Also requested is a variance to allow the driveway access width to be 20 feet with a 16 foot wide paved portion where a 25 foot access width with a 20 foot wide paved portion is normally required. The findings and conclusions on which the decision is based are noted below. Backgt fund; The subject parcel was annexed to the City in September, 1987 along with a large number of other properties in the northeast Metzger area In June, 1989 the Plann -gig Commission approved a request to c3ubdivide a 3.41 acre parcel into 6 lots (S 89 -06) Also approved avemc�ni,, - was a variance to allow a 28 foot wide pavement width for that portion of SW Locust Street that passes through the subdivision. In August, 1989 an application to incre gu pp ale the number of lots from 6 to 7 in the above described ssn xdivt' ion was approved by the Planning'Commiseion (589 -06) 2. Vicinity Information Properties Immediately ately abutting in all directions are also zoned R- 4.5. The majority of these, with the exception of land to the northeast leave been developed as single - family residences on generally small parc'eld 3. Site Information and Proposal Description The current application applies only to tot 7 of the Awn Downs subdivision located on the north side of Locust Street. The site is currently being developed for the previously approved subdivision discussed above. Some grading and filling and uree removal have already taken place. The proposed driveway has .ready been covered with gravel. A stand of tall evergreen trees is located on the rear or north portion of the parcel. The applicant proposes to partition this large 43,124 square foot, northern lot of the previously approved Aum Downs subdivision in order to proviaio sites for the construction of two residences. The two lots created by this partition are proposed to be approximately 13,018 and 26,161 square feet in size. The remaining square footage (approximately 3,945 square feet) will be used as a driveway to serv* the two parcels being created. The applicant seeks a variance to allow the driveway access width to be 20 feet qu where 25 feet in normally required and to allow the paved widt h of the driveway to be reduced from 20 to 16 feet. 4. Agency and NPO Comments The Engineering Division has the following comments: a. The applicant has submitted a site plan showing the proposed driveway and utilities. b. Access for tha lots is provided by a common driveway connected to SW Locust Street. The paved width of the driveway must be y increased to 20 feet instead of the 16 feet shown on the site plan to meet the requirements of section 18.108.070 of the Code. c. SW Locust Street is a fully unproved newly constructed local street. The proposed driveway will require a concrete apron at its connection to the street. d. Sanitary sewer service is available on the ;site. Each ',houaa must connect separately to the line. e. Storm drainage is provided by a awale tr the east of the site. The Fire Marshall has reviewed the proposal and approved the variance requested to allow a reduction in the with of the access feet , of subject to a lf®idaeot wide hard surfaced road with 2 fv shoulder on each , as indicated in the site plan. NPO the driveway access, noting that it does not satisfy the hCode requirements with respect to the width and recommended that the access be brought into conformance. The Building Division, Metzger Water District, P.G41 . , and Tigard Schoo]. District 23a have reviewed the proposal and have nc objections to it. No other comments have been received. NOTICE OF DEC /SION - HLP 90-0002/VAR 90 -0006 - BOSNAR PAGE 2 B. ANALYSIS AND CONCLUSION Minor Land Partition The proposal satisfies the minor land partition approval criteria of Section 18.162.040 of the Tigard Community Development Code except for the width of the access driveway, discussed in the next paragraph. Otherwise, the proposal conforms with the City's Comprehensive Plan and complies with all statutory and ordinance requirements and regulations. Adequate public facilities are available to serve the proposal, the proposed lots exceed the 7,500 square foot minimum lot size and other dimensional requirements of this title. All proposed improvements, other than the driveway, meet City and applicable agency standards. Varelnce to the Access Width A request for a variance must satisfy the criteria of Code Section 18.134.050 (variance Criteria) to be approved by the Director. The applicant's request for a variance to the access width requirement of Code Section 18.108.070 (Minimum Access Width Requirements - Residential Uses) satisfies these criteria in that the proposed veria ece will not be materially detrimental to the purposes of this title, be in conflict with the policies of the comprehensive plan or other applicable policies and standards, and to other properties in the same zoning district or vicinity. There are circumstances which exist over which the applicant has no control. These are, as indicated in the,juatification for the variance provided by the applicant, two large trees and an electrical transformer located near the east property line that would have to be ,removed to accommodate a standard width driveway. Staff generally encourages applicants to retain as many tree as possible in the development process, agrees wi.h the applicant that these tre -a should be saved, and therefore, finds the applicant's justification acceptable. (Staff also reminds the applicant that before any trees are removed it will be necessary to obtain a tree removal permit.) The request for a variance does not change the use that will be made of the subject parcel, physical and natural systems will be less adversely affected because the smaller driveway will require leee fill, and the variance requested is the minimum required to alleviate the circumstances. The applicant has also provided evidence thOtt the Fire Marshall, has approved the reduced access width, thus addressing a major concern (providing adequate access for emergency vehicles) associated with the reduction of the width of an accessway. Vacation of the Sewer ,Basement The applicant has requesited the vacation of a sewer easement which does not coincide with the actual location of the storm sewer located near the east property line. The vacation process will require a separate apPtiicmtion.
