SECTION I :C FINDINGS OF FACT: 1. Vicinity Informa.tion The subject site is located on the east side of SW 95th Avenue, approximately 600 feet north of the North Dakota Street /95th .Avenue intersection. Access to the site is provided from SW 95th Avenue, The adjacent properties are zoned R -12 (Residential, 12 units per acre) 2 Site Information and Proposal. D�escra ption Th.:s site is approximately 17,346 square feet in sire. An existing single family residence now occupies this site. The parcel slopes slightly to the south, and there are no major trees on the property. The applicant requests minor land partition approval to divide' this 17, 346 square foot parcel into two parcels of approximately 8 , 795 I and 7,371 square feet. 3 . Agency and NPO omments The City of Tigard Building Division has reviewed this proposal and has offered the following comments: o If no public storm drain system is provided, each new building will be required to provide an on -site private disposal system as approved by the plumbing inspector. A plan shall be submitted to the Building Division showing the location of all made], ground private utilities for the existing building. if they cross over new property they shall be provided with easements. Page The applicant should be aware of the provisions- of Community Development Code Chapter 18.9 8 0 3 0 for building heights and flag lots. Portland General Electric, Metro Area Communications, School i DistDistrict #233, General Telephone, and Tualatin Valley Water District have reviewed this proposal and have no objection to it. No ather comments have been received. SECTION III - FINDINGS AND CONCLUSIONS - Minor Land Partition Section 1188..162 .040 contains the following general appr°c ' *al criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2 The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; . All propos?-d lots conform to the size and dimensional . requirement; of this title; and 5, All proposed 1mn rovements meet City and applicable agency standards (Ord., 89-06; Ord. 83-52). The subject site conforms with the City's Comprehensive Plan in that no use is currently proposed for the newly created lot therefore, this site is presently not in conflict with the Medium Density Residential Comprehensive Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis rresented within this administrative decision and by this.., application and review pr .ass . Page 4 20 feet from the front of the garage to the property line from which accent :is obtained. Section 18.88.0401 . Due to tho configuration of the subject site, existing street orientation of parcel #1 precludes the possibility for orienting the frontage of this lo. within 30 degrees of an east -west axis Code Section 18.88.040(E), however, allows the approval authority to exempt new lots from the solar access standard in certain cases, including situations in which existing road patterns are continued through the site or terminate on -site which prevents given streets or lots in the development from being oriented for solar access. Therefore, parcel #1 is exempted from the solar access standards. The north -south lot dimension of parcel #2 with frontage on SW Longstaff Street will be greater than the required 90 foot minimum. Therefore this solar access code base requirement has been satisfied. Section 18.162.050 states that each lot created through the partition 'process shall front a public right -of -way by at least 15 feet or have a legally recorded minitauri 15 foot wide access easement. The preliminary partition plat demonstrates that both lots will meet or exceed this requirement. If dedication is required on SW Longstaff street, parcel 02 will have direct access and will not need the proposed flag pole extension. Sections 18 (.164.030 (Streets) , 18.164.090 (Sanitary Sewer) , and 18.164400 (Storm Drains) have been addressed and are satisfied as specified below: 1. Streets: The sitc is located on the east side of SW 95th Avenue, approximately 600 feet north of the North Dakota Street/:l5th Avenue intersection. SW 95th Avenue is classified as a minor collector. The rainimen standards for a manor collector are ( all distances are measured from the centerline of the right -of -way) o 30 feet of right-of- way, 20 feet of pavement, curb and sidewalk. The existing street frontage has the following (all distances are measured from the: centerline of the right -of -way) 20 feet of right-of- way, approximately 12 feet of pavement, open drainage ditch, w� tth no curb or sidewalk Section 18.164.030 (A) (1) (c) (v) of the Community Development Code allows the Director to accept a future improvement guarantee in lieu of street improvements if the improvement is associated with an approved laird partition on property zoned residential i � proposed � � _ w p ` � create any a.dential and the land partition does► not eras new streets. Page Therefore, the applicant should be required to dedicate 10 feet of additional right-of-way and sign a non- remonstrance agreelhant for the improvements of SW 95th _Avenue. According to the Washington County Assessor's Map and the appl. that runs along the applicant, there was or is a street th southern property line of this parcel. Specifically, the assessors zap shows SW Langstaff Street, beginning at SW 95th Avenue and heading east. Th ► street is shown in dashed lines which typically means th at it has been vacated. The applicant's app licatton shores SW Langstaff Street as a private street. It er iysts as a gravel road and serves several parcels to the east of SW 95th Avenue. The City has no records of SW Langstaff Street either being a public street, a public street that was vacated,, or a private street. The Washington County Survey and Cartography Departments have no record of SW Longs Laf f Street being dedicated to the public or as an easement. Therefore, they assumed that it was a private street From the above information, the current status of SW Langstaff Street is undetermined. The City has thefollowing concerns: A. B. There are existing parcels to the east that need access to SW 95th Avenue; If this parcel is divided and adjoining parcels improved they would be better accessed if a street, being private or public, were in the approximate location of SW Langstaff Street; and C. There is an existing public sanitary sewer line that serves the properties to the east. It does not r.. - City g e, appear the C�.t has legal access to the line.. Therefore, the applicant should be required to provide one of the following: A. Evidence whether SW Langstaff Street is a private or public street; or B. Dedication of right-of-way to the public for SW Langstaff Street; if the applicant is required to dedicate the right -of -way, they should also provide a non - remonstrance agreement for the improvements for SW Langstaff Street. STAFF 'R PO1 T! P Sanitary Sewer There is an e, isting eight inch public sanitary sewer line located in SW 95th Avenue. In addition, there is an eight inch public sanitary sewer line located Along the southern border of the property. Eithor line has they capabi.lit w* and capacity to serve the new lot Storm Sewer: There is an open drainage ditch along the west property line within the right -of -way of SW 95th Avenue. After a field visit to the site it appears the drainage ditch would be able to serve the newly created lot. The applicant should verify the existing drainage system will be .able to serve the new lot; if it is determined that it would NOT serve the lot then the storm water from the new lot will have to meet the requirements of the Building Department The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No 91 -47) Surface Water Management Regulations requiring the construction of on- site water quality facilities or fees in -lieu of their construction. Requiring surface water quality~ facilities on small sitea, would result in numerous facilities that would become a maintenance burden to the City. Furthermore, the applicant has not proposed and such facilities and there are no natural depressions or other areas of this site that are particularly suitable for water quality facilities. Regional facilities, funded by fees in- lieu of construction of these facilities/ would provide the required treatment with i nproved reliability and less maintenance. Therefore, the applicant should be required to pay the fees in- lieu of constructing an on -Rite facility. Storm Sewer: There is an open drainage ditch along the vest property line within the right -of -way of S.W. 95th Avenue.
