Location: South , „ side • of Hall Blvd. between Greenburg Road and Scholls Ferry Road ( 'CTM 1S1, 26C, TL 1100) . DECISION; Notice is hereby given that the 'Planning Director for. the City of Tigard has APPROVED the above described application subject to certain 1 . ' e ' , conditions. The findings and conclusions on which the Director based his decision are as noted below. r.; A. FINDING OF FACT t ?. 1. Background . , ' The subject parcel, tax lot 1100, and adjacent tax lot 1200 were the subject of a Washington County Hearings Officer approval for° 1) variances for access spacing, sign height, and sign area; 2) a lot _` line adjustment; and 3) development review fofor a retail center corY`e fining approximately 206,000 square feet (Washington County File 86- 14,4—D/V/LLA). The lot line adjustment created two parcels, tax lots 1100 and 1200, out of three parcels. Vhe parcels were annexed to ' '. j . the City of Tigard on April 16, 1987. eke other requests have been x. reviewed by the Tigard Planning Division with respect to the subject property. 2. Vicinity Information 4 1..y t a�µ w Properties to the south, west, and east are zoned CO (General Commercial) and are developed with the Washington Square Mall, Monarch 1 Suites Hotel, and Greenbueg Corners Shopping Center. The parcels to the north across Hall Boulevard are in Washington County and are designated Office. Commercial. Present development includes single ' ` ' ' , family residences and the Progress Downs Municipal Golf Course. Hall R Boulevard is functionally classified as an arterial. , 3. Site Information and Proposal Description The 4.5 acre parcel is currently undergoing development of a 51,844 ` square foot retail store on the eastern portion of the parcel and G 25,439 square feet of shops on the western portion. Agency and Npa Comments The Oregon State Highway Division commented that access perrits had beer, obtained for the site and that they had no problem with the proposed partition. The Building Division and Washington County Fire District #1 commented that they had previously requested of the applicants that a condition be added to the Operation and Easement Agreement for the entire }: development but that their request had not been 'granted. They again request that the Operation. and Easement Agreement be amended to require as follows: Prior to the sale of any or all of the properties contained in this agreement or portions thereof, or modifications to any ,;• property lines, approval for such changes shall be obtained from both the City of Tigard Building Department and the , ashiegton County Fire District 01 Fire Marshal. The above is intended to assure that fire protection concerns continue to be considered in eight of the development's construction plans having been granted several exceptions to standard building code requirements related to building size and separation. The Engineering Division, PGL, Metzger Water District, and General Telephone reviewed the proposal and offered no comments. B. ANALYSIS AND CONCLUSION 0 ' "a The parcels to be created by this partition meet the minimum lot width requirement of the CG (General Commercial) zoned Because the parcels would not abut residential uses, no building setback requirements would apply to these parcels. Adequate public facilities serve the site for the uses under detalopment. The concern of the Building Division and :Fire District can be satisfied as a condition of approval to be executed prior i 1 : to recordation of the partition, No other Comprehensive Plan or Community Development Code (CDC) requirements apply to the current request.
