Field measurements were taken which show dug sight distance to the east along SW Taylors Ferry Road conforms to the above requirements. Sight to the west along SW Taylor's Ferry Road is slightly impacted by roadside grass, brush end a dirt mound near the west property line of this project. Following removal of these items, sight distance will conform to the stated requirements and be satisfactory. The pieperty owner has been informed of this situation and will take action to correct it. I hereby certify that once the sight line to the west is cleared, as recommended, the intersection sight distance rot this development will conform to the Washington County Community Development Cod. Abutting properties in the area are also zon, 1 for residential use and are largely developed with single family residences. 2. Site Information and Proposal Desa_iptisri The applicant is requesting approval to divide an existing parcel located at 7480 SW Taylors Ferry Road into two parcels of approximately 15,500 and 9,093 square feet respectively. The smaller parcel located towards SW Taylors Ferry Road would retain the existing home. 3. AggijciSompiejLitg, The Engineering Department, the Tualatin Valley Fire District, the Building Department and the Washington County Department of Transportation reviewed this request and provided the following comments concerning this proposal. Findings: L Streets: Access to the site is provided by SW Taylors Ferry Road, a Washington County road, which is classified as a Major Collector on the City Comprehensive Plan. The existing right-of-way is 30 feet from centerline. However, the street is not improved to City standards and the applicant should be required to sign an agreement to waive the right to remonstrate against the formation of a future local improvement district to improve 8 Taylors Ferry Road. 2. Sanitary Sewer: Sanitary sewer service is provided by an eight inch line in SW Taylors Ferry Road and has sufficient capacity to serve the site. NOTICE OF DECISION - MLP 94-0009 - BLACKSTONE Page 4 3. Storm Sewer: The property slopes in a northwesterly direction to the existing ditch in SW Taylors Ferry Road. The roof and site drainage for the new construction should also be directed to the roadside ditch along the proposed flag driveway on the westerly side of the existing house. The Tualatin Valley Fire and Rescue District stated that prior to construction of a structure on the lot that a plan shall be submitted to the Fire District for review and approval of the access road. Fire hydrant required within 500 feet of all portions of the building measured in an approved manner. The Building Department stated that the new and existing home shall be connected to sanitary sewer. The new house .shall run concentrated storm water to an approved public storm sewer system or a private system designed to the satisfaction of the Building Division (including percolation tests). The Wasnington County Department of Land Use Transportation reviewed this proposal and provided the following comments and conditions for access to SW Taylors Ferry Road, which is designated a County Major Collector street: 1. The minimum access spacing standard for SW Taylors Ferry Road is 100 feet measured between access points on each side of the road as required by Resolution and Order 86-95 and Section 501-8.5.B of the Community Development Code. Access must therefore be restricted lo meet this spacing standard. Access to both lots should therefore be shared, 2. Resolution and Order 86-95 also requires a minimum of 300 feet of site distance at the proposed access location. County staff have not been able to perform preliminary site distance measurements. Prior to approval of this partition by the City, the County recommends that the applicant be required to provide evidence, from a registered engineer, that adequate site distance exists or is available. SECTION III - FINDINGS AND CONCLUSIONS - Minor Land Partition • ., Section 2,162.040 contains the following general approval criteria for a Minor Land Partition: 1, The proposal conforms with the City's Comprehensive Plan; 2. The proposed parcels of approximately 15,500 and 9,093 square feet complies with the density range planned for this area which is one to five dwelling units per acre with a 7,500 square foot lot minimum in accordance with Criteria #1 and Chapter 18.92. Upon completion of the reyiew period, the applicants request will have complied with the statutory requirements of the City of Tigard for review of this application as required by Section 18.32 in compliance with approval Criteria #2. Adequate public facilities are available or have been required to be provided to serve this site as set forth in See„ti_corg113.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drain) as required by Criteria #3. The required street improvements differ between Washington County and the City of Tigard. Conditions of Approval #6 and #7 require that the applicant comply with all street improvement requirements on SW Taylors Ferry Road. SW Taylors Ferry Road is under Washington County's jurty.diction for street improvements and ongoing maintenance. Becatme the new parcel does not exceed a two and one half to one length to depth ratio and is 78 feet in width the proposed parcels exceed 50 feet in average width. The parcel configuration conforms with size and dimensional requirements of this zone as required by Criteria #4. All proposed improvements will comply with City and applicable agency stanflards in satisfaction with Criteria #5 through the building permit plan check review process. The newly created lot also complies with the basic solar access requirement which is that the new lot have a minimum north-south dimension of 90 feet. The proposed parcel has a north-south dimension of approximately 160 feet. Section 18.162.050 contains the following special provisions for lots created through the Partition process: A. Setbacks: Setbacks shall be as requiled by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located . so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 1.8.100.080 and 18.100.090. Screening may also be requital to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fi re fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. Findings: 1. The Tualatin Valley Fire and Rescue District stated that prior to construction of a structure on the lot that a plan shall be submitted to the Fire District for review and approval of the access road. Fire hydrant required within 500 feet of all portions of the building measured in an approved manner. The Building Department stated that the new and existing home shall be connected to sanitary sewer. The new house shall run concentrated storm water to an approved public storm sewer system or a private system designed to the satisfaction of the Building Division (including percolation tests). The Washington County Department of Land Use Transportation reviewed this proposal and provided the following comments and conditions for access to SW Taylors Ferry Road, which is designated a County Major Collector street: 1. The minimum access spacing standard for SW Taylors Ferry Road is 100 feet measured between access points on each side of the road as required by Resolution and Order 86-95 and Section 501-8.5.B of the Community Development Code. Access must therefore be restricted to meet this spacing standard. Access to both lots should therefore be shared. 2. Resolution and Order 86-95 also requires a minimum of 300 feet of site distance at the proposed access location. County staff have not been able to perform preliminary site distance measurements. Priem to approval of this partition by the City, the County recommends that the applicant be required to provide evidence, from a registered engineer, that adequate site distance exists or is available. SECTION III - FINDINGS AND CONCLUSIONS - Minor Land Partition Section 18.162.040 contains, the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's COmprehensive Plan; 2. Because the new parcel does not exceed a two and one half to one length to depth ratio and is 78 feet in width the proposed parcels exceed 50 feet in average width: The parcel configuration conforms with size and dimensional requirements of this zone as required by Criteria #4. All proposed improvements will comply with City and applicable agency standards in satisfaction with Criteria #,5 through the building permit plan check review process. The newly created lot also complies with the basic solar access requirement which is that the new lot have a minimum north -south dimension of 90 feet. The proposed parcel has a north -south dimension of approximately 160 feet. Section 18.162.050 contains the following special provisions for lots created through the Partition process: A. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I, Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and/or development is allowed within or adjacent to the one- hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria A, B, C, and D are satisfied. The newly created parcel would have 20 feet of direct frontage on SW Taylors Ferry Road in satisfaction of the lot frontage requirement in Criteria C. Section 18.50, 18.100 and 18.102 set forth standards for setbacks, clear vision and landscape buffering which will be reviewed through the building permit plan check review in satisfaction of Criteria D. Criteria E will be satisfied through the buikling permit plan check of future structures on the property. Criteria F has been complied with because the newly created lot is a flag lot with 21 feet of direct frontage to SW Taylors Ferry Road which exceeds the 20 foot minimum required. Privacy screening along the access road has been required to be provided prior to the issuance of building permits, Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G Criteria H which requires reciprocal access maintenance agreement to maintain a joint access easement is not presently required because a flag lot parcel configuration has been proposed which provides direct access to SW Taylors Ferry Road. Criteria I is satisfied through the provision of a flag lot parcel configuration which provides 20 feet of direct frontage on SW Taylors Ferry Road. Criteria J has been met because the parcel is not located within the 100 year flood plain or in areas with slopes exceeding 25 percent. This parcel also does not abut a designated bike and/or pedestrian path. SECTION IV - DECISION The Planning Division hereby recommends APPROVAL of Minor Land Partition 94-0009 subject to the conditions listed in Section I at the beginning of this decision.
