B. APPLICABLE PLANNING CRITERIA AND STAFF ANALYSIS
1. LCDC Statewide Planning Goals and Guidelines:
a. Citizen Involvement - This goal provides for the opportunity of
citizens to be involved in all phases af the planning process.
In the case of this application all ovners of record within 100
feet of the subject property were mailed notice and a public notice
was published in the Tigard Times.
b. Land Use Planning - Al] applicable LCDC goals, NPO # 7 policies and
Tigard Municipal Code sections have been considered in review of

C. Open Spaces, Scenic and Historic areas and Natural Resourcles
The intent of the goal is to insure that lands necessary for open
space or preservation of natural resources are protected. In the
case of this application, a portion of the land on either side of
the creek has been designated as floodplain/greenway The applicant
has agreed to dedicate all land within the 100 year floodplain to
the public for use as open space.
d. Public Facilities and Services - Public Facilities and Services include
sewer, water, storm drainage, police and fire protection, schools
and parks, Sewer is available from an 8" line in S.W, Tigard Street, •
In addition, the Fanno Creek interceptor ruus through the site along
Fanno Creek. Water is available from a line in S.W, Tigard Street.
Storm drainage will be addressed at the time a development proposal
is, submitted for the proper*. Police protection is available from
the City of Tigard Police Devartment. Tualatin Rural Fire Protection
Distrit provides fire protection. The yropetty lies within the
Tigard School Distvict. The pizIperty owner is willing to dedicate a
lands within the 100 year floodplain to the public for use as open space.
2. Applicable NPO # 7 Policies:
POLICY 3. Development will coincide with the provision of public street ,
44, water and sewerage facilities. These facilities shall be (a) capable of
adequately serving all intervening properties as well as the proposed
dowelopment and (b) designed to meet city or county standards.
POLICY 4. Planned unit development will be encouraged on tracts large
enough to accommodate ten or more dwellings. Planned unit development
will permit a degree of flexibility in design that will, nable a higher —
quality of development in acdordance with zoning standweds.

Staff recommends that the Planning Director approved ELP 5-82 with the
following conditions:
1. The applicant shall develop the portion q,lE property west of is
