ZONE C -P (Commercial Professional) . LOCATION: Southeast corner of SW Greesburg Road and SW Locust St: et (WCTM 181 35A8, Tax Lot 100). DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APP?OVE) the above request subject to certain conditions. The findings and conclusions on which the decision was based are not =;d below: . a; ickcround The subject parcel and ad j acent parcels were annexed to the City of Tigard in late April, 1957. In Malt,' 1987,. the Tigard City Council approved the rezoning of t'e annexed area from Washington County's 0-C (Office Commercial) zoning designation to the. City's C -P (Commercial Professional) zone. The subject parcel was already developed. The City has reviewed numerous other land ul:h° and development applications for the Liv, „oln Ce a'v air ?evclop; ►ent, but none that have dealt directly with this property. 2. Vicinity I+xf orrat ion Properties to the north, east and south of the subject parcel ar also zoned C -a. Property to the north across has recently received Site Development Review approval for constructions of a bank building. Properties to the west across Greenburg Road are zoned C-G and are developed with the Washington Square Two shopping center. 3. Site Information and Proposal Description Teas lot 1000 is one of seven parcels that make up the Lincoln Center development. The Lincoln Center property ,£$ presently developed With six office bexildings and two multi-Level parking structures. However,, the applicant ha; submitted 'a separate Site Develop lent Rev;*.ew application, that would result in partial removal of the Lincoln savings building where it crosses the property line; would, re &ult in an El-story office building being constructed on parcel 1; and a 3- level parking structure on Parcel 2, That application is being considered separately from the minor land partition application. In order to maintain existing access and parking arrangements for development on any of the three parcels, _ the applicant has submitted a reciprocal parking and access e sement agr w oment o • Agency and NPO Comments The City of Tigard Building Division has reviewed the proposal and provides the following comm ents s The creation of property lines adjacent to buildings without providing firewalls or opening protection is not generally' permissible, by a strict reading of the building code. However, in cases where properties are divided into Separate p realm for the purpose of lease agreements, tax purposes, etc., this has been commonly permitted in this City as well as othex jurisdictions. In order t protect the City from future problems, however, the Building Division recommends that the following be required: • slP ro y shall gdeclaration stating that it is by their request that property lines be allowed to pass through °ough or adjacent to buildings without being required to µ for wall: and comp hse applicable building codes fo opening ,protection, and that should the property for any reason no longer be under control og the present owners, the e.wner sshall bear the entire cost of bringing the building or y pp odes and structures into ccnformance with a li.cab]o c regulations. • The owners: should indemnig y the City against all aulte that may arise from the above declaration. ° The format oZ, the above should ba reviewed by the City Attorney ° 0 office the legal 'document shall be recorded at the same time as the partition plat and these documents shall be recorded ae pant of the property deeds. aIRBC R S DECISION MLP 90-OO2 lI - LN HIGH 3. The Unified Sewerage Agency has established, and the City has agreed to enforce (Resolution No. 90 -43), surface water management regulations requiring the construction of on -site water quality facilities or fees in lieu of their conatructir . Requiring surface water quality facilities or small sites would result in numerous facilities that would become a maintenance buy °den to the ? 3 try Furthermore, the applicant has not proposed any such faci13..: i suitable for water alit .ee and there are no natural depressions or other of this site that particularly quality facilities. Regional facilities, funded by fees in lieu of construction of thee facilities, would provide the required treatment with improved reliability and less maintenance. Washington County has established, and the Cit y agreed a reel to enforrle (Resolution No 90 -65), Traffic Xupact Fees.
