Storm Drainac!e: Effective December 10 1991, the City is requires* to comply with a new requirement of the State Environmental Quality Commission (War!). The EQC is requiring that a:.1 new developments which add additional impervious surface area within Unified Sewerage Agency (USA) jurisdiction mint include a water quality treatment facility. Previously, developments without a suitable site fox' water quality treatment were allowed to pay a fee in lieu of on- site watex quality treatment, These fees would the be used to construct regional facilities. The Engineering Department feels that these new requirements are inappropriate. It is not feasible for many small developments to build on -site facilities. Construction of numerous small facilities will create maintenance problems both for cities and USA. ilowever0 effective December 1, 1991, the City must require these facilities or be its violation of State regulations. The issue of on --site water quality treatment facilities was not addressed in earlier staff reports, as the City expected the issue between USA and the ESC to be resolved. The City is still hopeful that this issue will be resolved within the next three months. Therefore, although the applicant should be required to install a water quality facility, the City Engineer may be allowed to waive this requirement if the regulations are amended. 2. The City of Tigard Operations Department, Portland General Electric, School District # 3J, Tualatin Fire Districts General Telephone FA Electronics, Tigard Building Divivsion and Ticard Water District have reviewed the proposal and have offered no comments or objections.
