Site Information and Proposal tion The applicant reque, a Minor Land Partition approval to create a 0,36 acre parcel from an existing 0.53 acre property, The property has direct access to SW 70th Avenue. The R-4,5 zoning district allows a minimum lot size of 7,500 square feet. 3. Streets: Access to the site is provided by SW 70th Avenue which is a local street. The street right- of-way width is 50 feet and no further dedications are required. In addition, the street has been improved with curbs and asphalt pavement. No additional improvements are necessary with the exception of a new driveway for the new parcel. 2, Sanitary Sewer Sanitary sewer service is provided by the existing 8" sewer located in an easement along the easterly property line of the site The applicant should provide a preliminary title report to verify that the easement has been dedicated to the City. 3. Storm Sewer: The property slopes in a southerly direction toward the rear of the property to a un-defmed swale that connects to the underground system located in SW Lola Lane. The new roof and pavement drainage from the proposed development of the new parcel should be directed to a public stormwater drainage system or he contr:olled in an on-site system designed to limit the drainage to the historic rate of flow. The Tualatin Valley Fire and Rescue District stated that prior to construction of a structure on the rear portion of this property plans for fire fighting water supply and access road showing compliance with the Unfiorm Fire Code shall be submitted to the Fire Marshall's office for review and approval. No other comments have been received. SECTION III FINDINGS AND CONCLUSIONS - Minor Land Partition; Section 18.162,(),40 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89-06; Ord. 83-52). The proposed parcel of approximately 15,845 square feet complies with the density range planned for this area which is one to five dwelling units per acre with a 7,500 square foot lot minimum in accordance with Criteria #1 and Chapter 18.92. Upon completion of the review period the applicants request will have complied with the statutory requirements of the City of Tigard for review of this application as required by Criteria #2. Adequate public facilties are available to serve this site as set forth in Sections 18.164.030 (Streets)„ 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drain) as required by Criteria #3. Because the new parcel does not exceed a two and one half to one length to depth ratio and is ill excess of the 50 feet in average width the proposed lot conforms with size and dimensional requirements of this zone as required by Criteria #4. All proposed improvements will comply with City and applicable agency standards in satisfaction with Criteria #5 through through the building permit plan check review process. The newly created lot also complies 'with the basic solar access requirement which is that the new lot have a minimum north-south dimension of 90 feet the lot has 100 feet. Section 18.162.050 contains the following special provisions for lots created through the Partition process: A, Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard. Determination for Pag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. NOTICE OF DECISION MLP 94-0008 - ICRUICOWSKI Page 4 F. Screening on Flag Lots: A screen shall be prov;,ded along the property line of a lot of record where the paved drive in ail accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed develc?nient. G. Fire Protection: The fire district may require the installation of a fire hydiant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is t be provided to serve more than one lot, a reciprocal easement whie, will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and/or development is allowed within or adjacent to the one- hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria A, B, C, and D are satisfied. The proposed parcel exceeds the minimum lot width and area requirement in the R-4.5 zoning district, The newly created parcel would have 21 feet of direct frontage on SW 70th Avenue satisfying the lot frontage requirement in Criteria C. The R-4.5 zoning district has setback clear vision and landscape buffering requirements which will be reviewed through the building permit plan check review to saiisfy Criteria D. Criteria E will be satisfied through the buildiag permit plan check of future structures on the property. Criteria F has been complied with because the newly created lot is a flag lot with 21 feet of direct frontage to SW 70th Street. Privacy screening has been required prior to the issuance of Building Permits, Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria 0, Criteria H which requires reciprocal access maintenance agreement to maintain a joint access easement is not presently required because the access easement will only serve one lot at this time.
