THIS AGREENE T is made effective t21is u. ;:±t March, 1991,
between Phillip Christensen and Sally Christensen (' 4hristensona ")
and Renaissance Homes, Inc. ( "Developer") and John Loewcr
( "Owner ") .
WHEREAS, Developer proposes to subdivide a four -acre parcel
into twelve detached singXe -family building miter. (ale Exhibit A);
and
WHEREAS, Developer Ms entered into an earnest money agreement
with owner to purchase the subject property; and
WHERE7iS, Deve1c er seeks to vacate a portion of the existing
right -of -way for S.W. 76th Avenue, as part of the subdivision plan,
without opposition from adjoining land owners; and
WHEREAS, the south terminus of S.W. 76th Avenue abuts the
Christensens' property at 15685 S.W. 76th Avenue, Tigard, Oregon,
also known as Lot 15, Durham Acres, Washington County, Oregon; and
WHEREAS, Lots 5, 5, and 7 of Ruaaissance Woods IX also abut
the Christensens" pro ?e.-ty; and
WHEREAS, Christensens desire a six -foot cedar fence to provide
a buffer and scree, their property from the new development (g ,a
Exhibit A for appre,limate fence location); and
WHEREAS, the parties have agreed to the construction of a six-
foot, two- sided; god neighbor cedar fence along t?.a common
boundaries between Lots 5, 6, and 7 of Renaissance Woods II and the
Christensens' property; and
WHEREAS, Develbper and Christensens have agreed that the

place within two years of the date of this agreement; and
WHEREAS, Developer and Christensens have agreed that Lots 5,
6, and 7 of Renaissance Woods I1 shall be subject to the

WHEREAS, Developer and Christensens nave agreed that a dead'.

WHEREAS, Developer and Christeneene have further agreed to
share equally the cost of a six-toot, two-sided, good neighbor
cedar fence on the Christensen's, property whore it abute the south
terminus Of S.W. 76th Avenues and
WHEREAS, Developer and Christensens have agreed that the
fencing on the Chrixtensene property where it abuts the south
terminus of 76th Avenue shall lee construct.' Y, upon completion el the
single-family dwellings on Lees 6 and 7 re; Renaiseanco Woods II or
within two years of the date of this Jgreement, whichever is
earaier; and
WHEREAS, the parties Wive agreed that the prevailing party
shall be entitled to attorney,' fees and costa if legal action is
taken to enforce this egreeeent; WOW, THEREFORE
IT IS HEREBY AGYAEED that a six-feet, twe-sided, good neighbor
cedar fence shall be constructed alone the coeron boundaries
between Lots 5, 6, axle 7 of Renaissance Woos II and the
Christensen& peeeTsrtY within two years of the date of this
agreement; (aga Exhibit A); and
IT IS FURTHER AGREED that the above fence shall be constricted
by a contractor, and upon tares, mutually agreeable to the property
owners on either side of the fence; and
IT IS FURTHER AGREED that Lots 5, 6, and 7 of Renaissance
Woods IX shall be sold subject to the requirement that the
purchasers pay one half the cost of constructing the six-foot, two -
sided, good neighbor cedar fence along the coeton boundaries
between their lots and the christensens° property and the
christensens will pay the remaining one half the cost; and
IT IS FURTHER AGREED that a deed restriction shall be placed
on Lots S, 6 nd 7 of Renaissance Woods II, requiring that the
fence be coestruceed within two years from the date of this
agreeene; ard
IT IS FURTHER AGREED that Developer and Chridtensens sha
share equally the cost, of a six-toot two-sided, good neighbor
cedar fonts on the Christensen& prope;ty where it abuts the south
terminus of S. W 7Gth Avenue (lag Exhibit A): and
IT IS FURTHER' AGREED that the fencing on the Chtistehsehat
property Where it abuts the south terminus of S.W. 76th Avenue
shall lio.4 constrUCted upon completion Of the single-family dWellings
on tots 6 and 7 of Rehaissasos Woods II or within two years of the
date of this agreement, whicheVer is earlier: and

not reduced below the minimum lot size established by the
zoning district;
2. By reducing this lot size, the lot or structures(s) on the lot
will not be in violation of the site development or zoniiiyt
district regulations for 'that district; and
3 The resulting ing parcels are in conformity with why dimensional
standards of the zoning district.

C. Lot Frontage: Each lot created through the partition process

a legally recorded minimum 15 foot wide access easement.
D. Setbacks: Setbacks shall be as reciuired by the applicable
zoning district.
E. Front Yard Determination for Flag Lot: When the partiioned
