8. PLANNING FEE WAIVER POLICY DISCUSSION
a. Community Development Director presented options for addressing ,
fee waiver requests. Those options were: .,
1. Grant fee waivers as requested on a case by case basis
(i.e. for City imposed hardships).
2. Grant
partial fee waivers on a case my case basis where the
applicant is filing ''for'more than one land, use. action' (i.e,
25% total fee discount)
3. Consider initiating a policy whereby fees for land use
actions could be deferred under certain circumstances until
the property is sold or development (i.e. record liens).
4. Charge full fees at all times but regularlye fee

AN ORDINANCE AMENDING AND REVISING THE FLOODPLAIN AND WETLANDS MAP OF THE
COMPREHENSIVE PLAN. (CPA 27-84)
WHEREAS, the City of Tigard adopted a Comprehensive Plan for the City by
Ordinance 83-52 on November 9, 1983; and
WHEREAS, Volume 1 — Resource Document, Volume 2 — Findings, Policies, and
Implementation Strategies, Volume 8 m y Development Code and the

Floodplain and Wetlands Map were adopted a part of the Comprehensive Plan; and
WHEREAS, a public hearing was held before the Planning Commission on February
5, 1985, to consider designating Mallard Lakes as wetlands and a
recommendation was made to the City Council; and
WHEREAS, a public hearing was held before the City Council on February 25,
1985, for Council consideration of the Planning Commission's recommendation'.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Floodplain and Wetlands Map of the Tigard Comprehensive Plan
is hereby amended to designate Mallard Lakes as wetlands as set
forth in attached Exhibit "A",
Section 2 This Ordinance shall be, effective on and after the 30th day

and staff's problem with policing illegalsigns, the need to remove
doubt as to_ the type of signs not permitted in the Code, and

SUB.'ECT: Mallard Lakes — Wetlands Designation
On November 13, 1984, the Planning Commission voted unanimously to direct
staff to initiate a Comprehensive Plan Amendment to designate the Mallard Lake
property as Sensitive Lands. (See attached minutes.)
In the staff report for the Mallard Lake Subdivision Planned Development,
Subdivision, Zone Change, and Variance request staff pointed out that only the
ponds and shore area meet the wetlands definikion. The definition oY wetlands
is as follows:
Wetlands Lands transitional between terrestrial and aquatic'systems where
the water table is usually at or near (within 24"' of) the
surface of the land is covered by shallow water. For purposes
of this classification, wetlands must have one or more of the
following3 attributes: periodically, the, land
(1) at least eriodica
supports predominantly hydrophytes); (2) the substrate, is
predominantly hydric soil; (3) the substrate is non--soil
and .is saturated with water or covered by shallow water at some
,, time during the growing of each yea

The pnnds were not identified as an area, with important val as for
wildlife by the Department of Fish and Wildlife in a 1976 ;aurvey. In
addition, a representative of the State Audobon Society reviewed the areas
named by the City as areas with important values for wildlife and did not
include the ponds 'in question. For these reasons, the ponds are not
classified as significant wildlife areas. Significant wetlands identified on
the City's Flood plain and Wetlands Map are those areas where conflicting uses
will not be allowed because e.)f their impact on environmental or resource value
of the site. In the case of the ponds at Mallard Lakes, only the ponds
themselves need to be protected, the land beyond the shoreline is not
significant in it ,eIf and does not warrant special protection. Since there is
no reason to limit conflicting uses an land 0=.round the por ; s, the area does
not qualify as a significant wetland a�l.rea.

2. Background
proposal for a subdivision and planned development was reviewed by the
Planning Commission on September 4, 198•'�, and October 2, 1984, (Wardin,
S 9--84/PD 4--84). During this review, it was revealed that the City
floodplain and wetlands map does not include this property but the
evidence presented indicated that this area might warrant a wetlands
designation. At their November. 13, 1984, meeting, the Planning,
Commission moved to have this issue resolved at a public hearing.
3. Site Information and Description
both parcels are undeveloped. the western property contains two ponds
in the northern portion and the eastern tract is a shallow ravine that
is owned by the City.
The Er .ineer. ng Division indicates that the water table is at the
surface of'the ponds all year and a natural spring exists at the, head of
the ravine. The soils in this area are also subject to erosion. ,

B, FINDINGS AND CONCLUSIONS
The relevant criteria in this case are Statewide Planning Goals 1 and 2;
Tigard Comprehensive Plan policies 3.1,1 and 3.4,1; and Chapter 18,26 of
the Community Development Code.
The Planning staff concludes that the proposal is consistent with the
applicable Statewide Planning Goals and Guidelines based upon the
following findings:

addition, all public notice requirements were met.

Policies and Development Code requiremo.nts to the application,
c. Statewide Planning Goal # 5 is met because the City has adopted
planning pol::,cies to protect significant wetlands areas
specifically, policies 3.1.1 and 3.4,1. In addition, the City has
adopted standards for development on land adjacent to significant
wetlands. Those standards are contained in Chapter 18.84 of the
Community Development Code.
The Planning staff concludes that the proposal is consistent with the

APPLICANT'S PRESENTATION:
o Bill McMonagle, Harris-McMonagle, 8905 SW Commercial Street, were
concerned about conditions number 9 and 10. On condition number nine
they would like the words "at the time of approval, if applicable"
added. They request conditions number ten to be eliminated because
the ponds are to be maintained by a Homeowners Association andthey
did not feel it was appropriate to have a bikepath which would allow
'the' public to use a private common area.
PUBLIC TESTIMONY
o Tom ;Arvidson, 8885 SW Scheckla, lot 23 east 'of the lower pond,
opposed having a 50' foot, road between the ponds as it would require
to much filling of the ponds to accomplish.
o' Connie Smith, 8860 SW Scheckla` Drive., representing NPU 6,' was
concerned that the new plans had not, been made available for the NPO
to review prior to the meeting. She did' not feel the plan submitted
reflected what the NPO and Developer had agreed to. Also, there was
to be a landscape plan submitted
o Iona Hansel, 8880 SW Scheckla, recommended that the ponds be keep in
their natural state. She was concerned about the width of the road
and that no landscaping plan had been submitted. She favored a
private drive to keep the road between the two

o Myron Recob, 8795 SW Reiling, opposed the development because the
size of the lots would not blend in with the surroundngsubdivisions.

John Hansel, 8880 SW Scheckla Drive, opposed the' development as it is
not in character with the surr.ouuding properties.
o' Kirk Smith, 8860 SW Scheckta Drive„ opposed the development. He
stated that their are. two bedroom homes being proposed when all the
surrounding home are 3 bedrooms. He did not feel, the proposal is

pathway.
o Commissioner Campbell supported the proposal. eliminating the parking.
- o Commissioner Fyre, generally was not in favor 'of the proposal. He
was concerned about the difference in opinion of ' the IPO and the
developer. He felt a 25' road was a good compromise instead of the
50' road originally proposed.
o Commissioner Owens favored' the changes proposed with the road width
being decreased.
* Commissioner Butler moved and Commissioner Bergmann seconded to '
approve ZC 12-84, PD 4-84, S 9-84 and V 15-84 with the following
changes from the staff report:
o Change condition number 8. to tlidewalks on both side,
deleting parking (put up no parking signs) subject to the
approval of, the Engineering Division. Otherwise, eliminate
sidewalk from one side.
o Condition number 9. add, "at time of approval, if
applicable.
o Delete conditions number 10 for the pedestrian/bicycle path. '
o Delete, condition number 6. (Variance approved).
o Lot number seven.. to be moved to fit in with lots 8, 9', and
10, if possible.

soils test he had taken that morning. He also submitted a map
showing where the test had been taken. He contended that there was
no problem with 'the soil.
o Bill McMonagle, Harris-McMonagle, opposed designating the property as
wetlands. He reviewed the topography of the :site, stating the
property to the north of the ponds is completely developable and the
ponds saveable.
o Mark Weintraub, 1200 S,W. Main, Portland, Attorney for G. Ferd
Wardin, opposed the application. He contended that 'sufficient notice
had not been cjiven to conduct a hearing, citing guideline State Goal
#2, which rzquires 30 days notice. He felt the application was
inappropriate as there it' an appeal before City Council which has not
been heard. He also felt there was a conflict of interest, He
reviewed reasons why designating the property wetlands would be a bad
idea

AN ORDINANCE AMENDING AND REVISING THE FLOODPLAIN AND WETLANDS MAP OF THE
COMPREHENSIVE PLAN. (CPA 27-84)
WHEREAS, the City of Tigard ado ted a Comprehensive Plan for the City by
Ordinance 83-52 on November 9, 1983, and
WHEREAS, Volume 1 - Resource Document, Volume 2 — Findings, Policies, and
Implementation Strategies, Volume 3 — Community Development Code and the
Floodplain and Wetlands Map were adopted as part of the Comprehensive Plan; and 4
WHEREAS, a public hearing was held before the Planning Commission on February
5, 1935, to consider designating Mallard Lakes as wetlands and a
recommendat° on was made to the City Council;; ail'..`
WHEREAS, a public hearing was held before the City Council on February 25,
1955, for Council consideration of the Planning Commission's recommendation
THE CITY OF TIGARD ORDAINS AS FOLLOWS
Section 1: The Floodplain and Wetlands Map of the Tigard Comprehensive Plan
is hereby 'amended to designate Mallard Lakes as wetlands as set
forth in attached Exhibit "A",
Section 2: This Ordinance shall be effective on and after the 30th day
after it is enactment by the Council and approvalby the Mayor. •
