NOTICE OF DECISION MLP 93 0008 SKORO / KOHLMAN Page The City of Tigard Public Works, Tualatin Valley Fire District, Tualatin Valley Water District, School District #23J, Portland General Electric and Northwest Natural Gas have reviewed this proposal and have no objection to it. No other comments have been received. SECTION III - FINDINGS AND CONCLUSIONS � Minor Land Partition Section 10.16.2.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conform with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89-06; Ord. 83-52). The subject site conforms with the City's comprehensive plan in that each newly created lot will allow for a single family residence and therefore, this site is presently not in conflict with the Low Density Residential comprehensive plan des nation. This proposed partition complies with all statuto and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process. After conducting a site visit of th subject parcel, planning staff found the site to contain two accessory structures that were not shown on the preliminary site plan. Planning Division will thus require that applicant submit a revised site plan that includes both accessory structures, their uses/ and how far they are setback from the side and rear property lines. Section 1811112_410.Q.4). (Solar Access) states th t all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. Due to the configuration of the ubject site, existing street orientation of the three parcel precludes the possibility for orienting the frontage of the ; e parcels within 30 degrees of an east -west axis. Code Section 18.88.040(E) , however, allows the approval authority to exempt new lots from the solar access standard in certain cases, including situations in which existing road patterns are continued through the site or terminate on -site which prevent given streets or lots in the development from being oriented for solar access. Therefore, all thr.ae parcels are exempted from the solar access st,= :ndards. The north-south lot dimension of the three lots will be greater than the 90 foot minimum required by code. Therefore this solar access code has been satisfied. Section 18.162. 450 statee that each lot created through the partition process shall front a public right -of .way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. The preliminary partition plat demonstrates that all the lots will meet or exceed this requirement. Sections 18.164.030 (Streets) 18.164.090 (Sanitary Sewer)/ and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: oc The site is located on the east said = of SW 72nd Avenue/ between Ito SW Oak and Mapleleaf streets. i SW oak is classified as a Major collector, SW 72nd is classified as a minor Collector and S'4 da.pleleaf is a local street, Currently, all streets that front the development have sufficient right -of -way, though they are ua not fully improved to meet current City standards, NOTICE OF DECISION p 93 0008 - SKORO / KORMAN Page Section 18.164 .030,.1. c .v of th Community Development Code allows the Director to accept a future improvement guarantee in lieu of street improvements if m the improvement is associated with an approved land partition on property zoned residential and the proposed land, partition does not create any new streets. This application meets the above criteria. Therefore, based upon the information provided the applicant should be required to sign a non - remonstrance agreement for the future improvements to SW Oak Street, SW Mapleleaf Street and SW 72nd Avenue Section 13.108.060 of the Community Development Code sets criteria for Inadequate or hazardous access. In general the code discourages direct individual access to arterial or collector streets , Specific lly direct access to major collector or arterial streets shall only be considered if their is no alternative way to access the site. Since both SW 72nd and SW Oak are collectors direct access for the newly created lots should be limited to SW 72nd Avenue and the lots should have a joint access. 2. Sanitary Sewer: Currently there is an flinch public sanitary sewer line located in SW Oak and Mapleleaf streets. Due to the slope of the site it appears the line in SW 0 is the most appropriate line to connect to, this should be verified by the applicant at time of building permit issuance. The applicant is proposing to provide two private lateral service lines from SW Oak to serve the new lots this will require and the applicant has proposed a private easement over lot 3 to for the sewer lateral for lot 2. While the Engineering Department has no objection to this proposal, it should be noted that if parcel 2 is divided this sewer lateral will not be sufficient and that a public sanitary sewer line would be required. 3. Storm Sewer: The site slopes towards the west. The applicant should be required to provide positive drainage of the newly created lots to the public storm sewer system located in SW 72nd Avenue or SW Oak Street. NOTICE OP DECISION MLP 93 -o0O8 SKORO / KOIU.MAN Page 6 • The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on- site water quality facilities or fees in-lieu of their construction. Requiring zurface water quality facilities on small sites would result in numerous facilities that would become a maintenance burden to the City. Furthermore, the applicant has not proposed any such facilities and there are no natural depressions or other areas of this site that are particularly suitable for water quality facilities. Regional facilities, funded by fees in-lieu of construction of these facilities, would provide the required treatment with improved reliability rnd less maintenAnce. Therefore the applicant should be required to pay the fee in-lieu of constructing an on-site facility. The Planning Division hereby APPROVES Minor Land Partition MLP 93-0008 subject to the conditions listed in Section I at the beginning of this decision. Two of the lots will contain approximately 19,950 square feet each and the third will contain approximately 26,980 square feet. May 17, 1993 Findings°.°: 1. Streets: The site is located on the east side of S.W. 72nd Avenue, between S.W. Oak and Mapleleaf streets. S.W. Oak is classified as a Major Collector, S.W. 72nd is classified as a Minor Collector and S.W. Mapleleaf is a local street. Currently, all streets that front the development have sufficient right-of-way, though they are not fully improved to meet current City standards. Section 18.164 030A.1.c.v of the Community Development Code allows the Director to accept a future improvement "guarantee in lieu of street improvements if: the improvement is associated with an approved land partition on property zoned residential and the proposed land partition does not create any new streets. This application meets the above criteria. Therefore, based upon the information provided the applicant should be required to sign a non- remonstrance agreement for the future improvements to S.117. Oak Street, S.W. Mapleleaf Street and S.W. 72nd Avenue. Section 18.10.8.060 of the Community Development Code sets criteria for Inadequate or hazardous access. In general the code discourages direct individual access to arterial or collector streets. j ,tor or art erial streets shall only be Specifically direct access to major collector e considered if their is no sl native way to access the site. Since both 72nd and Oak are collectors direct access for the newly created lots should be limited to S .W. 72nd Avenue and the lots should have a joint access. ENGR. COMMENTS - Si<ORO/KOHLMAN MLP 93 -0008 PAGE 1 2. Sanitary Sewer: Currently there is an 8 inch public sanitary sewer line located in S.W. Oak and Mapleleaf streets. Due to the slope of the site it appears the line in S.W. Oak is the most appropriate line to connect to, this should be verified by the applicant at time of building permit issuance. The applicant is proposing to provide two private lateral service lines from. S.W. Oak to serve the new lots. this will require and the applicant has proposed a private easement over lot 3 to for the sewer lateral for lot 2. While the Engineering Department has no objection to this proposal, it should be noted that if parcel 2 is divided this sewer lateral will not be sufficient and that a public sanitary sewer line would be required. Storm Sewer: The site slopes towards the west. The applicant should be required to provide positive drainage of the newly created lots to the public storm sewer system located in S.W. 72nd Avenue or S.W. Oak Street. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on -rite water quality facilities or fees in -lieu of their construction. Requiring surface water quality facilities on small sites would result in numerous facilities that would become a maintenance burden to the City. Furthermore, the applicant has not proposed any such facilities and there are no natural depressions or other areas of this site that are particularly suitable for water quality facilities. Regional facilities, funded by fees in -lieu of construction of these facilities, would provide the required treatment with improved reliability and less maintenance. Therefore the applicant should be required to pay the fee in- lieu of constructing an on-site facility. Recommendations: ALL CONDITIONS SHALL BE SATISFIED OR FINANCIALLY ASSURED PRIOR TO RECORDING THE FINAL PLAT WITH WASHINGTON COUNTY. 1. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against Local Improvement i�ictformed by the City of Tigard to improve S.W. Mapleleaf Oak streets and S.W. 72nd Avenue. 2 The applicant shall obtain a street opening permit from the Engineering Department prior to doing any work in the public right of -way or easements. These requirements render the subdivision financially unfeasible. 2.
