Vicinity Information NOTICE OF DECISION MLP 93-0014 - SOUTHER Page 1 • The subject site is located north of SW Bonita Road and east of SW 72nd Avenue. The adjacent properties are zoned I -L (Light Industrial) to the north and I -H (Heavy Industrial) to the south, east and west. The surrounding area is predominantly zoned industrial. 2. ije Information and Proposal Description This site is approximately 6.5 acres in size. Two existing concrete warehouses presently occupy the site. The site currently has access to S.W. 72nd Avenue. The applicant requests a Minor Land Partition approval to divide one parcel of approximately 6.5 acres into two parcels of approximately 3 and 3.5 acres in size. 3. eno:y Comments. The City of Tigard Building Division has reviewed this proposal and has offered the following continent. A storm easement needs to be provided from parcel 2 to parcel , The existing 24 foot easement needs to be reviewed for potential changes. Staff Contact: Dave Scott. The Tigard Water District has reviewed this proposal and has offered the following comment: The property owner will be required to purchase water service for the parcel. General Telephone and Electronics has reviewed this proposal and has offered the following comment The developer is responsible to provide and place all conduit and trench according to GTE specifications Allow 45 -60 days from GTE engineering completion to GTE construction completion. . The City of Tigard Public Works, Tualatin valley Fire District, Northwest Natural Gas, and Portland General Electric have reviewed this proposal and have no objection to it No other comments have been received. SECTION III - FINDINGS AND CONCLUSIONS Minor Land Partition on NOTICE OF DECISION NP 930014 - SOUTHER Page 2 Section 18.162.040 contains the following general approval ciziteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2 The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89-06; Ord. 83-52). The proposal conforms with the City's comprehensive plan in that the newly created lot will continue to allow for industrial use, as the partition is to an already developed property. This proposal therefore is not in conflict with the Heavy Industrial Comprehensive Plan designation . This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process. Adequate public facilities are available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process Lot Width: The minimum width of the building envelope area shall 'meet the lot requirement of the applicable zoning district. B. Lot Area The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the acoessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easewent. D. Setbacks: Setbacks shall be as required by the applicable zoning district. r. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria A,E, and D are satisfied The proposed lot widths for parcels 1 and 2 are approximately 290 and 315 feet respectively, thereby meeting the 50 foot average minimum lot width requirement in the I-H zone. There is no minimum lot area requirement in the I-H zone. The required setbacks in the I-H zone are as follows: front yard -30 feet and corner lot 20 feet. There are no applicable side or rear yard setbacks as the property does not abut a residential district. Parcels 1 and 2 have approximately 250 and 350 feet of frontage on SW 72nd Avenue, satisfying criteria C. Criteria E and F are not applicable as neither parcel is a flag lot. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying criteria G. Criteria H will be satisfied as a reciprocal easement will be recorded with the approved partition plat which ensures access and maintenance rights. As indicated on the site plan, accessways will be consistent with Community Development Code standards for both parcels, thereby satisfying criteria I. Criteria J is not applicable to these parcels as neither are within the floodplain. Sections 18.164.030 ( Streets ) 18.164.09.0 ( Sanitary SeYArer) , and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: Access to the site is provided by two private easements that connect to SW 72nd Avenue. The northerly easement is an extension of the public road to the west, SW Landmark Lane. This development configuration was previously approved by MLP 91-004 and the plat was recorded ao Partition Plat 1992-007. SW 72nd Avenue was constructed in 1984 by LID No. 21 with the curb line 20 feet from centerline on the existing 25 ft right- of-way. Inasmuch as SW 72nd Avenue is classified as a major collector on the Comprehensive Plan, a street dedication to 30 feet from centerline should be required. The sidewalk was constructed as a requirement of the previous MLP. 2 Sanitary Sewer: Sanitary Sewer Service is provided by eight inch lines of adequate capacity in SW 72nd Avenue and in easements along the southern driveway and easterly property line. 3. Storm Sewer: The site has been improved with asphalt paving and an underground storm drainage system that connedts to the storm drain in SW 72nd Avenue. The system does not require any additional improvement at this time.
