Requirements
A. Three copies of tie partition, plat prepared by a land
surveyor to practice in Oregon, and nece nary data or
narrative.
B. The partition plat and data or narrative shall be drawn
to the minimum standards set forth by the Oregon Revised
Statutes
(ORS 92.05), Washington County, and by the City
of Tigard.
2 SECTION 18.164.150 Installation: Prerequisite/Permit Fee
. No land division improvements, including sanitary sewers,
storm sewers, streets, sidewalks, curbs, lighting or
other reguiremonts shall be undertaken except after the
plans therefor have been approved by the City, permit fee
paid and permit issued.
SECTION II FIEDINGS OF FACT:
1. Vicinity Information
Tax lot 406 is located on SW North Dakota Street approximately
300 feet south of the inwarsection of SW Scholls Ferry Road and
SW North Dakota Street. Access to the property is provided
from SW North Dakota Street.
Tax lot 4 E 4 is located on SW Scholls - Per Road approximately

from SW Scholls Ferry Road. The surrounding properties are
zoned for residential development and are substantially
developed.
2 Site Information and Eggposal Description
The two parcels are approximately 146,808 square feet in size.
An existing Mc Donald' s restaurant now occupy parcel #1 of tax
lot 404. The remaining parcels are to be developed with
commercial activities.
3 Agency and NPO comments

the proposed parcels. Also if it is possible to loop
the water main back to another main on the south side of
proposed parcel 3 -plat B then a dead ended main would be
eliminated.
In addition, the Water District has no objection to the
partition request or tax lot 404, but it should be noted
that parcel 2-plat . does not have access to a water
main. The nearest water main is on the south side, of
proposed parcel 3-plat B. It is recommended that a n; w
water line be installed (minimum of 8") from SW North
Dakota Street along the existing private drive. e. A'Lso
fire hydrants must be located within 250 feet of all
portions around the new proposed buildings
General Telephone and Electronics has reviewed this proposal
and has offered the following comments:
Any re- location of existing telco facilities will be at
the expense of the owner/developer.
The City of Tigard Building Division, School District #23J and
Portland General Electric have reviewed this proposal and have
no objection to it.
No other comments have been received.
SECTION III -DINGS AND CONCLUSIONS - Minor Land Partition
Section 1162.04.0 contains the following general approval
criteria for a Minor Land Partition:
1. The proposal conforms with the City's Comprehensive
Plan;
2. The proposed partition complies with all statutory
and ordinance requirements and regulations;
Adequate public facilities are available to serve
the proposal;
All proposed lots a, onform to the size and
dimensional requirements of this title; and
5. All proposed improvements meet City and applicable
agency standards (Ord 89-06; Ord. 83-52).
The proposed partitions complies with the minor land partition
approval criteria noted above. The three parcels in the C-P

zoning district will exceed the 6,000 square feet minimum lot
area requirement, and the 50 foot average minimum let width.
The two additicaal parcels in the C-G zoning district will
exceed the 50 foot average minimum lot width standard. There
is no minimum lot area requirement in the C -G zone. The
existing McDonald's restaurant building would continue to
comply with applicable building setback standards. Because
partitioning would appear to facilitate usage of the parcels
with uses permitted by the C -P, and C-G zone, partitioning is
supportive of Comprehensive Plan purposes.
The parcels are already adequately served by necessary public
facilities including sanitary sewer, storm drainage and water
supply. The applicant has submitted copies of the declaration
of restrictions and easements for both parcels. This document
states that both parcels will grant non-- exclusie : utility
easements to all the other newly created parcels in the
development and specify maintenance responsibilities for the
utilities.
All affected parcels will have in excess of the 25 feet minimum
frontage on public roadways The declaration of restrictions
and grant of easements for tax lot 401 which is west of tax lot
404, and north of tax lot 406 grants non - exclusive access
easements for the various parcels within the development
Therefore, an access easement already exists in favor of 1.here
new parce.s . All parcels within this development will share
access and parking which is consistent with the standards of
Code Chapters p 6 (Parking) and Chapter 18.108 ; (Access,

Egress and Circulation)
18.164.030 (Streets) , 18: . 644 00990 (Sanitary Sewer) , and
18.1 4.10 0 (Storm Drains) have been addressed and are satisfied
as specified below:
1. Streets:
Tax lot 406 is located on SW North Dakota Street approximately
30 feet south of the SW Scholl° c'erry Road /North Dakota Street
intersection. SW North Dakota Street is classii .wed as a minor
collector street and has the following minimum standards (all
distances are from centerline of the right-of-way): 30 feet
of right -of sway, 20 feet of pavement, curbs and sidewalks.
SW North Dakota Street is fully improved along the frontage of
this site. Access to the site(s) is from an existing
ingress /egress easement, no additional access is requested.
No additional i. ;provements are required.
T'ax lot 404 is Located on SW Scholls Perry Road approximately
200 feet east of the SW Scholia Ferry Road /North Yokota Street
inter.ection.' SW Soholls Ferry Road is under the jurisdiction

of 'Washington County. OW Scholls Ferry Road is fully improved
along the frontage of the site. Access to the proposed 2nd
parcel is from an exist.a.ng access easement. No additional
improvements are required.
2. Sanitary Sewer:
Currently there is an 8 inch public anitary sewer line located
along the west and north property lies of tax lot 406. The
existing line has the capacity for any future development. No
additional improvements are required.
Tax lot 404 currently has an 8 inch public sanitary sewer line
located at the southwest corner of the parcel. The existing
line has the capacity for any future development. No
additional improvements are required.
3. Storm Sewer:
Tax lot 406 has an existing public storm drainage line located
in SW North Dakota Street. This system has the caparzity to
handle any future development No additional improvements ara
required.
Tax lot 40.4 is served by a private storm drain Tine which
connects to a public storm sewer system located in SW North
Dakota Street, The applicant has proposed a joint
use /maintenance agreement for the privy. a line for any future
development. The private and public system have the capacity
to handle any future development. No additional improvements
are required.

In 1990, Washington County adopted a county-wide Traffic Impact Fee (TIF)
ordinance Thies: action placed into effoct an increased street development
fee on all new development in Washington County. The City of Tigard has
adopted the county's program.
The City Traffic Impact Fee program will collect fees from new development:
based on the development's projected impact on the transportation system.
Developing properties will be required to pay based on The number of tripe
they are projected to generate. The TIF is calculated based on type of
use, size of project, and a general use based fee category. TIF shall
be calculated at time of building permit; issuance. In limited
circumstances, payment of the TIF may be allowed to be deferred until
issuance of occupancy permit. Deferral of payment until occupancy is
permissible only when the TIF is greater than $5,000..00.
STORMWATER QUALITY FEES /FACILITIES'
The Unified Sewerage Agency has established and the City has agreed to
enforce, Resolution No 90-43, Surface Water Management Regulations,
requiring the construction of on -site water grality facilities or fees in
lieu of their construction. The resolution requires that a fee and, /or,
construction of a water quality facility facilit be built. The fee is based on
the amount of impervious surface; for every 2640 square feet or portion
thereof, the fee shall be $285.00. The City of Tigard determines if a fee
or facility shall be built.

Applications must be accepted by a Planning Division staff member at the
Community Development Department counter at City Hall. Applications
submitted by mail or dropped off at the counter without Planning Division
acceptance may be returned. Applications submitted after 4 PM on Thursday
will be batched for processing with the ,following week's applications for
processing. No applications will be accepted 4:30 PM.
Maps submitted with an application shall be folded in advance to 5.5 by 11
inches. One 8.5 inch by 11 inch "map of a proposed project should be
submitted for attachment to the staff report or administrative .''ecision.
The Planning Division and Engineering Division will do a preliminary
ca

complete within 10 days of submittal. Staff will notify an applicant if
