ZONE: R -4.5 (Residential,, 4 S units /acre) . LOCATION: 6621 SW Walnut Terrace (WCTM 25DA tax lot 2600). The findings and conclusions cn which the decision is based are noted below. A. FINING OF FACT 1. Sa,ckground The sub; vice parcel was anx?exod to the City in September, 1987 (Rounder', Commission 'file : 2413). No other applications for this parcel have been reviewed by the Planning Division. 2. Vicinity Information The subject site is located in the northwest Metzger area and is surrounded by single family residences, also designated R -4.5. 3. Site Information. and Proposal DJscriptio 1 r street. Three deciduous and two pine trees separate the house from a small shed located near the middle of the property. The back portion of the lot is partially wooded and also contains some fruit trees. The applicants propose to partition the 17,579 square foot parcel Be into two parcels containing 7,680 and 7,568 square feet and an CO access easemert to serve the northern parcel. The proposed accesnway is 15 feet wide. "°J 4» Agency and NPO Comments OD CD The Engineering Division has the *Zollowing comments: Tire applicant proposes to divide a 0.4 acre tract on Std Walnut Terrace into two residential parcels. NOTICE IF DECISION Et STROM '. MLP 90 -0001 PAGE 1 1. The applicant has submitted a site map showing the existing house and proposed driveway. 2. Access for the lots is provided by a common driveway connecting to S.W. Walnut Terrace, a local street with an existing right-of-way of 50 feet. The driveway width shown on the site plan of 15 feat must be increased to 25 feet to meet the requirements of Section 18.108.070 of the Tigard Municipal Code. 3. S.W. Walnut Terrace Street is paved but is not improved with curbs or sidewalk. Subsection 18.164.030.A of the Code permits the Director to accept a future improvement guarantee in lieu of strt,et improvements on property zoned residential if the proposed land partition does not create any new streets. Since the area surrounding the it is nearly fully developed with streets without cuees and sideaalks, a future, improvement guarantee in lieu of street improvements is acceptable. 4. Sanitary sewer service is available from an existing sewer in S.W. Walnut Terrace. Each house must connect separately to the line. 5. Storm drainage may be provided by an existing culvert along S.W. Walnut Terrace or by on site disposal. The Maild.5.ng 1)ivision notes thee the utilities for the ezisting building must be located. If any utility lines cross lot lines easements will tome to be provided. The Fire District points out that if the new building is more then 500 feet from an existing hydrant, a hydrant must be provided. NPO 08 expressed an opposition to flag lots and also recommended that the proposed accessway meet the width requirement as stated in the Community Development Code or that a variance to the width be requested by the applicants. Washington County, U. S. West, Oeneral Telephone, Tigard School District, and Portland Oeneral Electric have reviewed the proposal and have no objections to it. No other comments have been received. B. ANALYSIS AND CONCLUSION Except for the width of the access which is discussed below the proposal meets the minor land partition criteria of section 18.1620040. It conforms with the City's Comprehensive Plan, complies with statutory and ordinance requirements and regulations and has adequate public NOTICE OF DECISION - ELSTROR e HLP 90-0001 PAGE 2 facilities availabLe to serve it The lots conform to size and dimensional requirements and meet City ' and applicable agency standards. Requirements for access width and buffering and screening are discussed below Access W, ie th As NPO #8 pointed out the access width as shown on the site plan does not e , particularly if it is to serve two dwellings. Code applicants . have informed staff that they intend to '9 provide access to the existine leouse by constructing a paved driveway and garage on the east side of the existing house and that the proposed easement would then serve only the dwelling to be built on the proposed northern lot. Under this arrangement the proposed access easement would be in compliance with the Code requirement of a 15 foot wide access, as lon g as a 1U foot width is If a garage and driveway is not built to the east of the existing house, then the access must be increased in width to 25 feet with a 20 foot wide paved area in order to serve two residences. Therefore, prior to construction of a new house on the proposed northern parcel, the PP revised site plan showing either d 1) a 25 foot applicants must. submit a rervis p showing wide easement or 2) a 15 foot wide e sent and details of the drivemsy and garage to be constricted to serve the existing house. If option #2 is selected there must be at least a 30 foot separation between the access easement and the new eastern driveway.
