Associate Planner Newton explained problems which have resulted because of
the setback requirements in the Commercial General and Commercial
- Professional Zone. Staff recommends forward a recommendation to city li
g Pyard Council. amending the CommunityDevelopment Code deleting front and
corner lot setbacks in the CP, CG and CBD zones. The Visual Clearance
Areas section of the Code should be referenced where to setbacks are
required.

11. COMPREHENSIVE PLAN AMENDMENT/CPA 10-84/COMMUNITY DEVELOPMENT CODE . '
A recommendation by the City of Tigard Planning Commission regarding
various sections of the Community Development Code. A complete list of
the fections recommended for amendments and the proposed language
changes are available in the City's Planning Department.
a. Public Hearing Reopened
b. Planning Director commented some of the changes suggested on the
errata sheet were by other agencies which have reviewed the
Comprehensive Plan. Most changes were recommended by staff as a
result of having implemented the code for the last few months.
Changes recommended are primarily for clarification of sections of
the code. Planning Commission recommended changes ad staff
recommended approval.
c. Public Testimony
Mary Clinton, 9865 S.W. View Court, Tigard, Oregon, commented on
Section 18.98.030 and suggested the insertion of the word "Or" any
abutting lot. She also proposed that flag lots chould be in
larger areas because of setbacks. This would be a more
restrictive requirement.
Staff responded they felt Mrs. Clinton's recommendation was too
restrictive and changes the meaning entirely.
Public Hearing Closed.
d. Motion by Councilor Cook, seconded by Councilor Scott to direct
staff to prepare an ordinance with the Planning Commission's
recommendation for the May 14, 1984 meeting.
Motion approved by unanimous vote of Council present.

During the process of implementing and admin+ stering the Community Development

setbacks in the C-G and C-P zones are inconsistent and limit )�lexibility of
development. The setbacks in the C-G zone currently are:
1. The front yard setback shall be 10 feet.
2 On corner lots and through lots, the setback shall be 20 feet on
any side f, a r street, however, the provisions of Chapter
18.102 (VISUAL CLEARANCE) must be satisfied.
3. Ni side yard setback shall be required, except 20 feet shall be

also required to meet Access and Egress Provisions (Chapter 18.108),
Landscaping and Screening Provisions tChapter 18.100), tiff-Street Parking and
