Abutting properties in the area are also zoned for residential use and are developing primarily with single family residences. 2, Site Information and Promsal Das j iption The applicant requests a Minor Land Partition approval to create a .45 acre parcel . � to SW 79th from an existing 1.20 acre property. Yl _Comments NOTICE OF DECISION MLP 94.0006 ,. CARDWELL The wilding Department reviewed this application and stated that depending on the location of the new residence sewer may be required to be made available to the new home on Parcel 1 and that the exact location of the drain field needs to be provided. Additional comments have been provided as specific Conditions of Approval. The Water Department has reviewed this proposal and stated that the new parcel will need its own water meter and service will need to be relocated to the south property line for access to the five foot utility easement. The applicant will need to make arrangements to reimburse the Water Department for relocation work. The owner of Parcel 1 will need to purchase a water meter. The Unified Sewer Agency stated that public storm water drainage and sanitary sewer should be provided to each new parcel without crossing any other than the one being served. The Fire District reviewed this proposal and stated that a fire hydrant is required within 500 feet of all points of structures. The Fire District has required that the access easement across Parcel 1 shall be a minimum of 20 feet in width with 15 feet paved. The minimum access width will assure adequate Fire and Life Safety Equipment access to Parcel #2. No other comments have been received. SECTION III - FINIANO_AND CONCLIMNS Section 18.162Q4 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2 The proposed partition complies with all statutory and ordinance requirements and regulations; Adequate public facilities are available to serve the proposal; 4. STRIP AVMS6111f.1.109111311.11131dAMAIAMMIlialy The proposed parcel of approximately 20,000 square feet complies with the density range proposed for this area within the Comprehensive Plan which is one to five dwelling units per acre in accordance with Criteria #1. Upon completion of the review period the applicants request will have complied with the statutory requirements of the City of Tigard for review of this application as required by Criteria #2. Adequate public facilties are available to serve this site as set forth in ect)Lissx 1 Q (Streets), 1 1.._&14_,...0Q (Sanitary Sewer), and 1L1A4.100 (Storm Drains) as required by Criteria #3. Because the new parcel does not exceed a two and a half to one length to depth ratio and is in excess of 50 feet in average width the proposed lot conforms with size and dimensional requirements of this zone as required by Criteria #4. All proposed improvements will comply with City and applicable agency standards in satisfaction with Criteria #5 through the Conditions of Approval and the building permit plan check review process. Section 18.162.05Q contains the following special provisions for lots created through the Partition Process: A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. • E. Front Yard Determination fo r Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100,090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Fire Protection: The fire dstrict may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, wed Circulation., J. Where landfill and /or development is allowed within or adjacent to the one- hundred -year floodplain, the City shall require the dedication of sufficient opn land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian /bicycle pathway with the floodplain in accordance with the adopted pedestrian /bicycle pathway plan. Criteria A, B, C, and D are satisfied. The proposed parcel exceeds the minimum lot width and area requirement in the R -4$ zoning district.
