The findings and conclusions on which the decision is based are noted below. A. FENDING OF FACT 1. Background Both parse were platted in May of 1990 and are included in the Viilage at Summerlake #3 subdivision.. This genelal area was annexed into the City of Tigard in November of 1976 (BC 955). No other land use actions have been approved for these parcels. 2 Vicinity Information The site lies due south of Summerlake Park and Summer Creek. Summerlake Park is owned and maintained by the City of Tigard. This new subdivision is currently developing with single family residences 3. Site Inf rmation and Proposal Description The two subject parcels are appropriately sized single family residential lots for the subdivision. Access to the parcels is from SW Winterlake Drive. Tags lot 5800 has developed with a single family home. The applicant is requesting to adjust the commonroperty line between two residential parcels. parcels p els are appro:drate ly 71119 and 8,375 s square feet. The proposed Lot Line Adjustment will result in two parcels of approximately '7,802 and 7,693 square feet. Therefore, this present application, if approved, will bring these items into conformance with the approved utilities plan 4. Agency and NPO Comments The City of Tigard Engineering Department has reviewed the proposal and has the following comments: 1. The applicant has pP scbmitted a vicinity map and a plat of the proposed lot line adjustment. The reason for the adjustment is due to a construction staking error which resulted in the driveway curb cut for tax lot 5700, an electrical power transformer, the water meters and electrical services for tax lots 5700 and 5800 being located in relation to the new proposed lot line rather than the existing lot line 2. After review of all existing data there does not appear to be any easements that would k:a in conflict with the adjustment. The City of Tigard Building Departeet has reviewed the proposal and has the following comment: There is an existing house at 12675 SW Winterlake Drive (Lot 97) . An additional lot is not created by the lot line adjustment,, and the existing parcel reducer in size by the adjustments is not reduced below the minimum lot size established by the approved zoning for that district; 2. By reducing the lot size, the lot or structure (s) on the lot will not be in violation of the site development or zoning district regulations for that district; In addition to the above criteria, the provisions of the Code Section 18 162.040 shall also apply to lot line ad jusrtments This section requires that: a) the proposal conforms with the City's comprehensive plan, all statutory and ordinance requirements and t�egulations adequate public facilities serve the proposal; all proposed lots conform dimensional requirements of all proposed improvements applicable agency etandarda. The proposal conforms with the City's Comprehensive Plan in that the land will remain zoned for Low Density Residential use, All other statutory w:nd ordinance ,0equirements will be met as well.
