No other comments have been received. SECTION III FINDINGS coNgpsioNs -1l inor land Pal ition Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The F roposall conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance . requirements and regulations; 3, Adequate public facilities are available to serve the proposal; TICE OF DECISION MU 93 -0015 RASE Page NO 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89-06; Ord. 83-52). The proposal conforms with the City's comprehensive plan in that the newly created lot will continue to allow for residential development. This proposal therefore is not in conflict with the Medium Density Comprehensive Plan designation. This proposed partition shall comply with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this adminigrative decision and by this application and review process. The applicant shall submit landscape and impervious surface calculations for lot 41 which demonstrates that lot #1 is in compliance with the minimum landscape requirement of 20 percent. Adequate public facilities are available to serve the proposal. Section 18.162.050 'contains the following special provisions for lots created through the Partition Process: A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement, D. Setbacks: Setbacks shall be as required by the applicable zoning district E. Front Yard Determination for Flag Lot When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for NOTICE OF DECISION MLP 93-0015 - RABER Page 3 " abutting lots and to provide usable outdoor recreation areas for proposed development. • Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. • Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards seo, forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and/or development is allowed within or adjacent to the one- hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a p edestsian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria A, B, C, and D are satisfied. There is no minimum lot width requirement in the R -12 zoning district. This partition would create lots of approximately 4,850 and 11,250 square feet, exceeding the 3,050 square foot minimum lot size requirement. Lots #1 and #2 have approximately 110 and 60 feet of frontage on SW Greenburg Road, thereby satisfying the minimum frontage of 15 feet in Criteria C. The required setbacks for the multi- family development on lot #1 are: front yard 20 feet; side yard - 10 feet; rear yard - 20 feet; and 20 feet from the front of the garage to the property line from which access is obtained. As indicated on the site plan, the existing tri-plex on lot #1 complies with the side and rear yard setbacks y satisfying of 20 feet is not tllereb satisf in Criteria D. The front yard setback ��iatel 16 feet. The satisfied as the site plan indicates a setback of approximately proposed partition will not increase the nonconformity of this setback. Future development on lot #2 will be reviewed for compliance with the applicable single family setbacks of the R -12 zone. Criteria E, F and J are not applicable to these lots as neither are flag lots applicable ne nor are they within the floodplain. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. This access easement is required as lot #2 shall be restricted to using the existing access. No direct access shall be allowed onto SW Greenburg Road for lot #2. Criteria 1 shall be satisfied as a revised site plan shall be submitted which shows the provision of a 30 foot wide access drive. This access shall include 24 feet of pavement, curbs and a 5 foot sidewalk along one side of the drive. Section 18.88.010 (Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. Code Section 18.88.040(E) , however, allows the approval authority to exempt new lots from the solar access standard in certain cases, including situations where existing right-of-way prevents lots from being oriented for solar access. Given the existing orientation of SW Greenburg Road and the configuration of the subject site prevents the proposed parcel from being orientated for solar access, Therefore, the new parcel is except form the solar access standard. Se_ctic8.1644131) (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: The site is located on the east side SW Greenburg Road which is classified as a major collector and the existing street has been improved to the ultimate width. The applicant shows on the site plan that the proposed new lot, Parcel 2, would use the existing driveway for access. This limitation on the access should be a condition of approval and no direct vehicular access to SW Greenburg Road for the new Parcel 2 should be allowed. 2, Sanitary Sewer: Sanitary sewer service is provided by eight inch lines of adequate capacity in SW Greenburg Road. However, there was no stub provided to the proposed lot and it will be necessary to construct a new sewer service line. 3. Storm Sewer: The site slopes to the north, toward an existing developed site. Future site development should require that the ori-site stormvvater should be collected in an underground system, prior to entering onto adjacent property, and piped to the existing storm sewer in SW Greenburg Road.
