The remainder of the property is vacant. The applicants intend to divide the subject property three parcels to be used as sites for single -family dwellings. ACcess to 132nd Avenue for the two southern parcels is provided by an access easement created by the previous minor land partition. The third lot will have a driveway onto $W 132nd Avenue. NOT/CE OP i BCISIO TOW Htp 90-0810 IM071 I Agency and NFO Comments The Engineering Diviaion has the following comments: The applicant proposes to divide a 0.7 acre parcel on SW 132 Avenue into three residential parcels. a. The parent parcel was adjusted by a previous application (1 U 89 -16/M 09 -22) that also provided the utility easements, acceseway„ and right -of -way dedication required for this application. la. The s Lto abuts 5W 132nd Avenue! a local street. The r.µquired right-of-way width of 25 feet from centerline was provided by the previous application. Each of the three parcels abut to SW 132nd Avenue. However, the two southern parcels also abut to a 30 foot wide acceesway created by the prior application. Sanitary sewer service is available from an existing line in SW 132nd Avenue. The Tigard Water District noted that they will require a: six -inch water line and fire hydrant at SW 132nd Avenue and a four -inch water line must continue east along SW Hampton Court to tax lot The Building Divis' ion commented that if any buildings exist on the parcel the utilities need to be located and provided with easemrants if they cross property line°. They also point out that a private storm line needs to be provided and have submitted a copy of the . plan showing where the storm line should be 1ooated Portland Genoral Electric, Fire District #1, School District 23J, and Washington County have reviewed the proposal and have to objections to it. no other comments have been received ANALYSIS ANT CONCLUSION The p► ro sal meets the, minor land partition criteria of Section p 18.152.640 (Partition Approval Criteria). . Hampton MLP Application (MLP 90-10) Tax Lot 1200 Map 2 S 1 4AC Dear Mr. Laden: On May 3, 1990 1 attended a. pre - application meeting with Ms. Goodwin regarding the above aref erenced side Minor Partition. ' Viola Tax Lot 12 (10 has 272 feet frontage on the East.. sade of S.W. 132nd, beginning 85 feet South of S.W. Walnut Road. Ms. Goodwin reintro- duced the possibility that I would be required to make a street improvement to S.W. 132nd. That possibility contradicts statements " g .` ' nc r partitioning of TL. 1500 (MLP 89 -16) . made to me during the mx - q _ 1 At that time Ms. Goodwin stated and rou as saying , tha _ the g . U(tPd a many requirements I had to meet were " ,nh ieu of street improvements" Early last .peek I asked Ms. Goodwin to arrange a meeting with her you, Greg Berry and I. She reported back , that p r or to a meetin g you wanted to review background on my property, including prior land use actions by Washington County. I have that inorma- tion and she said it would help if I supplied it to you. My father bought this property in 1937, origonally six acres.; He and my older brothers built a house on it in 1938. I acquired TL. 1500 from my father in 1966. My sister owned and had a sale for 1200. Washington County would not issue a septic tank the ermit. I L+uht it her 1976. I acquired .L 1300 from th' estate of and g n brother, Clifford f Ord L . Hampton in y1975, Thereafter the my . Att'. p permit that allowed the transfer of all but - `she Northerly 85 feet TL. 1300 to 'TL, 1200. After further discussion with Mr, Cone, I also transferred a portion of the enlarged TL. 1200 into. TL. 1, 500'. This would allow three lots from TL. 1500 to be accessed from S.W. Walnut over my deeded access lane. It would also allow . three lots from TL 1200 with frontage or 132nd. Att. -3- is a copy of the permit for the second lot line- adj ustment,h Att. -4- is a map section showing the three tax lots after the adjustments. I recorded the appropriate deeds. Because of the county's' refusal to partition and the slow pace of the incorporation, 1988 was lost for further development. Last year TL. 1500 was 1500 into three lots under the MLP 89 -16 pro- c,zeding. At the pre --a lication mer ti access Jerry Offer strongly pp g recommend that i abandon my S.W. cess and bring in a Street off 132nd. I finally agreed to do so, a a mistake on mY part. I have harrower lots on 132nd. and will have higher standard street to build. The mo'~4 isolated interior lots would have been desirable to a segment of the market. s early impression think Mr. Offer's r,, ession was that I was evading the subdivision law. I was " up fro w :.th him from the beginning. I simply could not afford to go that route, then or now. We sold my wife's car to help pay the $4,000. for theIsewer,1I3tubs in 132nd. and in Walnut. I had checked with a Tigard Engineer, who quoted a fee of $14,000 for subdividing my lots. Even if subdividing was desirable it wasn't economiJaliy feasible. It has been a struggle pay high costs incurred to date. to There were no bad amotives. the substantial, co The `` summary, 89 -16 was Processed I was required to In summer when MLP P . _ g TL. a with was dedicate Five Feet along 132n when Ti, 1500 did not abut I also required to dedicate 13 feet along Walnut, togeather erawiregard- ing all access thereto. Leslie B Hampton MLP Application (MLP 90 -10) Tax Lot. 1200 Map 2::S 1 SAC Dear Mr. Liden: On May 3, 1990 I attended a pra- appl..cati an meeting with Ms. Viola Goodwin regarding the above referenced Minor Partition. Tax Lot 1200 has 272 feet frontage oil the East s S.W. 132nd, beginning 85 feet South of S.W. Walnut Road. Ms. Goodwin reintro- aced the pos 5ibility that I would be requi red to make a street ' improvement to , S.W. 1 32nd. That possibilit y cont, M ctdict 3 statements made to me during this minor partitioning of TL. 150 (ML? 89-16) . time Ms. a and quoted you as saying that the ,t that oocwinst stated rr ' ' r'4e►errts' . many requirements 3 had ..o meet were inlieu of street im Early last week , asked Ms. Goodwin back, that ,prior rior to a ` y . My father bought this property in 1937, origon ally six acres. He and my older brothers built a house on it in 1938. T acquired my , a sale TL. 1500 from m father in 1966. I recorded the aPPX'opriate deeds - Because y p and the slow pace aunt 's refusal to partition an of the in' orporation, 1988 was lost for further development. Last year TL. 1500 was divided into three lots under the MLP 89 -16 Pro- ceeding- , t;t the re -a' lication meeting Mr. Jerry Offer strongly ceedin p pp #° recommend that i abandon my. S.J. The more isolated intorior lots would have been desirable to a segment, of the market. 1 was evading I think. Mr. Offer's ,r .. from rat the subdivision 1,'w. I had checked w with a igardt Engineer, who noted a fee of $14,000 for subdividing my lots. Even if subdividing was desirable it wasn't economically feasible. It has been a struggle to pay the high taxes and the substantial costs incurred to date. There were no bad motives In sa mmar when M-: • 89 -16 was process I was required to Y, p dedicate Five Peet along 132nd. when T °. 1500 did not abut.
