I. Findings of Fact:
1. The applicants are requesting Dermission in accore..nce with Section
17.24.030 o.e the Tigard Municipal Code, to partition t f_j: a 2.06 acrr.:
parcel from an 11.47 acre total on the north side of Bonita Road a
and northwest of 74th Avenue to provide a parking lot with 11 spaces
Fier dwelling unit (50 times 11) or 75 spaces.
The site and surrounding rea is designated on the NPO #5 Plan as
"Urban Medium Density Re 3idential''` and "Open Space". The applicable �a

requirements for "Urban Medium Density Residential" are the following;

o 7,000 square foot minimum lot size (18.24:030 Tigard Municipal Code) .
c Five foot side yard setback for one story building (18.24.0,40 Tigard
Municipal Code) .
3. The site is bounded by grass and trees on the north, east and west. To
th southeast is a iznuse and to the northwest there are two (2) houses
and a shed. To the northeast are some light industrial businesses.
4. Four-fifths of the proposed parcel is in the 100 year`flood plain.
•
5. Bonita Road is in substandard condition (no curbs or sidewalks) .
6. Bonita Road is designated as a collector street with a right-of-way
width of 65 feet and a pavement width of 36 feet in the NPO #5 Plan.
The current .`right-of-way width is 50 feet.
7. Water is available to the site from a 12 inch line in Bonita Road.
Sanitary sewer service is available from a 10 inch line in the
northeast at .l. southeastern potions of the partitioned parcel.

1. The proposed use of a parking lot does not comply to the intent and
purposes of the NP(i #5 Plan: The proposed parcel is designated as all
"Open ;Space and Greenway" area according to the NPO #5 Plan and it is

Based on the fiAdings of fact as C':atcd s l~>;ve the proposed land
partition is hereby approved with the conditions:
I. That an agreement not to remonstrate against the formation of a local
�• improvement ciistr.ict for street improvements. to Bonita Road (to
collector stet standard) be filed wit1i the City Recorder,
2. That an additional 71 feet of right-of-way be dedicated tU the City on
Bonita Road.
That the proposed parcel be used only as a Gre away as designated in
N'PO 45 Plan because the majority of the created parcel lies within
the 100 year flood plain.
