The eastern property line of tax lot 1001 will be moved one foot to the east. This adjustment will have a negligible effect on the total acreage. The findings and conclusions on which the d eca.oion to based are noted below. A. FINDING OF FACT 1. nackg ound Both parcel® became part of the City as a result of the original incorporation in September of 1961. The Chevron station had been constructed prior to this incorporation. A Sign Code Exception was approved by the Planning Commission in December, 1987 ( SCE 87-03) :!rich allowed the continued use of an existing 45 foot high freestanding sign, the retention of an existing 322 square foot sign, and they continued use of two freestanding signs (the logo zign and a price sign). A Variance was approved by the Planning Commission on February 7, 1989 (V a9 e43) which allowed for a freeway-oriented sign that is located approximately 220 feet . g' y right-of-way where a maximum setback of 200 from the Hi i•.9S 217 �i feet is required. This Final Order also approved a variance to allow two fr®_tatandi g signs on one streee frontage where the Code allows one No other land mae applications have been eeceiveed. 2. Vicinity Information Pacific Crossroads shopping complex abuts the site to the east. OC Pacific Highway abuts the site on its southern boundary. All of the properties which are located to the east and south of the subject parcels are zoned C -G (General Commercial) . The prr ", erties to the vest are zoned C-P (Commercial 'Professional) a 1d are developed as the General Motoru Training Center. The parcels which are located to the north are zoned R -7 (Residential, , 7 units per acre) and are developed with single .family residences. NOTICE OF DECISIOh MIS 90-0013 CHEVRON PAGE 1 LEGIBILITY STR . Site Information - nd Proposal Description Tax tot 1001 is developed as a Chevron service station and is zonlac, C -G (1eneral Commercial) . Tax lot 1000 is zoned C -P (Commercial Professional) end is presently undeveloped. This undeveloped parcel slopes upward to the north and is cover d by brush and low- lying grasses. The applicant requests Lot Line Adjustment approval to adjust a common property line one foot to the east. Presently, the easternmost driveway access encroaches approximately two inches into the southeast corner or taco lot 1001. By adjusting this property line one foot to the east, this encroachment will, no longer exist. 4. agency and NPO Comments The City Engineering Division has reviewed the proposal and has the following comments: The applicant has submitted a lot line adjustment survey. There are currently no City sewers along the property line which is to be adjusted. The City of Tigard Building Division, NPO #8, State of Oregon Highway Department, and Metzger Watsr District have all reviewed the proposal and have no objections to it L other comments have been received. f NALYSIS AND CONCLUSION Section 18.162.060 of Tigard's Community Development Code contains standards whereby the Director or his designee may approve, approve with conditions, or deny a lot line adjustment request. These criteria are 1 An additional lot is not crested by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the approved zoning for that district; 2 By reducing the lot size, the lot or structure (s) on the lot wilt not be in violation of the site development or zoning district regulations for that district In addition to the above criteria, the provisions of the Code Section ?,8.162.040 shall also apply to lot line adjustments. This section requires that a) the proposal conforms with the City's comprehensive plan, all` statutory and ordinance requirements and regulations; NOTICE OF DECISION MIS 90 -0013 CHEVRON PAGE 2 b) adequate public facilities are available to serve the proposal; c) all proposed lots conform to the size and dimensional requirements of this title; and d) all proposed improvements meet city and applicable agency standards. The proposal conforms with the City's Comprehensive Plan in that the land will remain zoned for Ccmmercial Professional and General Comm rcial uses.
