At aerial trespass occurs when a POE wire serving one customer crosses over private property and the property owner has not granted POE a legal easement for the crossing. In your situation,, our service wire coming from SW Murdock and attaching to the meter on your shed is crossing over the property you recently partitioned and sold. It is necessary for us to move the wire so that it only crosses your property or public property in order to reach the final connection to your home. In addition, the current meter and attachment to the shed has been examined by both the City of Tigard Electrical Inspector and PGE's Service Inspector and was determined to be hazardous and in violation of the National Electric Code. To correct these circumstances, we propose to set a new service pole along the East side of your driveway and connect our service wire from the street to this pole. We would then be able to provide a service drop wire directly from this pole to your house. The house will require a new overhead meter installation in order for us to make the new connection. An approved meter base is the responsibility of the homeowner to reavide. Once installed it must be inspected by the City of Tigard Electrical Inspector and PGE's Service :inspector. POE will not charge to place the service drop pole nor to reroute the service and inspect the new meter base. We are required to correct our aerial trespass situation in a timely manner. Therefore, we request that you install the meter base as soon as possible so we can complete our portion of the work. f the current circumstances are not corrected, the City may revoke authorization for providing electrical service and require us to disconnect it for your safety. Please contact me as soon as possible, so that we can take the appropriate steps to remedy this situation and arrange an acceptable schedule for completing this work. One of the conditions of approval required that the electrical service be put in the proper easement, which is a 5' strip on the west of the new lot EA another conmdition required that they move an existing building from 30" to 60" from the new property line. They moved the wall of the building ( they didn't get a permit, and need one). However, they apparantly left a piece of the wall which is taking the electrical service from the street at 30". Also, the wire is apparantly supported by a rotten limb of an old Walnut tree: so, I need you guys to: Have them get a permit for the moving of the wall and take a look at the work.. .footing? framing? What is the deal with the piece they left to take the service, should it also be moved Is the service hazardous (the tree, its support at the building, sort of?) Planning is making them get the service put in the easement but is leaving it to the 2 owners. to duke it out. Thanks C5 December 6, 1996 Cathie Feller 9795 SW Murdock Street Tigard, OR 97224 Dear Ms. Feller: The City has been asked to investigate a situation involving property located at 9795 and 9809 SW Murdock Street (VVCTM 2S1 11BD, Tax Lots 4500 and 4600). The existing residence located at 9795 SW Murdock Street receives power from an overhead power line which crosses the property at 9809 SW Murdock Street In 1994, a Minor Land Partition (MLP 94-0010) was approved to partition tax lot 3300 into two (2) parcels. Condition #9 of that approval stated that the applicant Mall show the location of all utilities serving the existing house. Easements need to be provided for these utilities and identification made of the easements shown on the preliminary plan. A partition plat was recorded (1994-69) which created the two (2) current tax lots. The preliminary plat noted that the existing house is served by aerial phone and electric from the SW corner of Lot 15, and easements from the plat of Cloud Cap subdivision. The recorded partition plat shows the five (5) foct utility easement which runs along the side lot line as provided with the Cloud Cap subdivision plat. VVnile a five (5) foot utility easement exists, the overhead power line is not contained in the easement. It is the responsibility of the owner of lot 4500 to put this line within the existing easement, negotiate for a new easement with the owner of lot 4600 where the line presently is, or remove the line totally. In any event, this is not a matter for the City to enforce or address but rather a dispute between two private parties who should resolve it as they see fit. The proposal conforms with the City's Comprehensive Plan in that the newly created lot will allow for residential development. This proposal therefore is not in conflict with the Low Density Comprehensive Plan designation. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, &toss, Egress, and Circulation. J. Criteria A is satisfied as the proposed lot widths are 78 and 105 feet respectively, thereby exceeding the minimum 50 foot lot width requirement in the R-3,5 zone. Criteria B is satisfied as this partition would create lots of approximately 10,140 and 15,726 square feet, exceeding the 10,000 square foot minimum lot size requirement. The proposed lot frontages for parcel 1 and parcel 2 are approximately 20 and 130 feet respectively, thereby exceeding the minimum 15 foot frontage requirement of Criteria C. The required setbacks in the R-3.5 zone are as follows: front yard - 20 feet, side yard - 5 feet; rear yard - 15 feet; garage - 20 feet; flag lot side yard - 10 feet. As indicated on the site plan, the existing single family home on parcel 2 complies with the setbacks, satisfying Criteria D.
