This site is ac.aall comprised d of three tax lots. It is 58 s ere how two of the three tax lots were created as these lots are substandard in size and unbuildable (tax lot 2800, 438.6 are feet, tax ,lot 2804, 3,484.8 square feet) . Portland General Electric, Tigard Water District, School District 23J, and City of Tigard Field Operations have reviewed the proposal and have no ob jectiorus to it No other comments have been received. ANAL7szf AND CONCLUSIO',a The area of tax lots 2800 and 2804 are substandard in size and are unbuildable. In effect, the area covered by these three tax bats is currently considered to be one buildable lot. Therefore, tax lots 2800 and 2804 should be consolidated to become part of tax lot 2806 at the sae time that the requested partition is recorded. This action will effectively extinguish two substandard and unbuildable lots while providing for more efficient partitioning of the buildable parcel and the provision of safe and adequate access and egress for the newly created parcels. Section ' l8 4 J,u2.040 or Tigard Community contains standards whereby the Director or ai deei g ee may approve, approve with conditions, or deny a partition request. These criteria are 1 The proposal conforms with the City's Comprehensive Plan; 2. The proposed partition complies with all statutory and ordinance requirements and regulations 3. Adequate public facilities are available to serve the proposal; All proposed lot dimensional requiremmeents of this title; and e conform to the size and dimens 5. All proposed i, ►erovements meet City and applicable agency standards. The proposal meets the minor land partition approval criteria of Section 18 i162.040 (Partition Approval Criteria). This proposal also conforms we.th the City's Comprehensive Plain and complies with all statutory and ordinance requirezr:eats and regulatione. Adequate public facilities are available to 'serve tree two parcels. All proposed lots conform to the size and dimensional requirements of this title. There are no improvements currently proposed for this site Solar Access: Code Section 18.88 states that all newly created lots within the City of Tigard shall promote the he use of renewable energy sources by providing for improved access to sunlight for reeidentiel dwellings. CLAYTON OWNER/APPLICANT PAGE 4 t 9ainimum. Since both of these requirements have not been satisfied, none of these three lots meet the base requirement of this section. The orientation of these lots is subject to the existing alignment of SW O'Mara Street from which these ;parcels must gain access, This alignment will not permit the front property lines to be oriented within 30 degrees of a true east -west axis. As a result, these three proposed parcels shall be adjusted out from this requirement as per Section 18.88.040(E). Therefore this code requirement has been satisfied. Building Setback: Code Section 18.64.50 A.3 states that for a single family dwelling the front yard setback shall be minimum of 15 feet; the .t5i.de yard setback shall be a minimum of five feet; the rear yard setback shall be a minimum of 15 feet; and the distance between the property line and the front of the garage shall be a minimum of 20 feet. The existing development on the northern parcel conforms with this code requirement. All future development on these two parcels shall comply with the current setback stanuarde Iccecs, Egress and Circulation: Code Section 18.162.050 (C) states that each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. Additionally, Code Section 18.108.030 (A) (Joint Access) states that owners of two or more structures or parcels may agree to utilize jointly the same access and egress when the combined access and egress of both structures or parcels satisfies the following: Satisfactory legal evidence shall be presented to the City Attorney in the form of easements ... to establish the joint uce; and Copies of the ... easements .. are placed_ :en permanent file with the City Recorder. ;ha easement should be recorded along the driveway of lot number two for the purpose of providing access and egress to the 17,824 ec edlare foot lot to the northwest. Should it be requested that taa'C lot 2005, 74hich is located to the west of the subject site, use this salve driveway t cess as its, required paved accessway, then this also should be recoruk. d by an easement.
