Eaekground Tax lot 1400 (see ' xhibit A) was anne :ee into the City in Hay, 1982 (Boendary Commission file no 1766!_. Tax lot 1200 was annexed into the City in May, 1988 ( BC' file no. 2488) . No other applications for these parcels have be a n reviewed by the Planning Divisi ,n. 2. Vicinity Information Some of the properties surrounding the site are within the Tigard city limits, ewe are in Wa ehincfton. County. Refer to Map 1 for detailed information abeet the zoning designations in the area Benchview Estates I subdivi ®ion Le currently being developed on an adjacent site to the west. A proposal for the development, of Benchview Estates II is currently being reviewed by the City. The rest of the area surrounding the site is essentially undeveloped. 3. Site Information and Propos 1 Description The site slopes upward to the southwest, ;tncreasing in elevation vaton from approximately 330 feat at the northern property line to approximately 550 feet at the aouthe:en property line. A deep ravine rune along the west property line of tax lot 1400. Approximately twro- thirdle of tax lot 1400 and hall' of tax lot 1200 are covered with scrub and Douglas Fir trees. ANALYSIS AND CONCLUSION The proposal meets the standards for lot line adjustment approval contained in Code Section 19..162.060 in that no additional lot would be created and neither lot would be reduced in ize below the minimum lot size. The proposal also aat sf ie = the approval criteria of Sectioaa 18.162.040 with the exception of the lot depth to width ratio which will be dismissed in the following paragraph. Site Access Staff's only remaining concern is how access to the site will be provided. The terrain is prohibitive with respect to street alignment, offering the s,pplicanta few alternatives for locating a street to serve feturo residential lots. Staff points out that the prospective devebopers of the Benchview II subdivision on the adjacent lot to the west have submitted a preliminary subdivision plan showing a street connection between SW 132nd and the private drive that currently serves tax lot 1200 from Bull Mountain Road. Staff encourages the applicants to work with the prospective eenchview developers to come to an agreement concerning access. In addition, staff notes th A% a future request for a variance to the street grade requirement® dill likely be viewed with disfavor. APPORTIONMENT, if the land described in Schedule (At(C)conslats of two or more parcels Which are not Used as a single site, and a loss Is established affecting one or More of the parcels but not all, the loss shall be compUted and settled on a pro rata basis as if the amount of the Company and the insured at the time of the issuance of this policy and shown by an express statement or by an endorsement attached to this policy. 9. LIMITATION OF LIABILITY. (a) if the Company establishes the title, or removes the alleged defect, lien or encumbrance, or cures the lack of a right of access to or from the land; or cures the claim of unmarketability of title, all as Insured, in a reasonably diligent manner by any method, including litigation and the completion of any, appeals therefrom, it shall have fully performed its obligations with respect to that matter and shall not be liable for any loss or damage caused thereby. (b) In the event of any litigation, including litita- tion by the Company or. ?.pith the Company's consent, the Company shall have no liability for loss or damage until there has been a final determination by a court of competent jurisdiction, and disposition of all appeals therefrom, adverse to the title as insured. (c) The Company shell not be liable for loss or damage to any insured for liabilityveluntaeiyassumed by the insured in settling any claim or suit without the prior written consent of the Company. 10. REDUCTION OF INSURANCE; REDUCTION OR TERMINATION OF LIABILITY.
