The adjacent properties are zoned R-4.5 (Residential, 4.5 units per acre). The surrounding area is zoned residential. 2. ite Informa ion ar Pro osal Description This site is approximately .42 acres in size. An existing single family house presently occupies the site, with access onto SW 70th Avenue. The applicant requests a Minor Land Partition approval to divide one parcel of approximately 18,600 square feet into two parcels of approximately 9,350 and 9,250 square feet. 3. ...6.gennent The City of Tigard Building Division has reviewed this proposal and has offered the following comments: Buildings on the proposed parcel shall convey all concentrated storm water to an approved public storm system, The Accessory buildings shall be relocated or removed. Sewer shall be provided to parcel 1. The Unified Sewerage Agency has reviewed this proposal and has offered the following comments Each lot should have seperate connections to public storm and sanitary sewer. The City of Tigard Maintenance Services Division has reviewed this proposal and has offered the following comments: Drainage from the house would go to curb outlets then flow down the curb line to catch basins 100 yards away? The Parks Department has some concerns about the trees larger than 16' diameter. Save if at all possible when construction occurs after the land partition. Tuaiatin Valley Fire District, Tualatin Valley Water District, General Telephone and Electronics, and Portland General Electric have reviewed this proposal and have no objection to it. No other comments have been received. SECTION III - FINDINGS AND CONCLUSIONS - Minor Land Partition Section 18.162.9A contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89-06; Ord. 83-52). The proposal conforms with the City's comprehensive plan in that the newly created lot will continue to allow for residential development. This proposal therefore is not in conflict with the Low Density Comprehensive Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process. Adequate public facilities are available to serve the proposal. Section 2,162...9.10 . contains the following special provisions for lots created through the Partition Process: A Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. Lot Area: The lot area shall be as required by the applicable zoning district, In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintename rights shall be recorded with the approved partition map. L Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedearian/bicycle pathway with the floodplain itt accordance with the adopted pedestrian/bicycle pathway plan. NOTICE OF DECISION WILP 94-0004 - BAUMGARTNER Page 4 • • Criteria A, B and C are ;;Misfied. As indicated on the site plan, both lots exceed the minimum 50 foot lot width requirement in the R-4.5 zone. This partition would create lots of approximately 9,250 and 9,350 square feet, exceeding the 7,500 square foot minimum lot size requirement. Each lot has at least 55 feet of frontage on both SW 69th Avenue and SW 70th Avenue thereby satisfying the minimum 15 foot frontage requirement. The required setbacks in the R-4.5 zone are as follows: front yard - 20 feet; side yard - 5 feet; corner lot side yard - 15 feet; rear yard - 15 feet; and 20 feet from the front of the garage to the property line from which access is obtained. As indicated on the site plan, the existing single family home on parcel 2 complies with the applicable zoning setb:.,cks. The existing shed and woodshed on parcel 1 are not in compliance with the accessory structure setbacks.. The minimum side and rear yard setback is 5 feet for accessory structures. The applicant shall be required to remove or relocate the existing structures on parcel 1 to a location that is in accordance with the required setbacks. Criteria B, F and J. are not applicable to these lots as neither are flag lots or within the floodplain. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H is not applicable to these lots as they will not share a common drive. Criteria I shall be satisfied on parcel 2 as the site plan shows the provision of a 15 foot driveway. Accessways on parcel 1 will be reviewed when it is built upon. Section 18.88.010(Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. (A lot meets the basic requirement if it has a north-south dimension of 90 feet or more and has a front lot line that is oriented wit.iik■ 30 degrees of a true east-west axis.) Section 18.88.040(E) , however, allows the approval authority to exempt new lots from the solar access standard in certain cases, including situations where existing right-of-way prevents lots from being oriented for solar access. The existing orientation of SW 69th Avenue, SW 70th Avenue and the configuration of the subject site prevents the proposed parcel from being orientated for solar access. Therefore, the new parcel is except from the solar access standard. 5ections 18.16101 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: NOTICE OF DECISION MLP 94-0004 - BAUMGARTNER Page 5 As noted, the site is located on the intersection of two streets. The existing house nearest to the corner takes access from SW 70th Avenue, which is paved and has a curb along a portion of the frontage. The existing right-of-way is 50 feet for SW 70th Avenue. The proposed access for the new lot is from an existing gravel driveway connecting to SW 69th Avenue, 60 feet wide. SW 69th Avenue is a narrow paved road with a ditch draining southeasterly, on the opposite side of the street. The applicant should be required to sign a non - remonstrance to the future construction of road improvements for both streets. The proposed driveway on SW 69th Avenue should be graded on -site and constructed to a grade matching the existing centerline pavement elevation to provide a good transition to the future curb construction.. 2. Sanitaiy Sewer: There is an existing 8 inch public sanitary sewer line located in SW 70th Avenue. The existing building is connected to the this line and the new parcel should also connect to this main with a new service line. The existing sewer has sufficient capacity for this development. 3. Storm Sewer: The site slopes towards the southwest and drains onto SW 70th Avenue. The ditch on the easterly side of SW 69th Avenue also drains into SW 70th Avenue, through a cross culvert at the intersection that drains into a catch basin connecting to the existing underground system in SW 70th Avenue. The new parcel should direct the roof drainage through the curb in SW 70th Avenue or connect directly to the underground system. SECTION IV -. DECISION The Planning Division hereby APPROVES Minor Land Partition MLP 94 -0004 subject to the conditions listed in Section I at the beginning of this decision.
