Vic :nit _ information The subject site is located on the west side of SW 78th Avenue approximately 790 feet south of SW Spruce Street Access to the site is provided from SW 78th Avenue. The adjacent properties on all sides are similarly zoned R-4.5. This area is substantially developed with single - family residences. 2. Site Information and Pro osal Descri j ion This approximately 0.34 acre site is presently developed with one single family residence. A shed is located near the southwest corner of the site The site is well landscaped. A large 14 inch diameter maple tree is located in approximately the center of the front of the lot. The applicant requests Minor Land Partition approval to divide this 15,015 square fort parcel into two parcels of approximately 7,509 square feet each Also requested is a variance a9proval to allow an increased lot to depth, ratio of 2.528 to 1.0 whereas a maximum ratio of 2.5 to 1.0 is permitted. Agency and NP smaments The City of Tigard Building Division, Tualatin Valley Fire District School District 23J, and Portland General Electric have reviewed this proposal and have offered no objection to it. No other comments have been received. SECTION III .. FINDINGS AND CONC US I S - Minor Land Partition. Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2 The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5 All proposed improvements meet City and applicable agency standards (Ord. 89 -06; Ord. 83-52). The existing residence will maintain the above state:,, or greater, setbacks from all new and existing property lines as demonstrated on the submitted preliminary partition map. Therefore, this code section is satisfied. STAFF' REPORT MLP 93 -0001 BARTLE T, AC FIC SPIRE Page 3 4.4 Section 8.08.040 �'C contains solar access standards for new residential development. lopmen-Y` A lot meets the basic solar access lot standard if it has a north -south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east -west axis A preliminary partition or subdivision plat r,omplies with the basic requirement if 80% or more of the n e w l y created lots meet or exceed this standard. Section 19 „88.040 provides an exemption .or lots which cannot meet the minimum solar requirement's due to pre- existing road patterns. Neither of these two lots meet the base requirement because of the alignment of SW 78th Avenue which is oriented in a north -south alignment. Therefore, the solar access requirements have been satisfied. Section 18.162.050 states that each lot created through the partition process shall front a, public right -of -way by at ,least 15 feet or have a legally recorded minimum 15 foot wide access easement. The lots will preliminary partition plat demonstrates that, exceed this 15 foot lot frontage requirement. Sections 14164.03 (Streets), 38.164.090 (Sanitary Sewer) and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: The site is located on SW 78th Avenue. Southwest 78t11 Avenue is classified as a 1o1 7a1 street and has the following minimum a � G waynd�l 25 feet of right-of-way, groin centerline of the right-of- way) sidewalks. No additional i- mprovents are required, REPORT MLP 93. -0001 BARTLETT/ PACIFIC EMPIRE Page 4 3. Storm Sewer; The site slopes towards the northwest. The existing public storm sewer system along SW 78th Avenue is a mixture of open ditches and culverts. The slope of the lot is such thr t the storm water will not be able to be directed to the public storm sewer system. Therefore, the applicant would be required to meet the requirements of the Vuilding Department for on -site disposal of the storm water. The Unified Sewerage Agency has established, and the City has agreed to enforce (Resolution and Order No. 91-47) , Surface Water Management Regulations requiring the construction of on- site water quality facilities or the payment of fees in-lieu qu g quality of their construction. Requiring surface water facilities on small sites would result in numerous facilities that would become a maintenance burden to the City. Furthermore, the applicant has not proposed any such facilities and there are no natural depressions or other areas of this site that are particularly suitable for tha placement of a water quality facility. Regional facilities, funded b y fees in -lieu of construction of these facilities, would provide the required treatment with improved rel iab t and required less maintenance. Therefore, the applicant shoul d r®cuu to pay the fee in -lieu of the construction of an on -site water quality facility. SECTION IV - FINDINGS AND CCNCLUSIQI S - VARICE: Code Section 18 .16 4 . 0 6 0 (A ), ..(k). states that the depth of all lots shall not exceed 2.5 times the average depth A, variance is recuested':P.or this proposal because the lot depth to width ratio of these two lots exceeds the maximum allowed by the Code by approximately 0.028 percent. For these lots, this amounts to approximately 1. 54 feet of excess width per lot'. Code Section 18.134.050 contains the criteria for allowance of a variance to a Code standard.
