Vicinity Infornmation The subject site is located on the east side of SW 97th Avenue, approximately 210 feet north of Sail McDonald Street. Access to the site is provided from SW 97th Avenue The adjacent properties are zoned R-4.5 (Residential, 4.5 waits per acre). 2. Site Information and Pr, oposal Description This site is approximately 52,272 square feet in size. An existing single family residence, a mobile home and a detached garage now occupies. this site The parcel is flat with some low profile trees. The appAcant requests minor land partition approval to divide this 52,272 square foot parcel into two parcels of approximately 43,272 and 9,000 square feet 3. Agency and Nro comments Tualatin Valley Fire Department has rev. ? sewed this proposal and has offered the following comments: The applicant should be made aware of the following requirements; 1) Provide plans to the Fire Department for review and approval of all dead end roads and turn- around; 2) Fire hydrants are required within 500 feet measured around the outside and along acoessways of all buildings. Tigard Water District has reviewed this proposal and has offered the following comments: Although the Water District has no objection, they are concerned that a new load may go in without proper water service. The developer is urged to contact the Water District for proper water system design standards. Portland General Electric, School District #23J, City of Tigard Building Division, City of Tigard Operations Division and General Telephone and Electronics have reviewed this p 2c,posa ,. and have no objection to it. No other comments have been received. STAFF REPORT IMP 93 -0002 MUTT PAGE 3 SECTION III FINDINGS AND CONCLUSIONS ;-_„Mi Lard Partition Section 18.162.040 contains the follssang general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2e The proposed partition complies with all statutory and ordinance , equirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and, applicable agency standards (Ord. 89-06; Ord. 83 -52) . The subject site conforms with the City's Comprehensive Plan because the site is already developed with a single- family structure. Therefore, this site is presently not in conflict with the Low Density Residential Comprehensive Plan designation. This proposed partition complies with all statutory and ordinance requireetents a nr regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process Adequate public facilit „\es are available to serve the proposal. Sect' ion 18.50.050 contains the applicable size and dimensional requirements. This partition would create lots which greatly exceed the 7,500 square foot minimum size requirement for lots in the R-4.5 zone There is a 50 foot average minimum lot width requirement in this zone. Both of the proposed lots surpass this lot width requirement. As evidenced by the site plan, the existin single family building, the mobile home and thedetached garage which are to remain on this site complies with applicable ble zonin r setbacks which are: front yard 20 feet, ode and 5 fees; rear yard - 15 f eet and 2 0 r sat from the front of the garage to the property line from which access is obtained. Section '.8.88.040(C) (Solar Access) states that all newly creates: lots within the City of Tigard shall promote the use of renewable energy sources by prosti.ding for improved access to sunlight for residential dwellings. Due to the configuration of the subject site, existing street orientation of lot #2 precludes the pose aility for orienting the frontage of this lot within 30 degrees of an east-west art's. T STAFF REPORT MLP 93 -0002 LAUTT PACE 4 base requirement has been satisfied. The exizting lot faces SW 97th Avenue which is oriented in a north-south orientation. The existing lot is not required to meet the solar access requirements for lot creation since this lot pre -dated the solar access portion of the Development Code. Section 18.1.162.050 states that each lot created through the partition process shall front a public right -of- -way by at least 15 feet or have a legally recorded minimum. 15 foot wide access easement. The preliminary partition plat demonstrates that both lots will be served by a 25 foot wide accessway, therefore this code requirement is satisfied. Sections 18.164. 030 ( Streets) , 18.164.090 (Sanitary Sewer) , and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: The site is located on SW 97th Avenue. SW 97th is clasf,.ified as a major collector street and has the following minimum standards (all distances are from centerline of the right-of- way) : 30 feet of right-of-way, 22 feet of pavement, curbs and sidewalks. Currently there is 25 feet of right-of-way, approximately 20 feet of pavement; r' to curbs or sidewalks. Section 18 .164.030 ..1. c . (v) of the Community Development Code allows the Director to accept a future ialprovement guarantee in lieu of street improvements if the improvement is associated with an approved land partition on property zoned residential and the proposed land partition does not create any new streets. This application meets the above criteria. Based upon the information providod, the applicant should be required to sign a non - remonstrance agreement for the future improvements to SW 97th Ave The applicant is proposing a new access point to serve this n develc►pmeY.4 t s The proposed access pain t would line up with SW Elrose Street which is across the street. Therefore, the applicant should be required to provide one foot non-access frontage strip along the frontage of S W 97th Avenue nue except at the location directly across from SW Elrose Street. In addition, all existing acces ? points along the frontage should be closed. Sanitary Sewer: Currently there is an eight inch public sanitary sewer lice located along the east boundary of the parcel. The existing line has the capacity for this proposed development. No additional improvements are, required. STAF'F' REPORTP 93 -00'02 LAUTT! PAGE 5 3. Storm Sewer: The site slopes towards the northeast. The slope of the lot is such that the storm water will not be able to be directed to the public stogy sewer system Located in ;SW 97th Avenue. However, there is a open drainage ditch which runs parallel with the north property line which appears to cross the applicant's parcel ai.n the northeast corner. Therefore the applicant should provide for, drainage of the lot to the drainage ditch. The Unified Sewerage Agency has and and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on- site water quality facilities or fees in -lieu of their construction. Requiring surface water quality facilities one omall sites would result in numerous facilities that would become a maintenance burden to the City. Furth erm w're, the applicant has not proposed any such facilities and there are no natural depressions or other areas of this site that are particularly suitable for water quality facilities. Regional facilities, funded by fees in -lieu of construction of these facilities, would provide the required treatment, with improver reliability and lens maintenance. The proposed access point would line up with S.W. Elrose Street which is across the street. However, there is a open drainage ditch which runs parallel with the north property line which appears to cross the applicants parcel in the northeast corner. Therefore the applicant, should provide for drainage of the lot to the drainage ditch. The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91 -47) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in -lieu of their construction.
