create some noises and vibrations affecting the Property. Grantee accepts the
Property subject to such noises and vibrations, and hereby covenants to release
Grantor from all liability, cost and expense resulting therefrom. This covenant
shall run with the Property, and shall be binding upon the successors and assigns
of Grantee.
By accepting this Deed, Grantee expressly covenants to construct and maintain,
at its own expense and to Grantor's reasonable satisfaction, a barrier along the
track side of the Property. This covenant is for the benefit of Grantor's
adjoining land, and shall run with and be binding upon the Property and the
successors and assigns in title of Grantee.
Grantor excepts from the property hereby conveyed and reserves unto itrelf, its
successors and assigns, all minerals and mineral rights, inter? ts, and
royalties, including without limiting the generality thereof, oil, gat ,►nd other'
hydroc.rboo substances, as well as metallic or other solid minerals, and under
said property; however, Grantor or its successors and assigns, shall not have
the right for any purpose whatsoever to enter upon, into, or through the surface
of said property in connection therewith.
This Bargain and Sale Deed is made subject to all covenants, conditions,
reatrictions, exceptions, easements, rights-of-way, rights-of-access, agreements,
reservations, encumbrances, liens and other matters as the same may be of record;
any matters Which would be disclosed by survey, investigation or inquiry and
any tax, assessment, or other governmental lien against said property.
TO HAVE AND TO HOLD the same unto Grantee and Grantee's heirs, successors and
assigns forever.
The true and actual consideration paid for the transfer, stated in terms of

SECTION I CONDDITIONS OF APPROVAL:
THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO RECORDING WITH UASHINGTON

1. The applicant shall submit a lot line adjustment survey map and legal
deficription showing both the exi,nting aad proposed lot lines to be reviewed
and approved by the Engineering Department.
2 The applicant shall consolidate the necessary tax lots through Washington
County in order to extinguirh the existence of four of the seven tali lots.
The lot line adjustment survey and new legals may be recorded Immediately
thereafter.
SECTION II FINDINGS OF FACT:

adjustment map, the existing buildings will maintain a front yard setback greater
than the required 30 feet as specified by the I -L zone. All three lots will
continue to meet the 50 foot minimum average lot width requirement of the I -L
zone; the narrow dimension of proposed lot #3 pertains to the proposed depth of
this parcel and not the width. Therefore, the resultant parcels will not be in
violation any applicable I -L zoning dietrict regulations.
In addition to meeting the above standards, a lot ling; adjustment must also meet
the following special provisions for lots Created through the minor land
partition process. Code Section 18.162.050 requires:

Lot Width: The minimum width of the building envelope area shall
meet the lot requirement of the applicable zoning district.
B. Lot Area: The lot area shall be as required by the applicable zoning

included in the lot area calculation.
