ANALYSIS AND C0NCLUSIo Minor Land Partition The proposed minor land partition,' as shown on Map 2, complies with the Minor Land Partition Approval criteria specified by Section. 18.162.030 and 18.162.050 of the Community Development '`Code, with the exception of consistency with the minimum lot size of the R-4.5 zoning district. The variance is considered separately below. The minor land partition approval criteria are: 18.162 .030 Partition . The proposed drainage to Summer Creek and to the, catch basins in SW 113th Place si.ould Provide adequate storm drainage for the development. Public service e and utility agencies haves r viewed the partition, plan and have not commented that the proposal would conflict with their development standards. The preliminary plat notes that aal public works improvements will be constructed to the City of Tiga:d standards and specifications. All three lots to be created through tt.e p rtitj ot1 p 'o as will have gr=ater than 15 feet of frontage on a private right -cf-way and will be provided with access to a public right -of -way through the co a,nly held and maintained private drive. A fire hydrant is located within an appropriate distance for all proposeal lots. A blanket easement for ingress, egress. drainage, water supply and public and privet4� utilities is proposed to be recorded for the private drive area. No flag lots are bei.rz created; therefore, there is no requirement for screening. Setbacks will be reviewed upon the submittal of development plans for each of the lots. The proposed private drive complies with the standards set forth in chapter 18.108. That chapter allows private roadways to serve no more than six dwelling unite as long as the private drive contains a minimum of 24 feet of pavement and a sidewalk on one side of the private drive. The proposed private drive would be 34 feat wide where it connects' to SW 113th Place, narrowing to 2) feet in width in the turnaround areas. A sidewal k would be provided along the southern edges of the private drive. There are special circuin tanoee that exist which are peculiar to the lot size or shape, topography, or her circumstances . for which the applicant has not control and which are not applicable to other properties in the same zoning district. The use proeoeed will be the same taa permitted under. this Code and City standards will be maintained to the greatest extent that is reasonably poosi ' e , while permitting some economic use of the land. The applicant states that the variance is rem = etted in order to allow the property to be devided into a reasonable number of lots, cons ,dering the large amount of the original site area that will be required to be dedicated for public purposes. Forty four percent of the original site would be dedicated for public purposes. The applicant purchased the property after consulting topographic maps which showed that there was more area outside of the floodplain than the recent survey indicates. The applicant relied upon the topographic maps in determining that there would be an opportunity for four lots to be created from the parent pate,als. Staff agrees that in light of this unusual situation, cequiri ng all ,lots to be created to be fully consistent wash the "1, 500 square foot minimum lot size of the R.-4.5 zone, thereby limiting development of tax. Staff t; pically would not aaecommend rezoning a site this small with a zone different than surrounding properties, even . if the requested zone is an overlay zone,,, In addition, the proposed development would not contain other typical elements s of a planned development ouch as reduced setbacks, common privately - owned open space, or an unusual development pattern. The proposed development would appear to be a very typical small residential subdivision. In order for the proposal to be reviewed as a planned development, substantial fees and time would be necessary to process a one change and planned development application for sr!ch a small project. 11\ di.tionaliy, the Commun ey. Development Code apparently has ` presumed that variances to lot size standards are possible. Code Section 10.164.060. a.1 c states that..." unless a variance has been granted, lot sizes shall not be less than the sized required by this I;Citle. " Therefore staff does not find it necessary, or practical, for this proposal to be reviewed as a zone change and planned development in order to obtain the housing opportunities needed. W do appreciate the NPO's comments and concern with regard to the necessary process but we feel that the NPO may have been unaware of some of the factors that entered into the staff's recommendation to the applicant r .tgarding the proper application process. The veriance request would not change the uses allowed on t. hle parcels. The applicant intends to build single-family residences on the lots - the primary permitted use in the R -4.5 zone. The amount of variance requested is minimal. The average size of the proposed lots would be 97 percent of the 7,500 square foot minimum lot size of the zone. At 7,068 square feet, parcel 1, the smallest of the proposed lots, would be 94 percent of the minimum lot size. No adverse effects upon adjacent parcels are foreseeable. Because of the amount o; open apace adjacent to the proposed lute, the slightly smaller size of these lots will not be noticeable compared to other lots in the area.
