TIGARD PLANNING COMMISSION
STAFF MEMORANDUM
February 4, 1975
SUBJECT: Determination of Land Use Classification in a C-3 zone.
•
An application has been received for a business license for an
"Auto Parts and Machine Shop" establishment at 13578 S. W. Pacific
Highway (Heinz Volkswagen Service occupies the building now and
will also continue to occupy it) .
Auto parts sales and automotive repairs are both conditionally
allowed in a C-3 zone.
Machine shops are allowed by conditional use permit in an M-4 zone
and are allowed outright in an M-3 zone.
There are presently at least two such shops operating in Tigard on
sites zoned C-3. One is in a portion of the Goodell ARCO service
station/garage/carwash on Main Street and the other is in an Auto
parts store at 87th and Center St. Neither of these establishments
is a conforming use in staff' s opinion. It appears that each is
prepared to claim that they pre-exist zoning in Tigard (if, .n
fact, they don't claim to have founded the place) . The point,
however, is that there are several questions to be resolved by
the Planning Commission.

The first question is whether a machine shop is allowable in a C-3
zone. Is any machine shop, whether automotive or farm machinery
less intensive or no more intensive than other uses allowed in a
C-3 zc.ne? Is a machine shop compatible in such a zone? What im-
pact dos such use have on the use, present or future, of adjacent
sites?
In this particular case thereis an additional question. Heinz has
been allowed status of an outright use because the bus barn that
preceeded him had been there before the zoning ordinance and the
City held that Heinz establishment was just like the establishment
that had originally been "grandfathered". Now, along comes the
,•, applicant see :.i.r4 shelter under Heinz's grandfather clause. The
question is, does Heinz 's grandfather clause extend to another
different establishment.?
