members of my immediate family who are or become dependant upon
me for support.

Approval for the partition of a 17,215 square foot tract of land into two parcels, one containing
9,661 square feet the other 7,554 square feet.
LOCATION
The address of the existing house is 11415 SW Greenburg Road. The property is located in the
southeast quadrant of the intersection of SW Greenburg Road and SW 98th Avenue, City of
Tigard, Washington County, Oregon.
The property is shown as Tax Lot 800 on Assessor's Map 1S- 1-35CD.

R -4,5 - Single Family Residential - Minimum lot size 7,500 square feet.

EXISTING SITE CONDITIONS
The site slopes from the northeast corner to the southwest corner at an average grade of
approximately two percent.
As shown on the Preliminary Partition Plat the existing house is located in the northerly portion of
the property.

way way was dedicated as part of the Greenberg Heights plat. The obvious intent was that the other

not yet occurred. However, any additional right-of-way that may

As shown on the Preliminary Partition Plan, the proposal is to partition the existing 17,215 s q uax

The subject site is located west of SW Greenburg Road, at the south east corner of
SW 98th Avenue and SW Greenberg Road. The adjacent properties are zoned R-4.5
and R-12 (Residential, 4.5 units and 12 units per acre). The surrounding area is
residential.

This site is approximately .39 acres in size. An existing single family house presently
occupies the site The site has access to S.W. 98th Avenue.
The applicant requests a Minor Land Partition approval to divide one parcel of
approximately 17,215 square feet into two parcels of approximately 9,661, and 7,554
square feet.

The Building Division reviewed this proposal and stated that the existing home should
connect to sewer and that storm water from any new structure shall be conveyed to
the existing drairAage ditch in SW 98th Avenue.
The Unified Sewage Agency stated that a separate connection will be required for the
exiting home to maintain the private sewage system entirely within Parcel 1.

89-06; Ord. 83 -52).
The proposal conforms with the Comprehensive e Plan in that the newly created lots
will allow for residential development at Low Density as defined in the
Comprehensive Plan as one to five dwelling units per acre. The partition complies
with all statutory and ordinance requirements and regulations as demonstrated both
by the analysis presented within this administrative decision. The parcels conform to
the dimensional requirements set forth in Section 18.162.050 below. The Engineering
Department states that adequate public facilities are available or may be made to
serve this newly created parcel as stated in Sec ions 9 5.164.. 030_ (Streets), 18164.00
(Sanitary Sewer), and 18.164.1 a0 (Storm Drains).
Section 18_._.162Q0, contains the following special provisions for lots created though
the Partition Process:
A. Lot Width: The minimum width of the building envelope area shall meet the
lot requirement of the applicable zoning district.
B. Lot Area The lot area shall be as required by the applicable zoning district.
In the case of a flag lot, the accessway may not be included in the lot area
calculation.
▪ Lot Frontage: Each lot created through the partition process shall front a
public right -of -way by at least 15 feet or have a legally recorded minimum 15
foot wide access easement.
Setbacks: Setbacks shall be as required by the applicable zoning district

Screening may also be required to maintain privacy for abutting lots and to
provide usable outdoor recreation areas for propmed development.
G. Fire Protection: The fire district may require the installation of a fire hydrant
where the length of an accessway would have a detrimental effect on fire
fighting capabilities.
H. Reciprocal Easements: Where a common drive is to be provided to serve
more than one lot, a reciprocal easement which will ensure access and
maintenance rights shall be recorded with the approved partition map.
I. Accessway: Any accessway shall comply with the standards set forth in Chapter
18.108, Access, Egress, and Circulation.
J. Where landfill and/or development is allowed within or adjacent to the one
hundred-year floodplain, the City shall require the dedication of sufficient open
land area for greenway adjoining and within the floodplain. This area shall
include portions at a suitable elevation for the construction of a
pedestrian/bicycle pathway with the floodplain in accordance with the adopted
pedestrian/bicycle pathway plan.
Criteria A is satisfied as the lots comply with 50 foot average width requirement of
the R-4.5 zone. The minimum lot size requirement in the R-4.5 zone is 7,500 square
feet. The lot area is defined as the total horizontal area within the lot lines of a lot
exclusive of public and private roads, and access easements to other property or the
private driveway area of a flag lot. A revised plat map shall be submitted which
provides the lot area exclusive of additonal public right-of-way dedication. Criteria
B shall be satisfied if the revised plat map demonstrates that these lots meet the
minimum requirements. Criteria C is satisfied because each parcel has continuous
direct frontage on SW 98th Avenue and/or SW Greenburg Road.
The existing home on Parcel 1 complies with the setback requirements of the R-4.5
zoning district with the exception of the garage which is at 12 feet from the property
line instead of the required 20 feet, The redesigned street will make the garage less
non-conforming by slightly reorienting the street away from the home which will
provide a setback of 15 feet to the property line. The setbacks on Parcel 2 shall be
reviewed through the Building Permit Plan Check process in compliance with Criteria
D. Criteria E and F are not applicableto this application because no flag lot has been
proposed. Fire hydrants shall be consistent with Uniform Fire Code standards thereby
satisfying Criteria G. Both parcels will have direct frontage and access to 98th
Avenue therefore Criteria H does not apply. Criteria I will be reviewed upon
application for building permits. Criteria J is not applicable as this property is not

within the floodplain an existing bicycle path has already been constructed along SW
Creenburg Road frontage.
SECTION V - DECISION
The Planning Division hereby APPROVES Minor Land Partition MLP 94.0002
subject to the onditions listed in Section I at the beginning of this decision.
THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE
EFFECTIVE DATE OF THIS DECISION.

Many of these issues were addressed and /or resolved as to why areas
to be dedicated are necessary to accomodate recommended street
improvements for the area.

To Whom it May Concern:
1 am the applicant in MLP 94-0002, 11415 SW Greenburg Rd.,
Tigard. The purpose of this letter is to clarify a few
matters and to express some concerns regarding your
department's decision of February 17, 1994.
First, in Section 1, number 3, the decision gives me the
option of either providing a sewer easement from parcel 1
across parcel 2, or constructing a new sewer from parcel
1 to 98th Ave. However, under Section 11, number 3, it is
stated that the Unified Sewage Agency will require a
separate connection for the existing home, to keep the
sewage system within parcel 1. (At present, there is a
sewer line from parcel 1 and the existing house across
lot 2, connecting with the public sewer line at the south
end of lot 2).
QUERY 1: Will a sewer easement from lot 1 across lot 2
be sufficient? or, must 1 build a new sewer line from the
existing house on lot 1 to 98th Ave.?
Second, Section 111 notes the requirement that all newly
created lotS must "provide for improved access to sunlight"
for residences by having a north-south dimension of 90 feet
or more.
QUERY 2: Does this mean that the length of lot 2 Can
be no less than 90 feet, i.e., that the dimensions of the
new lot must be at least 88.88 feet (the limit of the east-
west boUndary) by 90 feet; north to south' (This Would Mean
that lot 2 would be approXiMately 7999 Sq. ft., with a rear
Set -baCk from the existing house of 17.5 feet.)
Third, referring to the Plot Plan Exhibit Map attached to
the decigion, it is not clear how much square footage the
tight -of -way dedication takes of of parcel 2 Section 1,
number 5 states that the dedication along 98th Avende

requires that the northern lot line be moved north to
provide parcel 2 with 7500 square feet. As noted above,
the solar access requirements seem to outline a lot of at
least 7999 square feet. Obviously, if the right-of-way
dedication takes more than 500 feet off of the lot, then
the lot line will have to be moved even more to the north,
since the east-west boundaries are fixed.
QUERY 3: How much square footage will the right-of-way
dedication take from parcel 2?
QUERY 4: What is the estimated square footage of
parcel 2, allowing for the dedication and the solar access?
(The proposed lot size, of course, is 7554 square feet.)
Fourth, again referring to the map, specifically to the
right-of-way dedication on parcel 1, at the corner of 98th
and Greenburg, it is also not clear how much property is
involved at that location.
QUERY 5: How much square footage will be taken for the
right-of-way on parcel 1?
Fifth, it is apparent that several hundred feet of property
from both parcels will be dedicated for a future widening of
98th Avenue. In the case of parcel 2, this means that the
lot cannot be divided as a 7500 square foot lot, but must be
nearer to an 8000 square foot lot. The size of parcel 1
will also be reduced. A few years ago, a 7 foot dedication
was taken off of parcel 1 for the widening of Greenburg Rd.
At that time, the City of Tigard compenSated the owners for
the dedication.
QUERY 6: Does the City of Tigard compensate property
owners for right-of-way dedications for future improvements?
QUERY 7 What is the time-frame for the street
widening of 98th Avenue as well as the improvement at the
corner of 98th and Greenburg?
QUERY 8 Does the City of Tigard always require new
lots to be developed to their minimum size exclusive of
future right-of-way dediCationS? i.e, could parcel 2
conceivably be platted at 7554 square feet exclUSiVe of
the dedications planned for 98th Avenue?
Sixth, a memorandum dated February 4, 1994# to Mark Roberts
from Michael Anderson; states that a 60 foot right-of-way
will, be required on 98th Avenue to "satiSfy the minor
collector street status shown on the Comprehensive Plan .°
This indidates that the widening of 98th to the width
proposed on the Plot Plan Map conforms with a preexisting
City of Tigard plan for future street improvements.
However, the property owner to immediate west of parcel
1 has a different impression. That property owner, at the
corner of 98th and Greenburg, will have a significant portion
of his property taken by the future widening of 98th. He
informed me recently that he was told by someone at the City
of Tigard that the proposal for 98th Avenue, as evidenced
by the Plot Plan, came about only as a result of the minor land
partition.
QUERY 9: Is the proposed widening of 98th a result of
the intent to make 98th Avenue a "minor collector street" at
some future date, as entailed in Tigard's Comprehensive
Plan?

QUERY 10: If so, when was the Comprehensive Plan drawn
QUERY 11: If not, why would the partitioning of one
lot require 98th Avenue to be increased to 60 feet, when the
construction of apartments immediately across from parcel 2
did not?
QUERY 12: If the proposal embodied in the Plot Plan
came about only because of the minor lot partition, when
was the proposal drawn up?
QUERY 13: Ti the partition application were withdrawn,
would the city still propose to widen 98th Avenue as
outlined in the Plot Plan?
Seventh, the memorandum of February 4 also states that to
"the south of the site [parcel 2] land has been dedicated
sufficient to establish a 50 foot right-of-wa," but, as
noted above, the memorandum says that the 60 foot width is
needed to satisfy the Comprehensive Plan.
QUERY 14: Have the property owners to the south been
informed that they will b required to dedicate an
additional amount of land to satisfy the 60 foot
requirement?
Eighth, in early January, Harris -McMonagle submitted a
preliminary partition plat and projeCt overview as part of
my application for the partition. That report stated
that any additional right-of-way required on 98th Avenue
"should be provided by those on the west side of [the]
street as those on the east have already dedicated their
share"[as part of the Greenberg Heights platj. Prior to
the decision of February 17, neither Harri8-McMonagle nor
I were informed that this proposal was unacceptable, and
that Significant portions of land would be dedicated not

only for parcel 2, but once again for parcel 1.
QUERY 15 Why is additional right-of-way required for
the east side of 98th?
QUERY 16: Why was Harris-McMonagle not informed, after
submitting the preliminary partition plat, that the
Comprehnsive Plan for streets and the solar access
requirements would necessitate a revision of the proposed
85'x 88.88' lot for parcel 2?
Finally, the proposed right-of-way dedications for parcels
1 and 2 effectively take portions of the property without
provisions for compensation. In addition, the plan to widen
98th and take a significant amount of land from the property
to the west of parcel 1 and to the south of parcel 2 make
appeals by those property owners virtual certainties (the
property owner to the west has informed me that he intends
to appeal). This means that the widening of 98th Avenue
to 60 feet could ultimately terminate this partition
application and relegate parcel 2 to the status of a vacant
lot for the forseeable future.
QUERY 17 Is the City of Tigard prepared to compromise
on the width of 98th Avenue in order to facilitate this
partition and allow development of parcel 2?
My proprsal is this (1) Plan to widen 98th to only 40
feet; (2) take the additional 10 feet from the west side
of the street, since the east side has fully dedicated
its portion (I do not object to the proposed widening of the
corner of 98th and Greenburg, creating the 90 degree angle).
This compromise takes into account the actual conditions
on the street, especially at the interseOtion of 98th and
Greenburg. These conditions developed over 40 years ago;
to dedicate street rights-of-way in accordance with
a Plan, obliviouS to preexisting, albeit nonconforming,
conditions, offends not only basic justice and fair play,
but pragmatism, since the result of the wholesale
devaluing of property values along 98th Avenue, both now and
later, will no doubt result in extensive and expensive legal
battles. I respectfully ask you to reconsider the street plans for
98th Avenu e aS they impinge upon parcel 2 and its successful
partition4 Thank yoU.

Applicant is requesting approval to divide a single family parcel
known as Tax Lot 800 in the Greenburg Heights plat into two lots of
approximately 9600 square feet and 7500 square feet respectively.
Both the existing and proposed parcels would take access from SW
98th Avenue.
Findings:
1. Streets:
The site is located on the southeast corner of the
intersection of SW 98th Avenue and SW Greenburg Road. SW
Greenburg road is classified as a major collector and SW 98th
Avenue is a minor collector.
The existing pavement of SW Greenburg Road has been improved
to the ultimate width. The existing pavement on SW 98th
Avenue is approximately 20 feet wide, centered on the existing
30 foot right-of-way originally dedicated with the Greenburg
Heights plat. To the south of the site, an additional ten
(10°) feet has been dedicated on both sides of the existing 30
foot easement to establish a 50 foot right-of-way. However,
a sixty (60') foot right of way would be required to satisfy
the minor collector street status shown on the Comprehensive
Plan.
The existing structure on the subject site, as shown an the
plot plan submitted, and the existing house on the opposite
side of SW 98th Avenue, provide difficult design constraints
if the future widening of SW 98th AvenUe is to be achieved.
Due to the skew angle of the intersection SW 98th Avenue and
SW Greenburg Road, a curvilinear re-alignment of SW 98th
Avenue is recommended to provide a future interSection at 90
degrees. Maintaining a minimum 15 feet from the existing
residences, it would be possible to design the street With
reversing dUrV08, using a minimum centerline radius of 166
feet, that would provide for both the widening and the 90°
alignment. Please gee attached sketch Marked Exhibit A
Inasmuch as the entire right'-of-way is not available with this
proposal/ the applicant should be required to dedicate that
portion of the right -0f-waY that i8 applicable to this site
and sign an agreement of non'-tem0A8trahCe for a future LID to

improve SW 98th Avenue and, its intersection with SW Greenburg
Road.
2. Sanitary Sewer:
There is an existing 8 inch public sanitary sewer line located
in an easement across the southerly fifteen feet of proposed
Parcel 2. The existing building is connected to the this line
and will require a side sewer easement across Parcel 2 Or re-
connection to the existing sewer in SW 98th Avenue. The
existing sewers have sufficient capacity for this development.
3. Storm Sewer:
The site slopes towards the southwest and drains onto SW 98th
Avenue. The existing underground system is located 200 feet
to the south and is not adequate for the area.
In the future when the property develops, the applicants
should construct a ditch and culvert at fthe edge of the
existing pavement and grade the ditch to drain south toward
the existing system to flow along the existing edge of
pavement. This would be an interim solution until the future
LID is formed and the street constructed to ultimate
standards.
Recommendations:
ALL CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED PRIOR TO
RECORDING THE FINAL PLAT WITH WASHINGTON COUNTY.
1. Additional right-of-way shall be dedicated to the Public along
the easterly frontage of SW 98th Avenue to increase the right -
of -way to 30 feet from the proposed centerline. The
description shall be tied to the proposed right-of-way
centerline that conforms to Exhibit A and approved by the
Engineering Department. The dedication document shall be made
on the final plat of the Minor Partition. Instructions are
available from the Engineering Department.

2. An agreement shall be exec!uted, on forms provided by the City,
which waives the property owner's right to oppose or
remonstrate against a future Local Improvement District formed
by the City of Tigard to improve SW 98th Avenue.

Parcel 1 across Parcel 20 or construct a new house sewer in SW
98th Avenue for Parcel 1
4 Final Plat Applidation Submission Requirements:
Three copies of the partition plat prepared by a land
surveyor licensed to practice in Oregon, and necessary

B. The partition plat and data or narrative shall be drawn
to the minimum standards set forth by the Oregon Revised

LOCATION
The address of the existing house is 11415 SW Greenburg Road. The property is located in the
southeast quadrant of the intersection of SW Greenburg Road and SW 98th Avenue; city of `
Tigard, Washington County, Oregon:
The property is shown as Tax Lot 800 on Assessor's Map 1S- 1 -35CD.
ZONING
R -4:5 - Single Family Residential - Minimum lot site 7,500 square feet.

EXISTING SITE CONDITIO,
The site slopes from the northeast corner to the southwest corner at an average grade of
approximately two percent.
As shown on the Preliminary Partition Plat the existing house is located in the northerly portion of
the property.
The garage portion of the house is accessed from 98th Avenue. The set back from the right-of-
way line to the garage is 12.19 feet. This does not meet the twenty foot garage set back
requirement for the zone, however, Chapter 18.132 of the Development Code allows for this
existing nonconforming situation.
The right-of-way width of SW 98th Avenue in front of the property is 30.00 feet. This right-of-
way was dedicated a part of the Greenberg Heights ptat. The obvious intent was that the other
half of a 60 foot fight-of-way would be dedicated as the parcels to the west developed. This has
not yet °wanted, However, any additional right-of-way that may be required should be provided
by those on the west side of street as those on the east have already dedicated their share.
The entire site is landscaped; a large lawn area with a scattering of fruit and ornamental trees
around the existing house
DEVELOPMENT PROPOSAL
As shown on the Preliminary Partition Plan, the proposal is to partition the existing 17,215 square
foot tract into two parcels. The existing house will be on Parcel 1 which will have an area of 9,661
square feet. Parcel 2 will contain 7,554 square feet

is of sufficient size and depth to serve the property.
