The partition plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), 'Washington County, and by the City of Tigard. SECTION II FINDINGS OF FACT: A. g ound Iufor at3.on: In February of 1900, the City approved a site development review (SDR 4 -00) which permitted the building of a 2,800 square foot auto shop located on the front of the site AL site development review in 1985 (SDR 4 -85) approved the construction of a second building located on the rear of the site (west of the existing structure). 3. vicinity Information: This site is bounded on the west, south and east by properties which are zoned I -P (Industrial Park) . The land to t:he north is zoned I -L (Light Industrial). This area has been under a great deal of industrial investment in recent years and is now largely developed. Site and Proposal De C gcri.nta_ona s: Tax Lot 400 is approximately 0.62 acres in size (26,800 square feet) . The site fronts SW 72nd Avenue for a distance of approximately 80 feet. L=ndscaping is provided on the front (east) and north sides of the site with additional landscaping and screening around the perimeter. A variance is requested to allow the newly created parcel to provide less than the required 15 percent landscaping on-site. The easterly parcel will exceed this standard. D. The City of Tigard Building Division has reviewed this application and notes that a plan should be =ubmitted which clearly shows all existing utilities. Easements should be provided where utilities cross the new property line. GTE has reviewed this application and notes that any relocation costs of existing telephone facilities will be the responsibility of the property owner. It is the responsibility of the property owner to contact GTE on any building activity and allow 45-60 days lead time from GTE engineering approval to GTE construction start. No other comments have been received. SECTION III ANALYSIS - Minor Land Partition Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89-06; Ord. 83-52). The proposed application is not in conflict with the Cityes Comprehensive Plan in that use of this proposed new parcel is the same as currently exists (Peter's Auto Works) and is a permitted use in the I -L zone. In a statement supplied by the applicant, Bathcrest preforms a painting process which uses catalyzed acrylic paints, which very closely resemble automotive finishes. These finishes are both stored and used on the premises and often involve the use of a sterile paint booth. Therefore, both of these uses are permitted uses in the I-L zoning district. The preliminary partition plat compli s with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process. Adequate public facilities are available and do currently serve this site or can be conditioned as such. Section LELLO0M21). (Dimensional Requirements) of the Community Development Code (CDC) allows a maximum building height of 45 feet in the I.L zone. The front yard setback requirement for the I-11 zoning district is a minimum of 30 feet. There is no side yard or rear yard setback for this site since this property does not abut a residential zoning district. Approximately 15 percent of this site is landscaped as is required by this code section. However, the majority of this landscaping is located on the front portion of the site (the eastern portion). Upon the recording of this partition, the newly created lot will not meet the minimum landscaping standard as required by the I-L zone. This shall be addressed further in the review of the variance request. The subject site is fully developed and no site alterations are proposed by this application. Therefore, these code standards have been largely satisfied. Section 18.162.050 states that each lot created through the partition process shall front a public right-od-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. The preliminary partition plat demonstrates that the eastern lot will retain the full 80 foot street frontage with access to the western lot being made available on the south side of the property. This access shall be provided by easement across the easterly lot. Code Section 18.106.2130WALU (Parking) requires one vehicular parking space for each 500 square feet of gross floor area for each of the existing uses. The existing buildings, when combined, provide 9,918 square feet of floor area. Therefore, 20 parking spaces are required on this site. A total of 19 spaces are shown on the partition plat site plan. This one space deficit is according to current code standards and not the standards which were in place when the most recent site development review was approved in 1985. Therefore, to provide the opportunity for adequate parking, a reciprocal parking STAFF REPORT XIX 93-0009 NADEAU Page 4 agreement shall be entered into by both property owners. Verification of this agreement shall be submitted to the P1- :nninng Division. Future redevelopment of these sites shall be subject to all Code Standards in place at the time of application submittal. Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer) and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. , treetsw The site is located on the west side of SW 72nd Avenue just north of the Boones Ferry Road /72nd Avenue intersection. Southwest 72nd Avenue is cla.= ;sified as a major collector. All street improvements have been installed 2. Sanitary Sewer a There is an existing 8 inch public sanitary sewer line located in SW 72nd Avenue which runs along the northern property line. Both of the existing buildings are connected to this line. 3. Storm Sewer: The site slopes toward the west. An existing public storm sewer line runs along the north property line. The existing bui.. !.ngs are connected to the line(s). The Unified Sewerage Agency has established, and the City has agreed to enforce (Resolution and Order No. 91 -47), Surface Wat r Management Regulations requiring the construction of on -site water quality facilities or the payment of fees in -lieu of their construction. No additional imp;- rvious surface is being created with this land application. Therefore, the applicant is not required to pay a fee or construct an on -site facility. SECTION IV .ANALY. IS m VARIANCE: Code Section 18.70.050 A 6 states that the minimum landscaping requirement for each development in the I -L zone is 15 ercent • percent. A variance is requested to this st . ndard because the site is already fully developed with 15 percent landscaping currently provided. The proposed act of partitioning creates this none - conformity since a greater portion of the existing landscaping will be retained by the eastern tax lot Code Section 18.134.050 contains the criteria for allowance of a variance to a Code standard. (2) There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; (3) The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent possible, while permitting some economic use of the land. (4) Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected anymore than would occur if the development were located as specified in the Code; and The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. Staff finds that this variance request will not be detrimental to the purposes of Title 18, be in conflict with the policies of the Comprehensive Plan, or any other applicable policies and standards or to other properties in the vicinity. There is a special circumstance which exists on this site which is not directly applicable to other properties in the same zoning district The current development on this site has located the majority of this landscaping on the front portion of the site (the easterly portion). Upon the recording of this partition, the newly created lot (the westerly lot) will not meet the minimum landscaping standard as required by the I-L zone. The subject site is fully developed and no site alterations are proposed by this application. Strict adherence to this standard would result in either denying this application or requirin the applicant to remove some of the existing parking or circulation area Either of these alternatives would cause an undue hardship on the landowner and on this site by requiring a further reduction in the number of existing parking spaces and shall therefore not be required.
