposal includes an agreement to
plant trees capable of mitigating direct views, or that ,such trees exist and
will be preserved. A screening plan shall be submitted which shows how

the south property lines of lots 1 and 2 shall screen the existing residential
units or the property to the south.
Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drain)
have been addressed and are satisiied as specified below:
1. Streets:
The site is located on the westerly side of SW Hall Boulevard, southerly of F,W Spruce
Street. W Hall Boulevard is shown as an Arterial on the City Comprehensive Plan and
is a State Kighvvay. The existing right-of-way for SW Hall Boulevard fs not consistent with
arterial standards and the applicant slA id be required to dedicate additional right-of-way
to 45 feet from a centerline as approved by the Engineering Department.
In addition, the street improvements have not been constructed along the frontage of SW
Hall Boulevard. The applicant should be required to sign an agreement not to remonstrate
the formation of a future LID for the improvement of SW Hall Boulevard
The proposed access to the three parcels is along a private easement connecting to SW
Hall Boulevard at the existing driveway. The applicant shall obtain edit access agreement
from ODOT and a construction pertnit for the new driveway. The maintenance of the
private access should be the joint responsibility of the three, proposed parcels.
2. Sanitary Sewer:
The existing 8 inch public sanitary sewer line is located in SW Hall Boulevard. However,
the sewer may not have sufficient depth to serve Parcel 1 at the Lear of the property. A
new main may be required and it should be the responsibility of the applicant to provide
a solution acceptable to the Engineering Department. The existing downstream sewers
have sufficient capacity for this development,
3. Storm Sewers
The site slopes in a southwesterly direction across private property that drains toward SW
Thorn Street, The applicant's site plan shows on-site drywells. The applicant should be
required to provide a soils analysis by a professional soils engineer to subs!anaate the use
of dryvvells. As an alterniative, the storm water run-off shall he directed to the public storm
drain system or street.

The Planning Division hereby APPROVES Minor Land Partition MLP 94 -0016 subject to
the conditions listed in Section I at the beginning of this decision.

EFFECTIVE DATE OF THIS DECISION.

Applicant is requesting approval to divide a parcel known as Tax
Lot 2200, WCTM 1S1 35AD, into three lots of approximately 7266,
8794, and 10,854 square feet respectively. The existing single
family residence would remain on the larger parcel, adjacent to SW
Hall Boulevard.
Findings:
1. Streets:
The site is located on the westerly side of SW Hall Boulevard,
southerly of ,SW Spruce Street. SW Hall Boulevard is shown as
an Arterial on the City Comprehensive Plan and is a State
Highway. The existing right-of-way for SW Hall Boulevard is
not consistent with arterial standards and the applicant
should be required to dedicate additional right-of-way to 45
feet from a centerline as approved by the Engineering
Department.
In addition, the street improvements have not been constructed
along the frontage of SW Hall Boulevard. The applicant should
be required to sign an agreement not to remonstrate the
formation of a future LID for the improvement of SW Hall
Boulevard
proposed access to the three parcels is along a private
Easement connecting to SW Hall Boulevard at the existing
driveway. The applicant shall obtain an access allreement from
ODOT and a construction permit for the new driveway. The
maintenance of the private access ahould be the joint
responsibility of the three proposed parcels
2 Sanitary Sewer:
The existing 8 inch public sanitary sewer line is located in
SW Hall Boulevard. however" the sewer may not have Sufficient
depth to serve Parcel 1 at the rear of the property. A new
main may be required and it should be the responsibility of
the applicant to provide a solution acceptable to the
Engineering Department. The existing downstream seWers have
sufficient capacity for this developtent.

3. Storm Sewer:

The site slopes in ,c;L southwesterly direction across private
property that drains toward SW Thorn Street. The applicant's
site plan shows on-site drywelis. The applicant should be
required to provide a soils analysis by a professional soils
engineer to substantiate the use of drywells. As an
alternative, the storm water run-off shall be directed to the
public storm drain system or street.
Recommendations r,
ALL CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED PRIOR TO
RECORDING THE FINAL PLAT WITH WASHINGTON COUNTY.

The applicant shall provide a master sewer and storm drainage
plan for review and approval of the Engineering Department.
Based on the approved plan, the applicant shall obtain a
standard street opening permit for any public utility
construction,

Highway Division, to perform work within the right-of-way of
SW Pacific Highway (99W). A copy of the permit shall be

3. A joint use and maintenance agreement shall be executed and
recorded on City standard forms for all common driveways. The
agreement shall be referenced on and become part of all

4. Additional right-of-way shall be dedicated to the Public along
the SW Hall Boulevard frontage to increase the right-of-way to
45 feet from the centerline. The description shall be tied to

Department,

Easements shall be provided for all utilities.
Their is a fire hydrant across the street on Hall. All portions of the building are well within 500
feet of this fire hydrant, I checked with Gene Birchill Of the Tualatin Valley Fire Department and
he said that he did not think a hammer head or turn around was necessary.
Each lot will have a legally recorded access easement of 20 feet.
Each lot is over 6100 sq. ft. which is ok for duplexes:
Their is no 100 year flood plain on the property.
I have tried to meet all of the requirethents set forth in the r -12 zone.
