The findings and conclusions on which the Director based his , decision are as noted below. 0 A FINDING OF FACT 1 8ackground No previous land use applications have been reviewed by the City, 2, Vicinity Information The property to the north and west is zoned R-25 (Residential 25 units/acre) and the area on the north is in the process of being developed with single family residential subdivision, The land to the south is temporarily zoned C—N (Neighborhood Commercial) , It is intended that this designation will be moved once the location of arterial and collector street intersections in the vicinity are determined. The R-25 zone will replace the C—N zone once it is moved. The R-4,5 (Residential, 445 units/acre) zone lies to the east on the opposite side of 15th Avenue, 3. Site Information and Proposal Description A residence is located in the southeastern portion of the property, The applicant wishes to create a 75 by 150 foot lot to accommodate the house. The larger undeveloped parcel will have 80 feet of frontage on 185th Avenue on the south side of the smaller parcel and 885 feet of frontage on the north 4, Agency and NPO Comments • The Engineering Division has the following comments; a. The condition of 15th Avenue is substandard and street improvements are necessary before any further development can occur, NOTICE or DECXSION MLP 12-85 — PAOE 1 f , 0 b, A condition of approval for the subdivision to the north • to provide a 24 foot wide overlay on 185th Avenue to Scholls Ferry road or participate in a local improvement district (L.I.O.) An access permit will be required from Washington County if • any addition access drives aro contemplated. d. PART I - PUBLIC IMPROVEMENTS APPROVAL PROCESS / A. Public Improvement Review shall be applicable to all new developments and remodeling of existing developments. B. All provisions and regulations of the Municipal Code shall apply unless modified by other sections of said Code (e.g. Planned Development, Chapter 18.80; Variance, Chapter 18.134; Unusual Conditions, Section 15.04.120; Sanitary Sewerage Regulation, Chapter . . , 12.05). (Prior to formal submittal of public improvement construction plans)..,0e Applicant must submit one copy of the proposed public improvement construction plan, said plan having been , ' , - Ill prepared and signed by a Registered Civil Engineer, to the City's engineering office to facilitate preliminary review. Upon conclusion of said review,. City staff will contact the . , Applicant and the Applicant's Engineer to discuss any obvious . , deficiencies and, also, formal submittal requirements applicable thereto. . 2. (Prior to qualifying, to receive an approved public improvement construction plan to facilitate commencement of construction . work and receipt of building permits)...the Applicant must , . submit the designated number of sets of plans, as will have been . Improvement Construction Plan Review process, for formal , . circulation and final review; and simultaneously, must submit the following: . . . . a. One comprehensive itemized Public Improvement Construction Cost Estimate, prepared and signed by a registered civil engineer, b. One metes and bounds legal description, prepared and signed by a Registered Civil Engineer or land surveyor On 8 1/2" X 11" white bond papery for each nedettigary dedication and' easement. , All II,.. - 1 ,.... ... , . , • . , . - . . . . i . � 0 � .4 , Upon receipt of all of the aforementioned, the City will afix ' its routing stamp on one. set of the plans and,, then, either the City or the Applicant shall circulate the plan through the appropriate Agencies for comment and acknowledgment (It is recommended that the Applicant hand--carry said plan, due to a N• savings of time which will be gained thereby). Thereafter, a final plan review will be conducted by City staff. Should revision of the plan be deemed necessary by City staff, to bring . it into conformance with established City standards and specifications, circulation comments or development stipulations,, the Applicant and the Applicant's Engineer shall . then be notified thereof. ` Should the pltn be deemed by City staff to be approvable, the Applicant and. the Applicant's Engineer shall then be notified thereof. Notice of City readiness to issue an approvable plan does not mean that construction can commence not does it mean that building permits can be secured; public improvement construction documentation must first be completed (prior to the actual issuance of the • approved public improvement construction plan). • 3. Public.
